ITEM EXPLANATION
The City Council at your meeting of June 1, 1983 directed the City
Attorney to prepare a series of documents approving GPA-67(A),
GPA-67(B), GPA-67(D) and GPA-67(E) and zone changes ZC-270, ZC-271
and ZC-275. The documents have been prepared as directed. The
general plan changes have been incorporated in two documents:
GPA-67(A) (Ivar) and GPA-67(E) (Marie Callenders) are in Resolution
No. Tj?j5"W? ; GPA-67(B) (Partner's Equity) and GPA-67(D)
(Woolley) are in Resolution No. /7.?v5"v3 Two resolutions have
been used to reflect the Council's differing views on the matter
and they may be voted on separately. However, taken together they
will constitute one amendment to the general plan.

RESOLUTION NO.7252
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING THE LAND'USE ELEMENT
OF THE GENERAL PLAN TO CHANGE THE LAND USE DESIGNA-
TIONS FOR TWO AREAS OF THE CITY'S GENERAL PLAN
GPA-67(A) (IVAR) AND GPA-67(E) (MARIE CALLENDERS).
WHEREAS, the Planning Commission did'on April 13 and
November 3, 1983 hold duly noticed public hearings as prescribed
by law to consider amendments to the Land Use Element of the
General Plan GPA-67(A) and GPA-67(E); and
WHEREAS, the Planning Commission has determined that
GPA-67(A) and GPA-67CE) would not have significant impacts on the
environment and Negative Declarations-were approved on April 13,
1983 in satisfaction of the requirements of the City of Carlsbad
Environmental Protection Ordinance of 1980 and the California
Environmental Quality Act; and
WHEREAS, the City Council did on June 7, 1983 hold duly
advertised public hearings to consider said amendments and at
that time received the recommendations, objections, protests and
comments of all interested persons desiring to be heard; and
WHEREAS, the City Council, after considering all
proposed changes to the Land Use Element of the General Plan,
directed the City Attorney to return with appropriate documents
to allow the City Council to vote on the change individually as a
part of one single amendment to the Land Use Element of the
General Plan.

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California as follows:
A. That the above recitations are true and correct.
B. That this resolution and resolution no. 7253
constitute a single amendment to the Land Use Element of the
General Plan.
C. That the findings of the Planning Commission as set
forth in Planning Commission Resolution No. 2110 (GPA-67(A)) and
Resolution No. 2105 (GPA-67(E)) constitute the findings of the
City Council.
D. That the Land Use Element of the General Plan is
amended as follows:

1. GPA-67(A) (Ivar); To change the Land Use
Element from residential low medium (RLM) density to planned
industrial (PM) for approximately 45 acres of property generally
located on the west side of El Camino Real north of the Roll
Research Center as shown on the map marked Exhibit A - GPA-67(A)
attached hereto and made a part hereof.
2. GPA-67(E) (Marie Callenders). Change the Land
Use Element from extensive regional retail (RRE) to travel
service (TS) on approximately 2.16 acrea of property located on
the northwest corner of Interstate 5 and Palomar Airport Road as
shown on the map marked Exhibit B - GPA-67(E) attached hereto and
made a part hereof.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING THE LAND USE ELEMENT
OF THE GENERAL PLAN TO CHANGE THE LAND USE DESIGNA-
TIONS FOR TWO AREAS OF THE CITY'S GENERAL PLAN.
GPA-67(B) (PARTNER'S EQUITY) AND GPA-67(D) (WOOLLEY)
WHEREAS, the Planning Commission did on April 13, 1983
hold duly noticed public hearings as prescribed by law to
consider amendments to the Land Use Element of the General Plan
GPA-67(B) and GPA-67(D); and
WHEREAS, the Planning Director and the Planning
Commission have determined that GPA-67(B) will not have
significant impacts on the environment and a Negative
Declaration has been prepared, filed and approved on April 13,
1983; EIR 82-3 was certified by the City Council on June 6, 1983
for GPA-67(D) in accordance with Planning Commission Resolution
No. 2106 all in satisfaction of the requirements of the City of
Carlsbad Environmental Protection Ordinance of 1980 and the
California Environmental Quality Act; and
WHEREAS, the City Council did on June 7, 1983 hold a
duly advertised public hearing to consider said amendments and
at said time received the recommendations, objections, protests
and comments of all interested persons desiring to be heard; and
WHEREAS, the City Council, after considering all
proposed changes to the Land Use Element of the General Plan,

residential medium high (RMH) on approximately 1.52 acres of
property generally located on the northwest corner of Chinquapin
Avenue and Interstate 5 as shown on the map marked Exhibit
attached hereto and made a part hereof.
2- GPA-67(D) (Woolley); Change the Land Use
Element to include certain property, in the Carlsbad sphere of
influence, to wit: property generally located south of Olivenhain
Road, east and west of Rancho Santa Fe Road, with land use
designations of Open Space (OS), Residential Low Medium (RLM) and
Residential Low (RL) as shown on the map marked Exhibit
attached hereto and made a part hereof.

LOCATED ON THE SOUTH SIDE OF EL CAMINO REAL APPROX-
MATELY 7,500 FEET NORTH OF THE INTERSECTION OF
PALOMAR AIRPORT ROAD AND EL CAMINO REAL.

The City Council of the City of Carlsbad, California does
ordain as follows:
SECTION 1: Title 21 of the Carlsbad Municipal Code is
amended by the amendment of the zoning map to" grant a
preannexatioal,zone change (ZC-270) from county of San Diego E-1-A
to R-1-10,000 and from county of San Diego E-1-A to P-M on
approximately 44.6 acres of property as shown on the map marked
ZC-270 - Exhibit A, attached hereto and made a part hereof.
SECTION 2: This project is approved upon the express
condition that the applicant shall pay a public facilities fee as
required by City Council Policy No. 17, dated August 29, 1979 and
amended on April 2, 1982, on file with the City Clerk and
incorporated herein by reference, and according to the agreement
executed by the applicant for payment of said fee a copy of that
agreement dated May 27, 1982, is on file with the City Clerk and
incorporated herein by reference. If said fee is not paid as
promised, this application will not be consistent with the General
Plan and approval for this project ..shall be void. Said fees shall
be paid based on the April 2, 1982 version of Policy No. 17.

10,000, R-1-25,000, R-1-40,000 and 0-S on approximately 475 acres
of property as shown on the map marked ZC-275 - Exhibit B,
attached hereto and made a part hereof. The boundaries of the 0-S
zone are more specifically delineated on the map marked ZC-275 -
Exhibit A which is on file in the Land Use Planning Office.
SECTION 2: This project is approved upon the express
condition that the applicant shall pay a public facilities fee as
required by City Council Policy No. 17, dated August 29, 1979 and
amended on April 2, 1982, on file with the City Clerk and
incorporated herein by reference, and according to the agreement
executed by the applicant for payment of said fee a copy of that
agreement dated December 16, 1981 and January 12, 1982r is on file
with the City Clerk and incorporated herein by reference. If
