RECOMMENDED ACTION: Both the Planning staff and Planning Commission recommend that this application be APPROVED and that the City Council introduce Ordinance No. YbpBS ITEM EXPLANATION: This item is a zone code amendment that would regulate parking of private vehicles and recreational vehicles on residential lots. This item was previously considered by the City Council at its meeting of February 1, 1983. At that time, the Council expressed two concerns with the amendment: 1) the feasibility of enforce- ment of prohibiting R.V.'s from parking in the front yard set- back; and 2) the 30% parking area limitation of cars which park in the front yard setback on lots which have less than the required street frontage (e.g., cul-de-sac lots). Since that meeting, staff has conducted a survey of 422 resi- dences to determine the percentage of homes which have R.V.'s and, of these, the number of homes which park R.V.'s in the front yard setback and/or side setback. It was found that of all homes which have R.V.'s, most park their R.V.'s in the side yard adjacent to the house. Staff believes that it would be feasible to enforce an ordinance prohibiting R.V.'s from parking in the front yard setback. Staff also believes, however, that the requirement of a screen wall for those homes which park their R.V.'s in the side .yard would create an unnecessary hardship. For that reason, both the Planning Commission and staff is recommending that the requirement of a screen wall for R.V.'s parked in the interior side yard or rear yard be deleted. The screening requirement would still be in effect for private cars. With respect to the 30% area requirement for parking areas in the front yard setback, staff is recommending that the allowable area be 30% of the front yard areas or a minimum width of 24 feet, whichever is greater. This willensure that cul-de-sac lots are not unfairly restricted. Through staff review and Planning Commission hearing, all issues on this matter have been satisfactorily resolved, EXHIBITS: 1. APPLICANT: CITY OF CARLSBAD CASE NO.: ZCA-154 WHEREAS, the Planning Commission did, on the 12th day o€ January, 1983, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the zone code amendment. WHEREAS, this item was reconsidered by the Planning Commission on March 9, 1983, at the direction of the City Council. B) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of ZCA-154, according to Exhibit "A", dated March 1, 1983, attached hereto and made a part hereof, based on the following findings: Findings: This zone code amendment is consistent with the General Plan's intent of preserving the public's health, safety and welfare since it will ensure that private and recreational vehicles will not visually degrade or detract from the residential character of a neighborhood. This zone code amendment is consistent with the intent of the residential zones which is to allow residential uses and to not permit excessive storage of vehicles. I, RECOMMENDATION It is recommended that the Planning Commission ADOPT Resolution No. 2092 as modified recommending APPROVAL of ZCA-154, based on the findings contained therein. 11. DISCUSSION This item was previously approved by the Planning Commission on January 12, 1983. At that time, the Planning Commission recom- mended to the City Council the adoption of an ordinance that would: Allow the parking of private vehicles, other than recrea- ational vehicles and inoperable vehicles, in the setback areas only in a defined parking area which does not exceed 30% of the required yard area; and Prohibit the parking of recreational vehicles in the street setback areas for periods in excess of 24 hours. The amendment would permit the parking of recreational vehicles on other portions of a lot if they arc screened by a solid six-foot high wall or fence; and Incorporate the provisions of Section 10.52 (Abandoned Vehicles) of the Municipal Code into the Zoning Ordinance. This section prohibits the parking of inoperable vehicles on private lots for periods in excess of 72 hours unless such vehicles are lawfully located in an enclosed building. Upon review, the City Council expressed two concerns and requested that the Planning Commission take a second look at the ordinance. The two conceriis regard the parking enforcement of recreation vehicles in the front yard setback and the 30% area requirement (#1 above) for lots having less than the minimum street frontage (e.g., cul-de-sac lots). With respect to recreational vehicle parking, the Council believed that the prohibition of recreational vehicle parking in the front yard setback might become unenforceable given the large number of homeowners who park recreational vehicles in the front 7 t yard setback. The Council's concern was backed up by a Building Department survey of homes having recreational vehicles parking in the front yard setback. Most of these homeowners park their recreational vehicles in the side yard setback. Staff believes that the enforcement of the ordinance as presently worded would be difficult. As an alternative, staff would recommend that the ordinance be revised to prohibit the parking of recreational vehicles in the front yard, however, not require the screening of recreational. vehicles from public streets. Requiring a screen wall for all recreational vehicles would be a hardship for a large number of homeowners. Parking recreational vehicles in the side yard, in most cases, would not prevent a hardship. Staff has revised the ordinance to reflect this modification. With regards to the 30% area requirement for parking areas in the front yard setback, a member of Council indicated a concern that this standard might be unreasonable for cul-de-sac lots which have reduced lot frontages. As an alternative, staff is recornmending that the allowable parking area be 30% of the front yard area or a minimum width of 24 feet, whichever is greater. Again, the ordinance has been revised to reflect this change. With these changes, staff is recommending approval of ZCA-154. ATTACHMENTS 1. P.C. Resolution No. 2092 2. I! -' 1 2 3 4 Ir 5 6 7 a 9 10 11 12 13 14 15 16 17 le 19 2c 21 22 22 24 25 26 27 2e ORDINANCE NO. 9668 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21, CHAPTER 21.44, OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF SECTION 21.44.165 TO REGULATE THE PARKING OF VEHICLES ON RESIDENTIAL LOTS. ordain The City Council'of the City of Carlsbad, California, does as follows: SECTION 1: Title 21, Chapter 21.44, of the Carlsbad Municipal Code is amended by the addition of Section 21.44.165 to read as follows: 21 -44.165 Off Street Parking - Residential Zones. In all residential zones the following parking regulations shall apply: (a) Standard lots: (1) No vehicles shall be parked in the required front yard except on a paved driveway or parking area which does not exceed thirty percent of the required front yard area or an area that is comprised of twenty-four feet of width extended from the property line to the front of the building, whichever is greater . recreational vehicle shall be parked in the front yard parking area €or more than twenty-four hours. other than the required front yard subject to the following restrictions: commercial vehicles used as a principle means of transportation for the occupant of the residence may be parked in any other area of the lot provided that they are screened from view from the public right-of-way. Such vehicles may be parked without screening in a paved driveway or parking area which is an extension of the parking area permitted in Subsection (a)(l) provided that the paved driveway or parking area does not exceed the width of the area permitted in Subsection (a)(l). recreational vehicles or one passenger vehicle may be parked without screening only in side yard areas adjacent to the main structure on the lot or rear yards. Such vehicles may only be parked in front of the main structure if they are located outside the required front yard and screened from the public right-of-way. front yard or required street side yard except on a paved driveway or parking area which does not exceed thirty percent of the required yard area or an area that is compri-sed of twenty-four feet of width extended from the property to the front of the building, whichever is greater. (3) Vehicles may be parked in any area of the lot other than the required front or side yard subject to the following restrictions: commercial vehicles used as a principle means of transportation for the occupant of the residence may be parked in any other area of the lot provided that they are screened from view from the public right-of-way. Such the vehicles may be parked without screening in a paved driveway or parking area which is an extension of the parking area permitted in Subsection (b)(l) provided that the paved driveway or parking area does not exceed the width of the area permitted in Subsection (b)(l). or recreational vehicles may be parked without screening only in the interior side yard areas adjacent to the main structure on the lot or rear yards. (1) Storage or parking of inoperable, wrecked, dismantled or abandoned vehicles shall be regulated by Chapter 10.52 of this Code; provided, however, that not more than two vehicles in any inoperable wrecked or dismantled condition may be parked in the areas specified in this section for trailers, travel trailers, camp.ers, boats, or recreational vehicles while said vehicles are being repaired or restored by the owner of the property.
