RECOMMENDING AWARD OF CONTRACT FOR LITTER

RECOMMENDED ACTION:
Approve appropriation of $4,800.00 to continue the "Litter Gitter" program
previously funded by SB650 grant funds (State Litter Control, Recycling
and Resource Recovery Grant Program).
ITEM EXPLANATION:
The City of Carlsbad contracted with the Carlsbad Boys and Girls Club in
July 1982 for litter removal services on a once-a-month basis from selected
rights-of-way.
Divisions budget.
keep this worthwhile program operating during fiscal year 1983-84.
Funds for this contractare budgeted in the Solid Waste

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING AN AGREEMENT
BETWEEN THE CITY OF CARLSBAD AND TEE CAKLSBAD
BOYS AND GIRLS CLUB FOR LITTER REMOVAL SERVICES.
WHEREAS, the City Council of the City of Carlsbad,
California, does hereby resolve as follows:
1. That an agreement between the City of Carlsbad and the
Carlsbad Boys and Girls,Club for services relative to removal of
litter from City rights-of-way, a copy of which is attached
hereto, marked Exhibit "A" and made a part hereof, is hereby
approved.
2. That the Mayor of the City of Carlsbad is hereby
authorized and directed to execute said agreement on behalf of
the City of Carlsbad.
PASSED, APPROVED AND ADDPTED at a regular meeting of the
City of Carlsbad, held on the 19th day of July I 1983,
by the following vote, to wit:

This agreement entered into this day of
1983, by and between the City of Carlsbad, a.
municipal corporation of the State of California, hereinafter
referred to as "Carlsbad", and the Carlsbad Boys and Girls Club,
hereinafter referred to as "Club".
I WITNESSETH:
WHEREASf Carlsbad is engaged in various street
maintenance programs including street swekping to-promote the
safety, health and general welfare of its citizens and;
WHEREAS, it is deemed appropriate to accomplish litter
removal from the City rights-of-way by agreement wtth the Club
and ;
WHEREAS, the Club can provide litter removal. service
for just compensation and in the public interest;
NOW, .. THEREFOREf IT IS AGREED as follows:
SECTION 1 DUTIES OF CARLSRAD

Provide appropriate warning signing, equipment and
disposal of collected litter. ..
Provide appropriate inspection of the cleared
areas.
Reimburse the Cli-b on a monthly basis in the amount
of $400.00 on the condition of faimful performance
of litter rehioval.

SECTION 2 DUTIES OF THE CLUB *
A. Provide litter removal from the rights-of-way on:
1 . Palomar Airport Road - from El Camin'o Real
east to the City limits (Linda Vista Lane.).
. 2. Alga Road - Alicante to El Fuerte, including *
the median.
3. Coast Highway (darlsbad Boulevard) from
Pa1,omar Airport Road. to the Batiquitos
Bridge, including the median..
4, El Carf'dno Real - Kelly Drive to Marron Road,
including the median from Chesinut t.0 Marron.
.El Camino Real - south from Beckman entrance 5.
to end of industrial area.
6.. Cannon Road - Carlsbad Boulevard to east end.
7'. Marron Road - El Camino Real to Avenida de
. Anita.
.8. Chestnut - Monroe to El Camino Real.
.9. Poinsettia Lane - Avenida Encinas to
Batiquitos Lane on a once-a-month basis.
B. Provide adult supervision on the basis of one (1)
adult per four (4) youth m'embers.

Take all necessary measures ta ensure the safety
of personnel involved in the litter removal
efforts.

D. Conduct litter .removal during the period 8:OO a.m.
to 3:30 p.m. on Saturday. Specific Saturday to be.
scheduled to the mutual satisfaction of the C'lub
and City.
SECTION 3 PAYMENT TO the Club on the basis of one complete
litter clean-up per month in the amount of $400.00 per month
during the period of this agreement.
SECTION 4 TERM This agreement will be affective upon date of
execution of this agreement by the Mayor of Carl'sbad. It shall
terminate on June 30, 1984. During said term, this agreement may be
terminated at any time upon thirty (30) d-ays writfen notice.
SECTION 5 INSURANCE The Club shall provide City a
certificate of insurance naming City as additionally insured on their
normal liability policy.
SECTION 6 HOLD HARMLESS AGREEMENT Carlsbad, its officers,
and employees shall not be liable for any claims, liabilities,
penalties or fines or any damage to goods, properties, or effects of
any person whatever, or personal injuries to or death of'them caused
by, or resulting 'from, or claimed to have been caused by, or resulting
from, any act or omission of Carlsbad,'its officers or employees.
The Club further agrees to indemnify and-save free and harmless
Carlsbad and its authorized officers and employees, against any of the
foregoing liabilities,and claims thereof, and any cost and expense
that is incurred by the City on account of any claim thereof.

SECTION 7 NOTICES - All notices required herein shall be
'in writing and delivered in person or sent by mail.' Notice to '
Carlsbad shall be addressed: City Manager, 1200 Elm Avenue,
Carlsbad, California, 92008..
Notices to the Club shall be addressed: Executive Director, P.O.
Box 913, Carlsbad, California, 92008.
IN WITNESS WHEREOF, the parties hereto have executed this
agreement on this day.and year first above written.
