ITE:.i EXPLANATION: Councilman Prescott has been attending meetings of city officials discussing the bullet train. At a meeting in Del Mar on June 10, 1983, the representatives present urged all City Councils to endorse the "Del Mar Accord." The Accord opposes the issuance of any permits, bonds, or approvals of the Bullet Train project until all transportation, environmental, and economic concerns have been addressed in public meetings. Transportation_ NEeds' Assessment: The conduct of an independent integrated passenger trans- port needs assessment which addresses in detail corridor boundaries, routes, requirements, economies and recommends appropriate state of the art technologies that meet those needs. 2. Environmental Safeguards: The identification and mitigation of all environmental problems throughout the entire length of the corridor according to pre AB 3647 conditions within the California Environmental Quality Act and the California Coastal Act. 3. Economic Assurances: The developed shall acquire competitive bonding for the total project, plus the resources necessary to quarantee five years of uninterrupted service in the form of liability insurance and operational reserves. Transportation Needs Assessment An independent Transportation Needs Assessment shall be conducted which specificaly addresses: a. 'Corridor boundaries b. Corridor transporation requirements c. Routes that meet the corridor needs, interconnect with existing and proposed transportation modes, remove the maximum number of vehicles from streets and highways, and are sensitive to environ- mental and historical concerns d. Fare that can be paid by persons who could use the system e. Economics.necessary for a system to become self-sufficient within five years after commencing operation f.. Systems, existing and in testing, that meet the design criteria, are of the state of the art technology and are environmentally sensitive g. Expense versus income for commuters with station site h. Financing systems available 2. Environmental Safeguards The reinstatement of the conditions within the California Environmental Quality Act and the California Coastal Act to pre- AB 3647 status and written guarantees that an environmental impact report would be pre- pared on every mile of the entire corridor and that identified problems would be satisfactorily mitigated. 3. Liability insurance, equal.to the construction cost, to be purchased and prepaid to cover first five years of operation - Signed IVA 0 V_ co w 0 0 N a L cc E m L E �v 0 E 0 0 0 ��ISs83 City of del June 13, 1983 SUBJECT: Results of Bullet Train Accord Meeting mar A very informative and productive meeting was held June 10, 1983 to discuss the need for elected representatives to demand that the processing of bullet train permit applications and other authorizations be stopped until the American High Speed Rail Corporation addresses and resolves the issues of transportation needs assessment, environmental safeguards, and economic assurances. In attendance at this meeting were representatives of eight State and Federal legislators, nine cities, the City of San Diego, the San Diego Association of Governments, and sixteen community groups. In total, 75 persons participated in the meeting. There was considerable support for rapid rail commuter service that would be developed through coordination with local plans and mean- ingful community involvement. There were concerns expressed that the proposal presented by American High Speed Rail Corporation contained gross errors and was proceeding without the requested meaningful community involvement. As a result of the June 10, 1983 meeting, a draft accord was presented and modifications were suggested. The attached draft reflects the thinking that came out of this meeting. Each organization represent- ative was requested to present the draft accord to their governing body for consideration. Early action is required because applications for permits will be submitted to various governmental agencies in July, 1983. It was also suggested that each organization write to John J. Kozak, Director of the California Department of Transportation, to ask that any applications submitted be rejected until a needs assessment is conducted, environmental safeguards are identified, and economic assurances are resolved. The results of any action taken should be reported to Mr. Bob Bonde, (619) 753-7477, on or before June 24, 1983, and a written copy of any official acts trans- mitted to him at 1620 Haydn Drive, Cardiff, CA 92007. It is hoped that you will adopt a position similar to that outlined in the Bullet Train Accord. Together, we will be able to assure development of an economical high speed rail commuter service between San Diego and Los Angeles that will be compatible with the communities involved and will meet the needs of the area. It appears that the Public Utilities Co=izrion will not be able to participate in the California Environmental Vuality Acts' review process due to specific language in AR 3647. However, we expect to perform an environ- mental review pursuant to Public utilities Code Section 1002. Due to the potential til+ing of the AHSRC's application to the Corninsion in relation to the tizing of the EIS/EIR procE:es, it seems possible for the EIS/EIR to identify a project that is different in certain respects from that which might be approved by the Public Utilities Cor-aieaion. In that evert, we presently believe the P.FSRC would have to request that the Public Utilities Cc-,.nission modify. the certificate to be• cc:opatible with the project emerging from the EIS/FIR process, That modification, of course, would be maae at the discretion of the Ccmmission. Additionally, it is our staffs opinion that no land condemnation or construction as a utility could co=aence until the certificate and the EIS/EIR are cornatlble. ROURKE, CITY ATTORNEY hater—Com SUBJECT: BULLET TRAIN: ENVIRONMENTAL IMPACT REPORTS AND ENVIRONMENTAL REVIEW We have received the letter of Victor Weisser, Director of the Transportation Division of the Public Utilities Commission dated March 24, 1983, in which he states that "the Commission's action will be predicated on a thorough staff an of all aspects of the project proposal, including safety, financial, operational and environmental issues", etc. The thing that has to be kept in mind about the various state- ments that keep getting made about "environmental review" is that no matter what name may be given to the "environmental review" that it is still our opinion that the present state of the law as it applies to the Bullet Train, since the adop- tion of SB 3647, is that the entire Bullet*Train project is not subject to CEQA. There may be some aspects of the project that could be subjected to CEQA, but the intent and, we believe, the effec•c of SB 3647 is to exempt the entire project from one comprehensive EIR. While it is correct that the jurisdic- tion of the public Utilities Commission in granting a certificate of public convenience and necessity extends to consideration of "influence on environment" (PUC Code § 1002(4)?, this statutory mandate does not carry with it the broad and detailed require- ments of CEQA. In other words, CEQA is now a very detailed and comprehensive statue upon which there has been a great deal of case law, so that the requirements for an environmental impact report prepared under CEQA is a known quantity and the remedies for the failure to prepare an adequate EIR are clearly spelled out by statute and case law. On the other hand, the statutory direction to the PUC that it consider the "influence on environment" is a very simple and general direction. I think,it would be a much more difficult task to have any legal remedies for redress if the PUC would fail to require a really comprehensive and adequate environmental review. Likewise, the various other statements put out for public con- sumption by representatives of American High -Speed Railroad about "doing an EIR" and other such statements, are essentially meaningless, because at best the public would have to simply take whatever form of report on environmental impact that American High --Speed Railroad might see fit to put forth. If it was inadequate, incomplete, the public would have absolutely no remedy for redress. Finally, if there are any limited portions of the Bullet Train project which for one reason or another would turn out not to be exempt from CEQA, those EIR's may be so limited in scope as to be very questionable as to their value. I thought this memo would be desirable to clarify some of these issues which I think could be very confusing to anyone not familiar with the environmental review processes provided by the California Environmental Quality Acts JGR:se:R:4/l/83 BULLET TRAIN ECONOMICS Z Is the San Diego to Los Angeles Bullet Train proposal economically viable? The answer is becoming increasingly clear that it is not. We have not yet heard Mr. Richmond state that the cornerstone of the project, the Arthur D. Little marketing study, is flawed and that the ridership and resultant fare income projected by American High Speed Rail Corp. will riot materialize on schedule. A careful study of the construction budget estimate indicates that it, too, is unrealistic. American High Speed Rail Corporation is estimating only $14.5 million per mile for the construction of this porject, yet the head of the Bullet Train construction planning section in Japan is on record saying future bullet train projects should be estimated at $33.3 million per mile. The last two bullet train lines build in Japan averaged over $39 million per mile. A comparison between the estimated cost of the simple and inexpensive Long Beach to Los Angeles light rail trolley and the very expensive, heavy rail bullet train project immediately indicate that something is wront with American High Speed Rail Corporation's estimation: Bullet Train ,(per mile) Grade: $ 8 million Viaduct: $21 million Underground: $23 million Trolley (per mile) $ 20 - 30 million $ 30 - 50 million $ 50 -100 million Another item that demands immediate attention in the fact that American High Speed Rail Corporation is planning to fast track this project using the suspect construction budget estimate as the basedocument. Fast tracking is a -technique used to expedite construction projects. Instead of preparing full working draw- ings, specifications and a definite estimate on a complete project before beginning construction, the developer prepares plans, gets permits and constructs as he goes. On a project over 131 miles in length with a multitude of serious construction problems, fast tracking is unrealistic and deceiving, as no one including the investors, will have any idea how much the project will cost until it i.s com- pleted. Another friendly thought is that American High Speed Rail Corporation is also planning to begin construction in five or six places at one time; consequently, it is probable that the original capitalization will be spent, the project will be out of funds, and none of the system will be finished and operable within the budget. Bullet Train Economics Page 2 The question is why should you, our elected officials, be concerned if the developer is not fiscally responsible? 1. Please remember there is only one economically feasible light rail corridor between San Diego and Los Angeles, and if the wrong system is built on it or if an inoperable system occupies the space, the people of California will lose a very valuable asset. 2. Agreements, contracts and obligations between the developer and communities along the corridor will be worthless if construction dollars run short. American High Speed Rail Corporation's priority naturally will be to make the system operational with the funds available. Such things as tunnels, depressed rail sections, land- scaping, parking, stations, and noise attenuation will be lower on the priority. And don't count on legal action to force agreement compliance because American High Speed Rail Corporation is a paper corporation with'at last count, only $5,000 in assets. 3. If this project is -allowed to proceed and it fails, there is little doubt that State and/or the Federal government will pick up the pieces, complete the installation and operate it at tremendous losses. Why would our government do so? Because no politician could afford to have a graffiti -laden, safety hazard standing unused as a monument to a political decision that backfired. Critically needed tax dollars would be used to support the project and we know who would pay. Isn't it time that the communities stand together and demand fiscal responsibility of the developer and notify those proponents of the Bullet Train in Sacramento that they are going to be held accountable if the project is allowed to proceed where it is apparent the project is not hte solution to our transportation prob- lems, and is a threat to our economic well being. I join in support of the concept of a Del Mar Accord and urge you to do likewise. (2)
