Both the Planning Commission and staff recommend that this
application be APPROVED and that the City Council direct the City
Attorney's Office to prepare documents APPROVING GPA-67(B) and
ZC-271, as recommended by the Planning Commission.
ITEM EXPLANATION
This item consists of two applications:
1) An amendment to the Land Use Element of the General
Plan from Residential Low-Medium (RLM) (0-4 du's/acre)
to Residential Medium (RM) (4-10 du's/acre); and
2) A zone change from R-1 to RDM(Q).
The property is 1.52 acres in size and located on the northwest
corner of Chinquapin Avenue and 1-5.
The applicant's original request was for the RMH general plan
designation (10-20 du's/acre) and the R-3 zone. Staff
recommended denial to the Planning Commission because of the
incompatibility of these land uses with surrounding single
family development. The Planning Commission believed that the
R-M designation (4-10 du's/acre) was more appropriate for the
site and that the RDM(Q) zone was the best implementing zone for
the property. Staff concurs with the Planning Commission and is
recommending approval of the Commission's modifications.
The applicant disagrees with the Planning Commission's
recommendation on the general plan amendment and is still
requesting approval by the City Council of the RMH designation
(10-20 du's/acre). The applicant is satisfied, however, with the
Planning Commission's recommendation of the RDM(Q) zone since
this would permit the same development as would be allowed in the
R-3 zone. The attached staff report addresses the land use
issues associated with this site.
ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project
will not cause any significant environmental impacts and,
therefore, has issued a Negative Declaration, dated March 28,
1983, which was approved by the Planning Commission on April 13,
1983. A copy of the environmental documents is on file in the
Land Use Planning Office.

FISCAL IMPACT
No direct fiscal impacts will be created by approval of the
General Plan Amendment or Zone Change. Upon development, the
applicant will be required to provide all needed public
improvements to the property and, in addition, pay a public
facilities fee to offset the costs of providing City services.

SUBJECT: GPA-67(B)/ZC-271 - PARTNER'S EQUITY - Request for
approval to amend the Land Use Element of the General
Plan to redesignate property from residential low-
medium (RLM) to residential medium-high (RMH) and a
zone change from R-1-7500 to R-3 on property generally
located on the northwest corner of Chinquapin Avenue
and Interstate 5.
I. RECOMMENDATION
It is recommended that the Planning Commission adopt Resolutions
Nos. 2103 and 2104 recommending DENIAL of GPA-67(B) and ZC-271,
based on the findings contained therein.
II. PROJECT DESCRIPTION
The applicant is requesting approval of an amendment to the Land
Use Element of the General Plan to redesignate 1.52 acres from
RLM (residential low-medium density, 0-4 du/ac), to RMH (residen-
tial medium-high density, 10-20 du/ac), and a zone change from
R-1-7500 to R-3, located as described above. The subject
property is relatively flat and is currently occupied by an older
single-family house and detached garage.
Properties to the north and west, immediately adjoining the
project site, are designated RLM by the General Plan, zoned R-1-
7500 and developed as single-family homes. Property to the
south, across Chinquapin Avenue, is classified as RMH, zoned P-C
(planned community) and developed as the Papagayo (Windsong
Shores) condominiums. The subject property is bordered by
Interstate 5 to the east.
III. ANALYSIS
Planning Issues
1) Is the proposed General Plan Amendment consistent with the
objectives of the Land Use Element of the General Plan?
2) Would the proposed General Plan Amendment and requested
zoning adversely impact surrounding properties?
3) Is the proposed General Plan Amendment to residential
medium-high density an appropriate use for the site?
Discussion
The goals and objectives of the Land Use Element of the General
Plan indicate the preservation of the neighborhood atmosphere and
identity of existing residential areas. The General Plan further
states that distinctions between land use classifications should
be drawn along logical boundaries such as topographical features
or streets. Using this criteria, the proposed amendment would
not be consistent with the objectives of the General Plan.
The current boundary, Chinquapin Avenue, makes a logical
distinction between residential low-medium (RLM) land uses to the
north, and residential medium-high uses to the south. Utilizing
distinct boundaries, such as streets, minimizes conflicts and
disruptions of land uses. Staff believes that the proposed
amendment would adversely impact the integrity of the existing
single-family neighborhood adjoining the project site.
Also, staff does not believe that the proposed residential
medium-high density, RMH, designation is an appropriate use for
this site. As previously noted, the proposed density, 10-20
du/ac, would not be compatible with the existing single-family
neighborhood. Further, the site is impacted by noise from
Interstate 5. The noise contour map of the Noise Element of the
General Plan indicates that the entire site is impacted by noise
of 65 dBA or greater. The Department of Housing and Urban
Development, H.U.D., lists areas of 65 CNEL or greater as being
normally unacceptable for residential use. Staff, therefore/
believes that any increase in residential density would be
inappropriate.
With respect to the zone change, the RDM zone is not consistent
with the RLM designation existing on the site. If the Planning
Commission concurs with staff's recommendation of denial of the
General Plan Amendment, then staff would further recommend denial
of the zone change.
Overall, staff believes that the requested amendment to the
General Plan and corresponding zone change are not consistent
with the objectives of the Land Use Element of the General Plan,
could adversely impact surrounding properties, and are not
appropriate uses of the project site.
IV. ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that the project
will not have a significant impact on the environment, and
therefore, has issued a Negative Declaration on March 28, 1983.
