The amendment w( revise Condition 11 of the Specific Plan which requires the processing of a brand new specific plan for the entire proper1 if any subdivision occurs within its boundaries. The revised condition would simply make the specific plan applicable to ai newly created parcels. For further information please see thc attached staff report to the Planning Commission. It is recommended that the Planning Commission ACOPT Resolutioi No. 2120, recommending approval of SP-l82(A), based on the . findings and subject to the conditions contained therein. 11. PROJECT REQUEST AND BACKGROUND In May 1982, the City Council approved a zone change and specific plan tc im9lement the 0 (Professional and Related Commercial) and RM (Residential Medium Density, 4-10 du/ac) Combination District on the property. The specific plan was designed to prcvFde standards for development of the Elm Grade Off ice pro j ect . The applcant is requesting that a previously approved conditio of the specific plan now be deleted. This condition pertains resubdivision of the project site. The project site, approximately 7.9 acres in size, is relativ flat along El Camino Real but slopes upward sharply to the eas and south. "he area to the east of the property is in open sp and residential use. The property immediately to the north is vacant but has been approved for office development. 111. ANALYSIS * Planning Issue 1) Will the proposed amended condition ensure compliance with the intent and guidelines of the approved specil plan? Discussion The applicant is requesting the amendment of a condition requiring the filing of a new specific plan with any 0 e subdivision of the property. The condition, as existing, reads as follows: Specific Plan 182 is approved for one parcel. Any further subdivision of this property will require the filing of appropriate applications pursuant to Title 2 (subdivision) of the Municipal Code and the filing of new specific plan. The revised condition, as proposed by the applicant, would read as 'follows: Specific Plan 182 is approved for application to all lots within the boundaries of the plan. Any adjustmer of the boundaries of said lots and any subdivision of the existing lot or lots shall be perforned subject tc the terms and conditions of this Specific Plan, which terms and conditions shall run with each such lot and shall be binding upon the owners thereof and upon the heirs, successors and assigns of such owners. The proposed amendment would not otherwise alter the terms or guidelines of the Specific Plan. The existing condition was intended to ensure compliance of any subdivided lots with the guidelines and development standards of the specific plan. The applicant believes that the condition, as existing, creates an awkwsrd and unnecessary process for subdivision. The applicant believes that the revised condition would assure comEliance with the specific plan without requiring the more lengthy processing of filing another such plan. Staff concurs with the applicant that the revised condition wi satisfy the intent of the existing condition while ensuring compliance wiht the guid.elines of the approved specific plan. Reciprocal access and parking agreements would be required at the time of subdivision to ensure the integral working of the site. IV.
