RECOMMENDED ACTION:
Both the Planning Commission and staff recommend that this
application be APPROVED and that the City Council direct the City
Attorney's Office to prepare document APPROVING GPA-67(A), and
ZC-270.
ITEM EXPLANATION
This item consists of two requests:
1) A General Plan Amendment from RLM (Residential Low-
Medium, 0-4 du/ac) to P-I (Planned Industrial); and
2) A preannexational zone change from E-1-A (County) to
P-M (Planned Industrial) and R-1-10,000.
The property is 44.6 acres in size and divided topographically
by a steep slope. The upper portion of the site is proposed as
industrial and the lower portion as single family residential.
The Planning Commission found that both the General Plan
Amendment and Zone Change made sense from a land use point of
view. The upper portion of the site, proposed as industrial,
physically relates to the Carlsbad Research Center (Roll
Property) and would derive its access from there. The lower
portion of the site ties into residentially designated properties
to the north.
Through staff review and Planning Commission hearing, all issues
on this matter have been satisfactorily resolved.
ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project
will not cause any significant environmental impacts and,
therefore, has issued a Negative Declaration, dated March 8,
1983, which was approved by the Planning Commission on April 13,
1983. A copy of the environmental documents is on file in the
Land Use Planning Office.
FISCAL IMPACT
No direct fiscal impacts will be created by approval of the
General Plan Amendment or Zone Change. Upon development, the
applicant will be required to provide all needed public
improvements to the property and, in addition, pay a public
facilities fee to offset the costs of providing City services.

7 WHEREAS, a verified application for an amendment to the

Exhibit "A", dated March 31, 1983, attached and incorporated
herein, have been filed with the Planning Commission; and
WHEREAS, said verified applications constitute a request
for amendment as provided in Title 21 of the Carlsbad Municipal
Code; and
WHEREAS, the Planning Commission did, on the 13th day of
April, 1983, hold a duly noticed public hearing as prescribed by
law to consider said request;
WHEREAS, at said public hearing, upon hearing and
.considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors
relating to the General Plan Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad, as follows:
A) That the above recitations are true and correct.
B) That in view of the findings made and considering the
applicable law, the decision of the Planning Commission is to
recommend approval of GPA-67(A), as shown on Exhibit "B", dated
March 31, 1983.
Findings:
1) The property is physically suitable for industrial development
because the site is relatively level and is surrounded on two
sides by property designated for industrial development.

2) The uses allowed in the proposed planned industrial use desig-
nation will be compatible with the surrounding future land
uses.
3) This project will not cause any significant environmental

Planning Commission of the City of Carlsbad, California, held on

WHEREAS, said application constitutes a request as

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the
Commission recommends approval of ZC-270, based on the
following findings and subject to the following conditions:

Findings :
1 ) The proposed zone change to P-M is consistent with the General
Plan designation of P-I since this designation is applied to
areas that are suitable for industrial development. The
proposed zone change to R-1-10,000 is consistent with a General
Plan designation of RLM since a designation like this is
applied to an area that is suitable for single-family residen-
tial development.5
2) The P-M zone is compatible with surrounding properties because
" the properties to the south and west of subject property have
been designated for industrial development, and R-1-10,000
' zones are compatible with surrounding properties because the
surrounding properties to the north have been designated for
residential development at similar densities.
3) The applicant has agreed and is required by the inclusion of an
appropriate condition to pay a public facilities fee. Perfor-
mance of that contract and payment of the fee will enable this
body to find that public facilities will be available concur-
•'••'• rent with need as required by the General Plan.

applicant shall pay a public facilities fee as required by City
Council Policy No. 17, dated April 2, 1982, on file with the
City Clerk and incorporated herein by reference, and according
to the agreement executed by the applicant for payment of said
fee a copy of that agreement dated May 27, 1982, is on file
__ with the City Clerk and incorporated herein by reference. If
said fee is not paid as promised, this application will not be
consistent with the General Plan and approval for this project
shall be void.

SUBJECT: GPA-67(A)/ZC-270 - IVAR - A request to amend the
General Plan land use designation from RLM (residential
low-medium, 0-4 du/ac) to P-I (planned industrial), and
a preannexational zone change from E-1-A (county) to
R-1-10,000 (one-family residential, 10,000 square-foot
minimmum lot size), and P-M (planned industrial).
I. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Negative Declaration issued by the Land Use Planning Manager and
ADOPT Resolutions Nos. 2110 and 2109, recommending APPROVAL of
GPA-67(A) and ZC-270.
II.PROJECT DESCRIPTION
The applicant is requesting that the Land Use Element of the
General Plan be changed from RLM (0-4 du/ac) to P-I (planned
industrial) and that the zoning be changed from County E-1-A to
P-M and R-1-10,000 on property located southwest of El Camino
Real approximately 7,500 feet north from the intersection of El
Camino Real and Palomar Airport Road. The property is bounded on
the southern and western sides by the Koll Research Center.
Topographically, the site is dominated by a steep slope which
runs east to west and divides the property in half. The upper
section is relatively level and the lower section slopes slightly
toward El Camino Real. The applicant is requesting a zone change
of R-1-10,000 for the lower section so as to keep it consistent
with future residential development in the area. The applicant
is, also, requesting a zone change to P-M for the upper section
to be consistent with the adjacent industrial designated parcels
of the Koll property.
III. ANALYSIS
Planning Issues - General Plan Amendment

Is the proposed General Plan designation of planned
industrial appropriate for this site?
Is the proposed designation compatible with existing and
future land uses in the area?
Discussion
The applicant has requested the P-M designation for the upper
portion of the site since it is on the same elevation as the
adjoining Roll Research property and is best suited for
industrial uses. Staff concurs with this proposal since this
area is bounded on two sides by industrial uses and the proposed
P-I designation would be consistent with existing and future uses
in the area. Staff also believes that access would be better
served from the Koll property than from El Camino Real. With the
addition of this land to industrial use, a natural boundary would
be created by having the slope divide residential and industrial
uses. This would be in line with the General Plan guidelines
which allows that either property lines, streets or topography
should be used to designate land use boundaries. Overall, staff
feels it can make the required findings for a General Plan
Amendment, and therefore, recommends approval of GPA-67(A).
Planning Issues - ZC-270
1. Are the proposed zones (R-1-10,000 and P-M) both consistent
with the General Plan designations of RLM and P-I.
2. Are the uses allowed in the R-1-10,000 and P-M zones
consistent with the surrounding zoning and land uses?
Discussion
The requested zone changes would be consistent with the General
Plan designations for these properties as proposed. Planned
industrial, P-M, is the implementing zone for the P-I designa-
tion. Also, R-1-10,000 is an implementing zone for an area with
a General Plan Amendment of RLM.
Staff feels the proposed zone changes and the uses allowed within
these zones will be consistent with the surrounding zoning and
land uses. The properties to the south and west of the property
proposed for a zoning of P-M have been designated for industrial
development. The property that is being rezoned to R-1-10,000 is
adjacent to other property that is designated for a similar
density of developement. Overall, staff can make the required
findings and is, therefore, recommending approval of ZC-270.
IV. ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project
will not have a significant impact on the environment and,
therefore, issued a Negative Declaration on March 8, 1983.
