RECOMMENDED ACTION:
Staff is recommending that the City Council, by minute motion,
establish September 20, 1983, as the date for the third Land Use
Element amendment hearing with an application deadline of June 1,
1983.
ITEM EXPLANATION:
State law.permits the City to amend the Land Use Element of the
General Plan three times a year. The City Council's adopted
yearly schedule (attached) provides for two hearings, one in June
and the other in November. The third hearing is a "floater" and
can be used when the Council deems it appropriate.
The City has received a letter (attached) from the Hunt Proper-
ties requesting that the third or floating hearing be scheduled
at such a time where the Hunt amendments can be processed as
early as possible. They have just started processing an EIR and
should be ready for an amendment in early September of this year.
Staff sees no problem with this request as the City has no urgent
amendments to the Land Use Element at this time.
Finally, staff would recommend that the following deadline for
receiving applications be established; June 1, 1983. Projects
needing an EIR that have not submitted their application by
March 1, 1983P will have to wait until the November hearing.
ENVIRONMENT REVIEW:
No environmental review is required.
FISCAL IMPACT;
There will be no direct fiscal impact from this Council action.

Dear Mr. Aleshire:
Under separate cover HPI Development Company has tendered to
the City of Carlsbad it's annexation application and environ-
mental information relating to our Rancho LaCosta parcel. In
consideration of the magnitude and complexity of this project,
we respectfully request a special hearing by the Carlsbad City
Council for the consideration of our general plan amendment and
pre-annexation-application.

It is our desire to schedule the public hearing
possible time. Certainly a project of this nature
special hearing and the level of public interest surrounding
this topic would seem to indicate the need for early scheduling
We appreciate the support we have received from you, your City
Council and your staff and we look forward to working closely
with all of you in the future.
Kindest regards,
