Adopt Resolution No. 7,:Z 7 approving an agreement between the
City of Carlsbad and SANDAG for Traffic Engineering Services.
ITEM EXPLANATION:
The city, for the last several years, has provided its traffic
engineering services by means -of a consultant contract. For
the last two years and a•half, this contract has been with
SANDAG. It is proposed to continue this arrangement in lieu of
a`full time position on City staff.
The agreement with SANDAG provides for this service on the basis
of 12 hours per week (one and a half days). This schedule may
cause some delay in processing traffic engineering' matters
relating to developmental projects, but efforts will be made to
keep inconveniences to a minimum.
In the event the traffic safety grant is obtained which has been
requested and includes partial funding for a full-time traffic
engineer position, consideration can be given to terminating
the SANDAG agreement in favor of establishing a full-time traffic
engineer on the City staff.
FISCAL IMPACT:
The agreement establishes 12 hours of work per week at a rate of

Dear Mr. Kackley:
Should you wish to continue our current arrangement for traffic engineering
services, I have attached two executed copies of an agreement between your City
and the San Diego Association of Governments for Kent Whitson's services for
FY1984. The revised hourly rate of $24.60 (versus $21.85 per hour for FY1983)
reflects our renegotiated rate plus 15 percent for administration, travel, and other
miscellaneous expenses.
If this agreement is acceptable to you, please return one signed copy to us for our
records.

3 BETWEEN THE CITY OF CARLSBAD AND SAN DIEGO
ASSOCIATION OF GOVERNMENTS FOR PROVIDING
TRAFFIC ENGINEERING SERVICES.
5 The City Council of the City of Carlsbad .does hereby
6 resolve as follows: '
7 1. That certain agreement between the City of Carlsaad
8 and San Diego Association of Governments for providing traffic
9 engineering ser�,ices, a copy of which is attached hereto and
3-0 made a part hereof; is hereby approved.
11 2. The Mayor of the City of Carlsbad is hereby authorized
12 and directed to execute said agreement for and,on behalf of
13 the City of Carlsbad.

SAN DIEGO ASSOCIATION OF GOVERNMENTS
AGREEMENT FOR
CONSULTANT TRAFFIC ENGINEER SERVICES
WHEREAS, the City of Carlsbad (City) requires the services of a part-time traffic
engineer; and
WHEREAS, the San Diego Association of Governments (SANDAG) has offered to supply
such services, the parties hereunto agree as follows:
SANDAG shall supply the services of traffic enginee: acceptable to the City on the basis
of 12 hours a week at a not -to -exceed cost of $24.60 per hour: Such traf fic engineer shall be
under the direction of the City Engineer and shall prepare staff reports, supply traffic
engineering expertise and review of traffic engineering related problems, observe and report
on traffic problems and complaints, and work in close coordination with City staff to provide
specialized traffic advice.
The traffic engineer shall be in the total employ of SANDAG and the City, shall not bear
overhead or liability for his employment status. The City shall maintain a record of the
traffic engineer's work and report monthly to SANDAG on number of hours Worked. The
specific hours of work shall be set by the City Engineer in consultation with SANDAG and the
traffic engineer to allow flexibility in meeting the mutual commitments of the involved
agencies.
The City agrees to indemnify and hold harmless SANDAG, its officers, agents,' and
employees against any and all claims, demands, damages, expenses, actions, liabilities or
losses which may arise from, or be incurred as a result of, injury or damage to persons or
property in connection with the performance of traffic engineer under this agreement, pro-
vided, however, that City's obligation under this paragraph shall be limited to the extent that
SANDAG is required by the employment agreement between SANDAG and traffic engineer to
indemnify and hold harmless traffic engineer.
The City shall compensate SANDAG for services performed upon billing by SANDAG.
This agreement may be terminated by either party giving written 30-clay notice.
This agreement shall become effective upon ;July 1, 1983, and supersede any prior in-
formal arrangemert•
