DATE: July 5, 1983
TO: City Council
FROM: Marty Orenyak, Director of Building and Planning
VIA: Frank Aleshire, City Manager
SUBJECT: RECOMMENDED CONTINUANCE OF PUBLIC HEARING FOR PUBLIC
NUISANCE ABATEMENT FOR CHAPPEE AUTO WRECKING
Based on numerous field checks of the Chappee Auto Wrecking site
over the last six weeks, our office believes Mr. Chappee to be
living up to the terms of his agreement with the City at this
time. The agreement stipulates that by July 1, 1983 three
conditions must be met. They are as follows:
1) No new materials will have been brought into the yard;
2) One-sixth of the total materials in the yard will be
removed in accordance with a schedule verified by the
Director of Building and Planning; and
3) Everything above the level of the top of the wall shall
be removed.
Our inspection of the site leads our office to believe that the
materials are being removed in accordance with the intent of
this agreement. Previously, no aisles were visible in the yard.
Recent inspections have shown that aisles are beginning to
appear throughout the site. While parts are still visible above
the wall in some areas, it is our opinion that these few items
are in areas that continue to be inaccessable, and are generally
toward the rear of the site.
In summary, we believe Mr. Chappee to be sufficiently in
compliance with his agreement for us to recommend a continuance
of the Public Nuisance Public Hearing to August 2, 1983.
