RECOMMENDED ACTION:
Adopt Resolution ~0.72~3 amending the Consultant Agreement with McDaniel Engineering Company to permit earlier payment of fees.

I ITEM EXPLANATION:
On January 6, 1981, the City Council adopted Resolution No. 6396 approving an agreement with McDaniel Engineering Company,to prepare the plans and specifications for a bridge over the Agua Hedionda Lagoon on Carlsbad Boulevard. The agreement provides for certain percentages of the contract amount to be paid in progress payments to the Consultant prior to completion and approval of the work. The Consultant desires to increase the percentages of the progress payments as follows: Current Proposed Total of incremental payments based on evidence of work accompl i shed. 75% . 90%
Total payment upon completion of the design package.
Total payment upon completion of con- struction of project.

The City Engineer has reviewed the proposed payment schedule revisions and finds them acceptable.
I FISCAL IMPACT:
No change in the total contract amount of $125,608 will occur under this revision. The Consultant, however, has been paid 75% of the contract amount and under this revision will become eligible for an additional 15% prior to the completion of the plans and specifications, subject to the approval of the City Engineer.
The Consultant has agreed to complete final plans and specifications
for the roadway by May 1, 1983, and for the bridge by July 1, 1983.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
MENT WITH McDANIEL ENGINEERING COMPANY.
OF CARLSBAD, CALIFORNIA, AMENDING AN AGREE-

The City Council of the City of Carlsbad, California, does
hereby resolve as follows:
That the certain agreement between McDaniel Engineering Company
and the City, dated January 22, 1981, is hereby modified as
by replacing Paragraph 2, Lines 3-11 of Contract Article V, with
the following:
"After receiving notice to proceed on the final design
package, incremental payments may be authorized upon
submission of evidence of work accomplished up to a total of
90% of total lump sum fee for the civil design package. Upon
final approval of the final design package, an additional incre
mental 5% will be paid (up to 95% of the total lump sum fee for
the civil design package). The remaining 5% shall become due
and payable at the completion of the construction of Project,
but no later than two years from date of approval of the final
design providing all work under this agreement is completed and
approved by Engineer . I'
