The agreement stipulates that by July 1, 1983 three conditions must be met. They are as follows: 1) No new materials will have been brought into the yard; 2) One-sixth of the total materials in the yard will be removed in accordance with a schedule verified by the Director of Building and Planning; and 3) Everything above the level of the top of the wall shall be removed. Our inspection of the site leads our office to believe that the materials are being removed in accordance with the intent of this agreement. Previously, no aisles were visible in the yard. Recent inspections have shown that aisles are beginning to appear throughout the site. While parts are still visible above the wall in some areas, it is our opinion that these few items are in areas that continue to be inaccessable, and are generally toward the rear of the site. In summary, we believe Mr. Chappee to be sufficiently in compliance with his agreement for us to recommend a continuance of the Public Nuisance Public Hearing to August 2, 1983. MO:PJK:bw COUNCIL ACTION; 7-5-83 Council continued the public hearing to August 2, 1983. 8-2-83 Council continued the public hearing to Sept. 6, 1983.
