RECOMMENDED ACTION: Adopt Resolution No .y*?s^approving plans and specifications and authorizing the City Clerk to advertise for bids for Monroe Street Assessment District. ITEM EXPLANATION This project, the result of the proceedings under Assessment District No. 83-1, as established by Resolution No. 7183, is to construct 398 linear feet of curb, gutter, and sidewalk on its east side of Monroe Street, north of Chestnut. The appropriate procedures have been taken in accordance with the Streets and Highway Code and as directed by the law firm, Brown and Nazarek, employed by the City for this purpose. The findings of the City Council, held on June 7, 19.83, were: A. That all protests were overruled and denied (there were none); B. The Superintendent of Streets (City Engineer) was directed to proceed with the construction of the improvement if such work was not commenced within 60 days after notice to the property owners, and C. The improvements are to be financed in accordance with Chapter 27 of the Streets and Highway Code. Notice was lawfully given to the owners on April 21, 1983, and it has been determined that, as of this date (60 days later), the improvements have not been constructed. Therefore, it is proposed to advertise and award a construction contract for the improvements. Bids will be asked for July 8, and an award to be made on July 19. FISCAL IMPACT The Engineer's Estimate for this project is $11,930. Funds in the amount of $14,630 are available in Account No. 80-92-44-0519-1 for this project. The expenses incurred will be reimbursed to the City through the Assessment District Proceedings. EXHIBITS 1. Location Map 8 2. Area Map 3. ASSESSMENT DISTRICT NO. 83-1 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 7255 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DIRECTING THE CONSTRUCTION OF WORKS OF IMPROVEMENT (MONROE STREET) (hereinafter referred to as the "Assessment District"); and, WHEREAS, the property owner or owners within the boun- daries of the Assessment District have not commenced the works of improvement within sixty (60) d.ays upon receiving notice to do so by the Superintendent -of Streets, and at this time the City Council desires to authorize the bidding on the works of improve- j i ment for the above-referenced Assessment District; and, WHEREAS, it is also necessary to determine the prevail- ing rate of wages for the various classifications of workmen required in the performance of said work. NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1. That the above recitals are all true and correct. SECTION 2. That it is hereby dcetermined that the gene- >* ral prevailing rate of per diem wages in the locality in which said work described is to be performed within the Assessment 6 7J3!9! 10 | 111 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 District for each craft and/or type of workman or mechanic needed, is in accordance with a schedule as obtained from the Director of Industrial Relations, pursuant to the provisions of Section 1173 of the Labor Code of the State of California, a copy of which is on file in the Office of the City Clerk and open for public inspection. SECTION 3. That the proposals or bids shall be opened and examined at a public so called, and said^ results of the bidd- ing shall be reported to the City Council at the next regular neeting following the opening of said bids. SECTION 4. That the terms and conditions for bidding on the works of improvement for this Assessment District are as set forth in the Bidding Documents as herein approved, and reference is made to the Bidding Documents as approved and identified as follows: NOTICE INVITING SEALED PROPOSALS ASSESSMENT DISTRICT NO. 83-1 (MONROE STREET) -or all particulars as to bidding, the Notice Inviting Sealed 3roposals and all referenced and approved documents, including the Specifications, shall govern for the works of improvement. SECTION 5. That this City Council hereby finds and determines that in the event the Contractor does not complete the within the time limit as specified in the bidding documents jr within the time limit as further authorized, the Contractor shall pay liquidated damages in the amount as set forth in the jidding documents for this project, a copy of which shall be kept file in the Office of the City Clerk. It is impractical at 8 9 10 11 12 13 this time to determine the actual damage which will be sustained by reason of any such delay, but that sums set forth therein .is a reasonable amount for said liquidated damages and said amount is not being imposed as a penalty. SECTION 6.
