HD.J?& > 0 [r e a Q CITY Li CARLSBAD - AGENDA ______ RECOMMENDED ACTION: Adopt Resolution No. {JE? declaring the intention to vacate portions of Walnut an Lincoln Avenues and setting a public hearing for 6:OO PM, Tuesday, August 2, 1983. ITEM EXPLANATION: I A request to vacate excess street right-of-way on portions of Walnut and Lincoln Avenues was made by Rick Engineering, Co., on behalf of Pelican Properties. Pelican Properties is currently working on plans for a condominium project adjacent to the area to be vacated. Staff has reviewed the request and concluded that the excess street right-of-way is not needed for 'the ultimate street widening. Walnut and Lincoln Avenues are collector streets with required right-of-way .width of 60 feet. The City currently has 80 feet of right-of-way on the above streets. Utility companies have been notified of the vacation. An easement Staff recommends that the above vacation be conditioned for half- street improvements by Pelican Properties. . for all existing utilities is exempt from this vacation. I FISCAL IMPACT: I Approval of this vacation will result in approximately 6,400 sqaure feet of land to be returned to the tax rolls, and cost of half-street improvements will be borne by the property owner. The City Council of the City of Carlsbad, California, does hereby resolve as follows: 1. The City Council of the City of Carlsbad hereby declares its intentions to proceed, under the provisions of Public Streets, Highways;and Service Easement Vacation Law of 1981, to vacate portions of Walnut and Lin'coln Avenues, located in the City of Carlsbad, County of San Diego, State of California, particularly described on Exhibit A. 2. A public hearing shall be held at the City Council Chambers at 1200 Elm Avenue, Carlsbad, California, at 6:OO PM on August 2, 19'83, for the purpose of hearing all persons interested in or objecting to said proposed vacation.
