The City Council on July 19, 1983, adopted Resolution NoB 7239, of intention to vacate portions of Walnut Avenue and Lincoln Street. City Council set August 2, 1983 at the hour of 6 P.M. as the time and the City Council Chambers, 1200 Elm Avenue, as the place for a public hearing for all persons interested in or objecting to said proposed vacation. companies were notified.

RESOLUTION NO. 7 315
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, VACATING PORTION OF WALNUT AVENUE AND LINCOLN STREET.
The City Council of the City of Carlsbad, California, does'hereby
resolve as follows:
1. That all publication and posting notices regarding the
proposed vacation of portions of Walnut Avenue and Lincoln Street pursuant
to Resolution of Intention No. 7289 have been given as required by law.
That the City Council did hear the evidence offered by all
persons interested in said proposed vacation and does find from all the
evidence submitted that portions of Walnut Avenue and Lincoln Street in the
City of Carlsbad, County of San Diego, State of California, particularly
described on Exhibit "All, attached hereto and by this reference
incorporated herein, is unnecessary for present or prospective street
purposes and does hereby make this order vacating said portion of Walnut
Avenue and Lincoln Street.
2.
3. That an easement for all existing utilities is excepted from
this vacation.
4. That the vacation of said portion of Walnut Avenue and Lincoln
Street is conditioned upon the Pelican Properties constructing street
improvements along the frontage of the proposed vacation within a year.
Such improvements shall include sidewalks, street lights, tree planting,
and pavement.
5. Filing of final condominium map by Pelican Properties and
inclusion of the half-street improvement conditions will satisfy Condition
4.

The City Clerk is instructed not tc record this Resolution of
Vacation until the terms of Conditions 4 or 5 have been complied with.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City
Council of the City of Carlsbad, California, held the 2nd day of August,
1983, by the following vote, to wit:
