RECOMMENDED ACTION:
The Planning Commission and the staff are recommending that thc

CT 83-13/CP-237.
ITEM EXPLANATION
The applicant is requesting a zone change from R-1-10,000 to RL
M, a tentative map and a condominium permit for 131 units locat
on the southeast corner of Avenida de Anita and Marron Road (location map attached), The existing general plan designatior is RMH (Residential Medium High Density) which permits a range
10 to 20 dwelling units per acre. The proposed RD-M zone is consistent with the RMH designation. The only concern with the project is that at 19.5 du/ac it is in the high end of the
density range. Both the Planning Commission and the staff felt
that a higher density was justified for this project because of the quality of design, large recreation areas and close proximi
to shopping facilities. For further information please see the
attached staff report to the Planning Commission.
FISCAL IMPACT
The applicant will provide all required public improvements to the project. Also, the applicant has agreed to pay a public facilities fee to offset the costs of providing all other publi services.
ENVIRONMENTAL REVIEW
The Land Use Planning Manager issued a negative declaration for
this project which was approved by the Planning Commission on
July 27, 1983.

It is recommended that the Planning Commission APPROVE the &iegative.Declaration issued by the Land Use Planning Manager and ADOPT Resolution Nos. 2156 and 2157, recommending APPROVAL of ZC-283 and CT 83-13/CP-237, based on the findings and subjec to the conditions contained therein,
I1 * PROJECT DESCRIPTION
The applicant is requesting approval of a %One change from R-l-
10,000 to ED-M and a tentative subdivision nap and condominium
permit for 131 units on 6.7 acres, located, as described above.
The subject property is roughly rectangular in shape with
portions of the site fronting on both Avenida De Anita and
Marron Road. Access to the project would be derived from
Avenida De Anita.
~Sne project site is bordered to the south and west by the
Tanglewood development. Property to the southeast is an open
space slope dedicated as a part of the Quail Ridge development.
The souther"^ property adjoins the site to the north. This
portion of the Souther's project is planned for office development.

The units would consist of approximately 98 two bedroom and 33
one bedroom units. The project would result in an overall
density of 19.5 du/ac, near the maximum permitted by the RXH
(Residential Medium-High, 10-20 du/ac) designation of the subjf
property. To justify the proposed density, the applicant
proposes to provide large open areas, special landscaping,
recreational amenities in excess of ordinance requirements and
hydroseed the adjoining open space slope with a variety of
flowers. Additionally, proximity to shopping facilities and tl
proposed office development tend to justify a higher density,
Recreation area requirements would be exceeded by a combinatior of private and common areas. have a private deck ranging in size from 72 to 97.5 sq, ft.
Three common recreation areas would also be provided. One are;
would contain a tennis court, a second area would include a
pool, spa, cabana and adjacent lawn, and a third lawn area woul be provided near the project entrance. Total recreation area provided would approximate 48,000 sq., ft. for an overall ratio of 365 sq. ft, per unit.
A total of 300 parking spaces would be provided, 147 covered ar

parking area beneath the tennis court and in carports. The
remaining resident parking would be provided in open parking.

Storage areas would range in size from 392 to 432 cubic feet.
Finally, staff believes that the proposed project would satisfy
all design criteria of the Planned Development Ordinance. The
project appears to be well designed. Buildings have been sited
to maximize open areas and preserve views. Recreation areas
are conveniently located offering a variety of recreational
opportunities,
Overall, staff believes that the proposed project satisfies all

The applicant is requesting a zone change from R-1-10,000 to RI Residential Density Multiple. The requested zone would be
consistent with and implement the RMH, (Residential Medium-Higl
Density, 10-20 du/ac), designation of the Land Use Element of 1
General Plan for this property.
The 6.7 acre site would be suitable in size and shape to accomc
development permitted in the RD-M zone. Typical RD-M developmc
would include multiple-f anily condominiums, as proposed by the
applicant. The site, proposed for rezoning, would be adequate
the design and development of condominiums.
Staff believes that the proposed zoning would be compatible wi
surrounding and anticipated zoning and development. The prope
to be rezoned is bordered to the south by a slope and the Tanglewood condominium project. An apartment project adjoins the subject property to the west across Avenida De Ani Property to the east is an open space area created by the Quai
Ridge development. The Buena Vista Park Plaza, Souther's
development, will abut the project site to the north. This portion of the Souther's property is designated for office
development. In light of the future adjoining office developm
to the north and existing condominium development to the south
a.nd west, staff does not anticipate any adverse impacts on
surrounding properties as a result of the proposed zoning.
The project site is bounded by Marron Road, a secondary
arterial, and Avenida de Anita, a residential collector.
Although Marron Road currently experiences some congestion at
the intersection witn El Canino Real, the City Engineering Department does not anticipate any significant detrimental
efEects resulting from approval of the proposed r2zoning and
believes that the street system would be adequate to accomodat
all traffic generated,
Overall, staff believes that the proposed zone would be
appropriate, consistent with the General Plan and would not
adversely impact surrounding properties or street system.
