RECOMMENDED ACTION:
Both the Planning Commission and staff recommend that this
application be APPROVED and that the City Council direct the City
Attorney's Office to prepare documents APPROVING GPA-67(E).
ITEM EXPLANATION
The project is a requested amendment to the Land Use Element of
the General Plan which would change the designation of property
located on Avenida Encinas, near the northwest corner of 1-5 and
Palomar Airport Road, from Extensive Regional Retail (RRE) to
Travel Service (TS) Commercial. The site is being considered for
a Marie Callender's restaurant. A traffic study was prepared for
the subject property which showed limited impact from a
restaurant use if certain improvements are made to the street
system in the vicinity of the project. The extent of these
improvements would be determined when a site development plan is
submitted for the property. All other corners at the
intersection of 1-5 and Palomar Airport Road are already
designated TS.
The Planning Commission recommended approval of this project at
their April 13 hearing. For further information please see the
attached staff report to the Planning Commission.
ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project
will not cause any significant environmental impacts and,
therefore, has issued a Negative Declaration, dated April 1,
1983, which was approved by the Planning Commission on April 13,
1983. A copy of the environmental documents is on file in the
Land Use Planning Office.

Approval of this general plan amendment will not create any
direct fiscal impacts to the City. Upon development, the
applicant will be required to provide all needed public
improvements to the property and, in addition, pay a public
facilities fee to offset the costs of providing City services

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF AN AMENDMENT TO THE LAND USE ELEMENT
OF THE GENERAL PLAN FROM EXTENSIVE REGIONAL
RETAIL (RRE) TO TRAVEL SERVICE (TS) ON PROPERTY
GENERALLY LOCATED AT THE NORTHWEST CORNER OF
INTERSTATE 5 AND PALOMAR AIRPORT ROAD.

WHEREAS, a verified application for an amendment to the
General Plan designation for certain property located, as shown on
Exhibit "A", dated March 25, 1983, attached and incorporated
herein, have been filed with the Planning Commission; and
WHEREAS, said verified applications constitute a request
for amendment as provided in Title 21 of the Carlsbad Municipal
Code; and
WHEREAS, the Planning Commission did, on the 13th day of
April, 1983, hold a duly noticed public hearing as prescribed by
law to consider said request;
WHEREAS, at said public hearing, upon hearing and
considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors
relating to the General Plan Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad, as follows:
A) That the above recitations are true and correct.
B) That in view of the findings made and considering the applic-
able law, the decision of the Planning Commission is to
recommend approval of GPA-67(E), as shown on Exhibit "A", dated
March 25, 1983.

SUBJECT: GPA-67(E) - MARIE CALLENDERS - A request to amend the
Land Use Element of the General Plan from Extensive
Regional Retail (RRE) to Travel Service (TS).
I. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Negative Declaration issued by the Land Use Planning Manager and
ADOPT Resolution No. 2105 recommending APPROVAL of GPA-67(E)
based on the findings contained therein.
II. PROJECT DESCRIPTION
The applicant is requesting an amendment to the Land Use Element
of the General Plan from Extensive Regional Retail (RRE) to
Travel Service (TS) on property located at the northwest corner
of Palomar Airport Road and Interstate 5. The property involved
consists of two parcels with a combined area of 2.16 acres. The
smaller of the two parcels is occupied by Stoneys Tire Service.
The larger of the two parcels has an area of 1.38 acres and is
vacant. The smaller property is zoned C-2 and the larger parcel
is zoned R-A-10,000. This General Plan Amendment is being
requested so that a Marie Callenders Restaurant can be located on
the vacant parcel.
III. ANALYSIS
Planning Issues
1. Is the proposed land use amendment to Travel Service an
appropriate use for the site?
2. Would the proposed General Plan Amendment adversely impact
the surrounding properties?
Discussion
Staff feels the proposed General Plan Amendment from Extensive
Regional Retail to Travel Service is an appropriate use for this
site. One of the General Plan policies for Travel Service areas
is to locate these areas so that they are highly visible and
readily accessible from major transportation corridors.

The subject property is highly visible and easily accessible from
both Interstate 5 and Palomar Airport Road. The intersection of
Interstate 5 and Palomar Airport Road is developing into a major
Travel Service area. All of the other three corners of this
intersection have been designated for Travel Service by the
General Plan.
The Land Use Element of the General Plan requires that Travel
Service areas have a minimum area of five acres to provide for a
full range of travel services. The subject properties have a
combined area of 2.16 acres. Staff feels that although the
subject property is not five acres in size, it should still be
designated TS. When the subject property's acreage is added to
the other properties designated TS at the intersection of Palomar
Airport Road and Interstate 5 there will be approximately 25
acres of Travel Services at this intersection. These 25 acres
will provide a full range of travel services to the passing
motorists.
Approval of this General Plan Amendment should not have an
adverse impact on the surrounding properties. The property to
the north is designated for Extensive Regional Retail
development and the property to the west is designated for
planned industrial development. None of the uses permitted by
these designations should be adversely impacted by a restaurant
on the subject property.
Staff had some concerns about the possibility of traffic
congestion in this area if a high volume, sit-down restaurant was
located on the subject property. The applicant had a traffic
study prepared by Robert Sargent of Wildan Associates addressing
this issue. This study concluded that the proposed General Plan
Amendment should not create any traffic problems when all of the
adjacent streets were developed to their full potential as
designated by the Circulation Element of the General Plan.
However, if a large, high volume restaurant was constructed on
the subject property prior to complete buildout of the adjacent
roads, certain improvements may be required, such as
dedicating/widening Palomar Airport Road and signalizing the
intersections of Palomar Airport Road and Avenida Encinas and the
freeway ramps. The exact level of the improvements needed to
maintain an acceptable level of service will have to be made at
the time a site development plan is submitted.
Prior to the construction of a restaurant on the subject
property, it will be necessary to rezone the property to CT-Q and
submit a site development plan for the approval of the Planning
Commission.
Overall, staff feels that the requested General Plan Amendment to
TS would be appropriate and compatible with the surrounding
properties.

IV. ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that approval of
GPA-67(E) will not have a significant impact on the environment
and, therefore, has issued a Negative Declaration on April 1,
1983.

The City of Carlsbad has conducted an environmental review of the
above described project pursuant to the Guidelines for Implementation
of the California Environmental Quality Act and the Environmental
Protection Ordinance of the City of Carlsbad. As a result of said
review, a Negative Declaration (declaration that the project will not
have a significant impact on the environment) is hereby issued for the
subject project. Justification for this action is on file in the
Land Use Planning Office.
A copy of the Negative Declaration with supportive documents is on
file in the Land Use Planning Office, City Hall, 1200 Elm Avenue,
Carlsbad, CA. 92008. Comments from the public are invited. Please
