RECOMMENDED ACTION: Adopt Resolution No.7d<.1L adopting the 1983-84 appropriation limit ITEM EXPLANATION: Article XIIIB of the California Constitution requires that all governmental entities operate under certain limits on appropriations of proceeds of troces. This "spending limit" is based on the appropriations as adopted by the governing body during 1978-79 and is increased annually by a factor based on inflation and population. For the City of Carlsbad, the 1978-79 base is about $10.2 million. That is the City appropriated $10.2 million from proceeds of taxes duriilg 1978-79. The City is required by law to annually set and publish the appropriation limit for each fiscal year. For 1983-84 this limit should be set as part of the budget adoption process. The exhibits to this agenda bill show the process used in computing the 1983-84 limit of $19.9 million compared to appropriations from proceeds of ta.xes.of about $11.S million. Based on these numbers, the City ,~ill have a $8.4 million margin during 1983-84. FISCAL IMPACT i The establishment of the appropriation limit has no fiscal impact in itself. It should be noted, however, that should the City ever receive more in proceeds of troces than can legally be appropriated, the excess must be rnturned to the state or to the citizens by returning sales tax, property troc or other tax revenues. CONSTITlITION AND STATE LAW. 5 WHEREAS Article XII IB of the California State Cons ti tut ion requires that . 6 governments annually establish a limit on the appropriation of proceeds of 7 truces; and 8 WHEREAS state law requires that this limit be fonnally adopted by the 9 governing body of each entity vrior to June 30th of each fiscal year; and 10 WHEREAS state law also requires that this limit be published in a news- 11 paper of general circulation to allow public response. to the limit as adopted, 12 NOW, TIIEREFORE, BE IT RESOLVED as follows.: 13 1. That the City Council of the City of Carlsbad, California, does hereby 14 establish and adopt the 1983-84 appropriation limit of nineteen million eight 15 hundred eighty thousand seven hundred thirteen dollars ($19,880, 713) as 16 computed in Exhibit A attached hereto. 17 2.
