Authorize non -budgeted expenditure of not more than $2,000 for membership fees and for teleprinter equipment. DISCUSSION: SSION: AB 3019 (Elder) passed by last year's legislature, requires that all agencies owning underground facilities in the public right-of-way become members of a regional notification center by July 1, 1983. The regional notification center in our area is Underground Service Alert of Southern California. THe proposed compliance plan is attached as Exhibit 1. FISCAL IMPACT: There will be a one-time charge of about $1,500 for the purchase of a teleprinter. Annual membership dues are $300 and a maintenance contract for the teleprinter will be $200 - $250. There are funds available in the FY 82-83 Water and Sanitation budget to defray the first year costs. Future costs may be recovered from the Engineering permit fees. Additionally, a more comprehensive one -call notification system will reduce liability for damage to underground facilities. EXHIBITS: I. L1 W 0- 83-028 U 123 MARCH 4, 1983 TO: CITY MANAGER �I CITY ATTORNEY FROM: DIRECTOR UTILITIES COMPLIANCE PLAN for AB3019, SUBSURFACE INSTALLATIONS AB3019 requires that all operators of subsurface installations within public streets become members of a regional notification center by July 1, 1983. This is more popularly known as a "one -call" service and in our area is provided by Underground Service Alert (USA) of Southern California. Underground Service Alert is a non-profit corporation formed by major utilities in our area. They comprise the principal members of the organization and provide the majority of funding. Cities and smaller utilities will join as Associate Members and contributions will be based on population (50a/1000) and/or trench miles with a minimum charge of $25 monthly. We will be assessed at the minimum rate for membership. Additionally, we will be billed at the rate of $1.25 per call for all calls up to 30 per month, $1.50 per call from 30-60 and $1.75 for all calls over 60. Alternatively, it is required that we install a tele- printer if the average number of calls is over 30 per month. Teleprinter costs vary in price, however I believe we can obtain a unit sufficient for our needs for about $1500 and an annual maintenance cost of $200 - $250 per year. We average about 20 mark outs per month at the present time. I anticipate a significant increase in calls, as every excavator will call the single number even though they would not have called us in the past. The USA system is not sufficiently precise to identify discrete locations. We will get a call if we have facilities within a radius of 500 feet of any dig. Therefore, I believe a teleterminal is required and will save money when compared to the telephone rates. There are three specific functions that must be accomplished by City staff. These are outlined below with the recommended action department. City Mgr/Att. -2- March 4, 1983 1. Permiting of excavation in the public right-of-way and noticing of excavator of the requirement to utilize USA for mark outs. Annual dues can be recovered from the permit fees - Engineering. 2. Receipt of excavation information and mark out of city underground facilities, costs of communications terminal to be borne by the individual utility funds (water, sanitation, street light) admin- istered by Utilities Director, Utilities. 3. Permit validation - excavation permits may be issued prior to notification of USA, however they are validated by a call number provided by USA. These can be verified by engineer inspectors as a part of their inspection responsibilities - Engineering. rngT UMMARY Annual Membership $ 300 Teleprinter 1500 Maintenance Contract 200-250 $2000-2250 Membership in USA is accomplished by a standard agreement which I will provide the City Attorney for review. USA has provided a briefing to interested city staff including engineering so all are aware of the program. The programs I have outlined above is our consensus on how the system will work. Funds are available to implement the program in this fiscal year. Request your concurrence to proceed. That certain agreement between the City of Carlsbad and the Principal Parties of the Underground Service Alert of "outhern California, a copy of which is attached hereto and incorporated herein by reference, is hereby approved. 2. The Mayor of the City of Carlsbad is hereby authorized and directed to execute said agreement for and on behalf of the City of Carlsbad. C LER, Mayor f EXHIBIT 2 ASSOCIATE PARTY AGREEMENT THIS AGREEMENT made as of the day of , 19�1 and among SOUTIERN CALIFORNIA GAS COMPANY,, THE PACIFIC TELEPHONE AND TELEGRAPH COMPANY, GENERAL. TELEPHONE COMPANY OF CALIFORNIA, SOUTHERN CALIFORNIA EDISON (hereinafter referred.to as "Principal Parties") and City of Carlsbad (hereinafter referred to as "Associate Party"). WITNESSETH: WHEREAS, the Principal Parties have heretofore entered into an Agreement dated as of July 1, 1976 (hereinafter referred to as the "Principal Party Agreement"), a copy of which is attached hereto and made a part hereof, and WHEREAS, Associate Party desires to become a participating Associate Party under the Principal Party Agreement, NOW, THEREFORE, the parties agree as follows: 1. Associate Party accepts and agrees to be bound by the terms and conditions of the Principal Party Agreement. t L 2. The Principal Parties agree that Associate Party shall be accepted as a participating Associate Party under the Principal Party Agreement. 3. The monthly fees to be paid by Associate Party for participating under the Principal Party Agreement as a participating Associate Party shall be -determined in accordance with Principal Party Agreement and Exhibit 1 attached hereto. The provisions of the foregoing paragraph are not intended to, nor do they modify any additional obligation of Associate Party arising under the provisions of Article 4 of the Principal Party Agreement. 4. For the protection of the Principal Parties,, Associate Party shall secure and maintain in force during the term of this Associate Party Agreement, comprehensive liability insurance, including contractual liability insurance, with minimum limits of $500,000 each occurrence fbr injury or death of any person or persons resulting from the same occurrence, and property damage coverage in the amount of $500,000 each occurrence. Such insurance shall be in such form and with such companies as may be acceptable to the Principal Parties. A certificate or certificates evidencing such insurance shall be filed with the Contractor under the Principal Party Agreement within fifteen (15) days of the dat4 hereof. Such certificates shall provide - 2 - IP evidence that the policies of such insurance have been I endorsed so as to provide twenty (20) days notice of the cancellation or change thereof to Contractor at the Con- tractor's address. Any written notice directed to { Associate Party shall be addressed as follows: 1200 Elm Avenue Carlsbad, CA 92003 5. An Associate Party member who does not operate underground facilities within the intent of this Agreement and/or does not desire to receive messages from the call center is exempt from the requirements of para- graphs 1, 2, 3 and 4 above. In consideration of waiver of the foregoing requirements and in recognition of the services provided by the call center to excavators, under- ground operators and to the general public to reduce damages and prevent.interruption of necessary services the Associate Party member agrees to pay either $ 25.UU per month or the minimum monthly membership fee, whichever is the greater, in accordance with the terms of this Agreement, 6. This Agreement shall become effective on the day and year above first written and shall continue in effect for a period of one (1) year and from month to month thereafter; provided, however, that this Agreement may be terminated at any time after one (1) year by the 3 - 7 r 5 Associate Party member upon thirty (30) days prior written notice to each Principal Party or at any time after one (1) year by all Principal Parties upon thirty (30) days' prior written notice to the Associate Party. Any Principal Party may terminate its participation in this Agreement at any time after one (1) year upon ninety (90) days' prior written notice to the other Principal Parties and the Associate Party • without affecting the remainder of this Agreement. 7. Notices provided for in this agreement to be given by participating Associate Parties to Contractor and the Principal Parties may be given by delivering teach notice to the one call center addressed to Contractor and Principal Parties by their individual names.
