RECOMMENDED ACTION:
If the City Council wishes to deny the appeal and approve
CT 83-5/CP-228, CRC/La Costa, your action is to adopt
Resolution No. '62 '7 7
ITEM EXPLANATION
The City Council, at your meeting of June 21, 1983 directed the
City Attorney to prepare documents denying the appeal and appro1
C'II 83-5/CP-229, CRC/La Costa.
The findings of the Planning Commission contained in Resolution 2122 shall be the findings of the City Council in this matter, i approval is subject to the conditions of PC Resolution No. 2122

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA DENYING THE APPEAL OF THE
PLANNING COMMISSION APPROVAL OF A 20 UNIT TENTA-
TIVE TRACT MAP AND CONDOMINIUM PERMIT LOCATED ON
THE SOUTH SIDE OF LA COSTA AVENUE WEST OF LA
APPELLANT: D ' ALTROY
APPLICANT : CRC/LA COSTA
CASE NO. : CT 83-5/CP-228
WHEREAS, on May 25, 1983 the Planning Commission of t'
CORUNA PLACE I AND APPROVING SAID PROJECT.
City of Carlsbad adopted Resolution No. 2122 approving a
tentative map and con5ominium permit for 20 dwelling units
located on the south side of La Costa Avenue west of La Coruna
Place (CT 83-5/CP-228); and
WHEREASp that approval was appealed in a timely manne
to the Carlsbad City Council; and
WHEREAS, the City Council of the City of Carlsbad did
on June 21 , 1983 hold a duly noticed public hearing to conside
the appeal of the Planning Commission action and to receive a1
recommendations and hear all persons interested in or opposed
the project
NOW, THEREFORE, BE IT RESOLVED by the City Council o
the City of Carlsbad, California as follows:
A. That the above recitations are true and correct, . E. That the appeal is denied,
C. That _the findings of the Planning Commission
contained in Resolution No. 2122 shall be the findings of the
City Council in this matter.

D. That tentative tract map and condominium permit
CT 83-5 and CP-228 are approved subject to the conditions
contained in Planning Commission Resolution No. 2-122.

E. This action of denial of the appeal is final the
date this resolution 'is adopted by the City Council. The
provision of Chapter 1.16 of the Carlsbad Municipal Code, "Tj
Limits for Judicial Review" shall apply.
