ITEM EXPLANATION:
This item is a request for City Council approval of an annexation
of 42.7 acres of uninhabited land, generally located between Rancho Santa Fe Road and the future extension of Melrose Avenue.
The Local Agency Formation Commission adopted a Resolution of Annexation
for this property on June 6, 1983. A copy of this resolution is
attached for your review. The last discretionary action to complete
the annexation is the adoption of a Resolution of Annexation by the
City Council. Approval of this annexation would be consistent with
the City Council's annexation policy.
It is also being requested at this tirce that the City Council accept
the dedication of Melrose Avenue as a public street. This road is
already constructed but acceptance of the road has been pending
approval of the annexation.
ENVIRONMENTAL REVIEW:
The Negative Declaration for the property was approved by the
Planning Commission on May 1, 1982. A copy of the environmental
documents is on file in the Land Use Planning Office.
FISCAL IMPACT :
The annexation of this property will generate additional revenue from property taxes which should offset the cost of providing public services to the site.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE ANNEXATION OF
CERTAIN UNINHABITED TERRITORY HEREINAFTER DESCRIBED AND DESIGNATED AS THE MELROSE AVENUE REORGANIZATION TO INCLUDE THE DETACHMENT OF SA15
PROPERTY FROM THE CITY OF SAN MARCOS AND THE SAN
MARCOS FIRE PROTECTION DISTRICT.
WHEREAS, an application for approval of a proposal for the
initiation of proceedings for the reorganization of territory
hereinafter indentified and described as Melrose Avenue
Reorganization to the City of Carlsbad, County of San Diego,
State of California, was filed with the Local Agency Formation
Commission Reference No. RO 82-29; and
WHEREAS, a resolution of the said Local Agency Formation
Commission, after a hearing held in the manner required by law
was duly passed and adopted on the 6th day of June 1983,
approving the application for annexation of the territory
hereinafter described by metes and bounds; and .
WHEREAS, said resolution provided that said reorganization
was approved without notice and hearing and further provided that
the City Council of the City of Carlsbad was authorized to annex
said territory without notice and hearing by said Council and
without an election as provided in California Government Code
Section 35151; and

WHEREAS, a written petition containing the required
signatures and a description of the uninhabited territory
hereinafter described has been presented to the Local Agency
Forination Commission requesting reorganization under the
Municipal Organization &ct of 1977; and the District
ReOKganiZatiOn Act of 1965; and

WHEREAS, said petition has been signed or consent thereto
has been filed by the owners of all.of the land in the t-erritory
to be annexed;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, Californja, as follows:
1. That the above recitations are true and correct.
2. That said petition contains a description of certain
uninhabited territory sought to be included and annexed to the
City of Carlsbad and detached from the City of San Marcos and San
Marcos Fire Protection District that said petition is signed by
the owners of not less than 25% of the land in the territory by
area and by assessed value as shown on the latest equalized
assessment roll of the County of San Diego, in which county the
City of Carlsbad is situated.
3. That the City Council hereby declares that said petition
has been signed or consent to the proposed reorganization filed
by the owners of all. of the land in the territory proposed to be
annexed and, therefore, no protests may be filed against the
petition by persons owning property in the territory.
4. That the territory proposed to be annexed to the City is
uninhabited territory as defined by Section 35038 of the
Government Code and is contiguous to the boundaries of the City.
M 5. That the aforementioned uninhabited territory included
in the proposed reorganization is hereby designated and shall
hereafter be known as the MelrbSe Avenue Reorganization.
6. That upon completion of said reorganzation all of the
property included therein shall be taxed accordingly with the

Dther property within the City of Carlsbad to pay the bonded
indebtedness and any and all generkl indebtedness of the City of
Carlsbad contracted prior to, or existing or outstanding at the
time of, the aforesaid proposed annexation of said described
property.
7. That all requirements'of law necessary to the adoption
of this resolution approving the- reorganization of certain
uninhabited territory pursuant to the provisions of the Municipal
Organization Act of 1977, and the District Reorganization Act of
1965, have been complied with.

8. That it does hereby approve the annexation to the City
of Carlsbad and the detachment from the City of San Marcos and
San Marcos Fire Protection District of that certain real property
located in the County of San Diego, State of California,
designated as the Melrose Avenue Reorganzation and more
particularly described on Exhibit "A" attached hereto and made a
part hereof.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING GRANT DEEDS FROM
AETNA CAPITAL COMPANY, ANDEN GROUP AND LA COSTA
LAND COMPANY FOR ROAD PURPOSES.
WHEREAS, Aetna Capital Company, Anden Group and La Costa Land
Company have submitted Grant Deeds conveying an easement to the
City of Carlsbad for road purposes; said Deeds are on file in the
Office of the City Clerk and are incorporated herein by reference;
and
WHEREAS, the City Council of the City of Carlsbad has determined
it to be in the public interest to accept said Deeds;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the Grant Deeds conveying an easement to the City of
Carlsbad for road purposes are hereby accepted.
3. That the City Clerk is hereby authorized to cause the origina
Deeds to be recorded in the Office of the County Recorder of San
Diego County, State of California, with the appropriate Certificate
of Acceptance attached.

FORMATION COYJ\IISSION APPROVING A PROPOSED
ANNEXATION TO THE CITY OF CARLSBAD AND
DETACHMENTS FROM THE CITY OF SAN MARCOS AND
TElE SAN MARCOS FIRE PROTECTION DISTRICT
"MELROSE AVENUE REORGANIZATION"
On motion of Commissioner Hersom, seconded by Commissioner
Bennett, the following resolution is adopted:
WHEREAS, a petition of application was submitted to this
Commission for reorganization of territory including the detachments
from the City of San Marcos and the San Marcos Fire Protection District and annexation to the City of Carlsbad, which petition was certified sufficient by the Executive Officer on November 17, - 1982; and
WHEREAS, the territory proposed for reorganization is as described in the application on file with the Local Agency Formation Commission; and
.WHEREAS, pursuant to Government Code Section 56262, the
Executive Officer of this Commission'set a public hearing on the
proposed reorganization for June 6, 1983 and gave notice of the date, time, and place of said hearing in accordance with Government
Code Sections 56264 and 56265: and
WHEREAS, the Executive Officer of the Commission has filed
his report on said reorganization, which report was received and considered by the Commission;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby
finds, determines, and orders as follows :
(1) The hearing was held on the date set therefor, and due notice of said hearing was given in the manner required by law.
(2) At that hearing the Commission called for, heard, and considered all interested parties and read arid considered the '
report of the Executive Officer.
(3) The Cornmission certifies that it has reviewed and considered the information contained in the Negative Declaration prepared by
the City of Carlshad.
(4) The Commission hereby approves the reorganization with modified bouiidasies, as described ir. Exkibit "A" attached hereto,
subject to the following conditions:
None
(5) The boundaries of the territory as described in Exhibit
"A" are definite and certain.
' (6) The boundaries of the territory do conform to lines of
assessment and ownership.
(7) The change of organization does not constitute a minor
boundary change.
(8) The Territory includes 42.7 acres and is uninhabited.
(9) The territory proposed to be reorganized is hereby
designated the "Melrose Avenue Reorganization" (City of Carlsbad).
(10) The Commission hereby designates the City of Carlsbad as the conducting authority and authorizes the City Council to initiate proceedings in compliance with' this resolution without notice and hearing and without an election.
(11) The Executive Officer of this Commission is directed to file and mail certified copies of this resolution as required by law.
