TITLE: PERMIT A?AD AN APPEXL OF A DEW& OF A SETBACK Both the Planning staff and Planning Commission recommend: 1) CT 83-2/CP-225 be APPROVED and that the City Attorney be directed to prepare documents APPROVING CT 83-2/CP-225, 1 Planning Commission Resolution No. 2090. 2) V-346 be DENIED and that the City Attorney be directed tc prepare.documents DENYING the appeal of V-346, based 6n . findings contained in Resolution No. 2091. ITEM EXPLANATION: This item consists of two requests: 1) A 584-unit tentative tract map and condominium permit, a1 2) An appeal of a Planning Commission denial of a front yarc setback variance for garage structures from 20 feet to 8 feet. The subject site is located as described above and is immediately north of the Spinnaker Hills subdivision. The 584-unit project is on 83 acres and the project's overall density would be 7 dwelling units per acre which is within tl general plan range of 4-10 du's/acre designated for this sitc The project consists of two distinct product types: 1) 192 detached single family patio homes to ,the South; and 2) 392 attached townhouse units to the north. The two product type! east. The Planning Commission found that the project met al: development standards and design criteria of the Planned Development Ordinance and is recommending approval. The Planning Commission denied a variance that would reduce i . setbacks of garages from 20 feet to 8 feet on private street: The Commission was not able to make the mandatory findings fc variance. By minute motion, however, the Planning Commissiol stated that it had no problems with the variance request in terms of project design. Should the Council approve the variance, the Commission suggests that the garages be set bac feet from the curb line instead of 8 feet so that cars would be tempted to park in front of the garage doors, thus, protruding into the street. would be separated by the extension of Poinsettia Lane to thr 1 ' 1 0 PAGE 2 of AB# 733 9 Several homeowners from the Spinnaker Hills subdivision were the Planning Commission hearing and asked questions relating the project. No one was opposed to the project, however, som people expressed concerns with the potential traffic that wou be generated by the project and with the noise and dust impac on Spinnaker Hills during the construction period. The Plann Commission added a condition prohibiting construction equipme from using existing streets in the Spinnaker Hills subdivisio ENVIRONMENTAL REVIEW: The Land Use Planning Manager has determined that this projec will not cause any significant environmental impacts and, therefore, has issued a Negative Declaration, dated February 1983, which was approved by the Planning Commission on March 1983. A copy of the environmental documents is on file in th, Land Use Planning Office. FISCAL IMPACT: The applicant will provide all required public improvements tc the project. Also a variance request to reduce the front yard set on several of the units. The property is located at existing east end of Poinsettia Lane, immediately nc of the Spinnaker Hills development in the RD-PI zone4 I, RECOMMENDATION It is recommended that the Planning Commission ADOPT Resolut: No, 2090 and 'No. 2091, recommending APPROVAL OF CT 83-2/CP-2: and DENIAL of V-346, respectively, to the City Council, base( the findings and subject to the conditions contained therein 11. - PROJECT DESCRIPTION The applicant is requesting two actions. The first is appro1 of a 584 unit planned development on the 83 acre parcel as * described above. The second is a front setback variance for several 'of the units. The proposal involves the development of 192 detached single. family houses on the southern half of the site, and 392 atta units, in sets of four and six-plexes on the northern half, shown on Exhibit "A". The detached units are situated on 45, foot wide lots with varying (front and side) setbacks, elevations, and roof lines. A 12-15 foot wide landscape scr is proposed along the southerly lot 1in.e to buffer the exist single family development to the south from this development The southerly (detached) units with their individual. lots, a separated from the attached (postage stamp) units by the extension of Poinsettia Lane. Only two points of access wil taken off this arterial. The extension of Batiquitos Drive northward will serve as the main collector for the northern units. The developer has proposed two. types of attached units. Typ units contain a rear-loading two-car garage. Type B units possess a one-car front yard garage with the additional resi parking space in a garage located on the ends of individual buildings. Most of the easterly units will have ocean views .. w e. The pLoposed density for the project is 7 du/ac which is withi the 4-10 dudac range designated for this site by the Land Use Element of the General Plan. The site is presently vacant with few outstanding natural features. A major recreation area will be incorporated into a small, natural geologic ampitheater. Approximately 420,000 cu yards of earthwork are expected for development of the project This grading will have an average deviation from natural contours of about 3.1 feet. 111. ANALYSIS - CT/CP Planning Issues 1) Does the proposed project satisfy all design criteri and development standards of the Planned Development Qrdinance? 2) Is the project compatible with surrounding developme .. Discussion Staff believes that the proposed project does meet the design criteria and development standards of the Planned Development Ordinance. The linear streets of the southerly (detached) portion should be adequately broken-up by substantial front an side yard setback variation,. and variety in orientation, heigh and pitch of rooflines. The alignment of Ivy Street and A Street is such that through traffic from surrounding developme will not be encouraged. The site plan of the northern (attached) portion is regulated a great degree by the developers chosen product type and the desire to maximize the number of units possessing ocean views. The relatively linear streets, occasional garage court, and extensive asphalt use are a result of these factors. The unit are "vehicle-oriented" in that most (all type A) possess a two car garage at the unit. The remainder (type B), have one resident space directly in front of the unit and the second in nearby garage. In a small percentage of the cases (15%) this garage is 550-200 feet from the unit. Guest parking is provid on private and public streets, in all cases directly in front the units., The vast majority of the drives run north- south s that units will have a westerly views. Two major recreation areas and a small passive area are well interspersed throughout the development. The units also nave private patios, and in some cases, balconies. Recreational vehicle storage to accomodate approximately 30 vehicles is proposed on the western boundary of the site. Overall, staff bel-ieves that the proposed development satisfie the requirements of the Planned Development Ordinance. -2- . - .. w 0 The project is compatible with existing and future land uses ir the area. The southern (detached) units provide an excellent transition between the 7500 sq.ft lot single family development condominium project> CT 82-30 (Pacesetter) has already'been approved to the west. _., In summary, staff supports the project and recommends approval, IV. ANALYSIS - VARIANCE Planning Issues to the south and the attached units to the north, A similar 1) Are there exceptional or extraordinary circumstances applicable to the property that do not apply general11 to other property in the vicinity? 2) Is this variance necessary for the preservation of a substantial property right denied the property in question? .. 3) Will this variance be materially detrimental to the public welfare? 4) Will this variance adversely affect the general plan? Discussion The applicant is requesting a front setback variance on all Ty I3 units (front-loaded single-car garages) on the northern port of the site, only when directly across this street from the rear-loaded Type A units. The applicant has indicated that th redu,ction from the required 20 foot setback is requested only follows: - First, whenever a setback is reduced on one side of a street, it will be increased by that same amount on the opposite side of the street. Second, that the variance w only apply to units on private streets. Third, that it w only reduce the setback on the B unit side (those with .front-loaded, single garage driveways). Finally, that th distances between the buildings across a street will not reduced. The result.of this variance would be an increased usable yard front of the A units (rear-loaded double garages) across the street and reduce the amount of driveway paving, generally enhancing the overall street scene. The site plan in the Planning Commission packet does not refle the variance request. The applicant will demonstrate his requ at the Commission meeting. While staff agrees that the concept of the request would creat an improved project, we cannot make t-he first two required findings.
