RECOMMENDED ACTION:
Approve a change order to the Calco Construction contract for dredging the Buena
Vista Lagoon to increase the quantities as requested by Department of Fish and
Game.
ITEM EXPLANATION:
A contract was awarded to Calco Construction Company on May 12, 1983 to dredge
the Buena Vista Lagoon on a unit price basis in an estimated amount of $779,740.
The City awarded the contract on behalf of the Department of Fish and Game who
had specified the work to be done, provided the necessary funds, and approved the
terms of the contract as it was to be awarded.
It has now become necessary to modify the original set of plans for the project
dictated by the experiences gained during the course of construction and to
maximize the benefits for the funds available. Department of Fish and Game, by
letter of August 5, 1983 (Exhibit 1), has authorized the issuance of a change
order to Calco to proceed with a plan based upon revised figures as furnished by
Calco (Exhibit 2).
The changes essentially increases the quantity of dredging to be done and also
provides for the construction of a parking and visitation point behind the fence
at the southeast corner of the lagoon. The intent of Department of Fish and Game
is to build as many islands as is feasible with the funds available under the
present contract. The approved plan was delivered to the City on August
15,1983. The contract quantities are to be'changed as follows:

Department of Fish and Game deposited $990,000 with the City for the dredging
contract. As of this date, an additional $62,390 has been earned on this
account for a total funding of $1,052,390. The expected construction contract
costs are $992,167 leaving $60,223 for engineering and supervision costs, in-
house costs, and professional services. These funds are solely Department of
Fish and Game funds. No City funds are involved.

Dear Mr. Kackley:
It has become necessary to modify the original set of plans for
the dredging and construction of islands at Buena Vista Lagoon.
Elevations and projected quantities were based on an early contour
map. As construction proceeded, these elevations were shown
to be in error. This has resulted in different quantities of
material than those estimated in the original set of plans.
Calco construction has prepared a revised plan which would raise
the island elevation to 11.5 from 10.5, raise the channel elevation
to 1.7 from 1.2, and create two additional islands. The payment
to Calco for these revised quantities will remain within the
available funds.
We approve the revised figures submitted by Calco as Exhibit "A" -
Sheet 3/4 in their letter of July 27, 1983. We authorize the
City of Carlsbad to issue a change order to Calco to proceed with
the plan based on these revised figures.

Dear Roy,
This letter is to confirm the information reviewed in the meeting Wednesday
August 10, 1983 between Calco Construction, California Fish and Game and the
City of Carlsbad.
Referring to our letter of July 27, 1983 and the meeting at your office July
29, 1983 in which we were directed to proceed with alternate 3 (Exhibit A -
Sheet 3 of 5), we have completed the revised drawings for Buena Vista Lagoon
and the original mylar is now with California Fish and Game to obtain official
approval.
We are proceeding with all haste to complete the excavation for said revised
plans prior to October wildlife migration. The schedule is extremely tight
and can only be completed if the tropical rains now hitting Southern California
do not inflict severe damage.
The calculated projected final quantities are very close but slightly different
to the estimate "submitted, July 27, 1983. Enclosed herewith is a tabulation of
the estimate of July 27, 1983 and calculated Projected Final Pay (Exhibit "A").
The change order executed in accordance with Section 7 - Page 13 of the contract
should be based upon these calculations.
I have submitted under a separate cover, a suggested procedure for verifying
final quantities.

It is absolutely critical that we receive written confirmation of the verbal
instructions to proceed very soon if work is not to be delayed.
It is my opinion that all authorizations to proceed with the revised plan is
contained in the original contract with the authority to extend quantities to
125% of the Engineer's Estimate, except:
1. Extension of work outside original excavation limits. (Northwest corner)
2. Extension of construction of Island beyond the 125% for the agreed
price of $2.00/cy plus lump sum for construction of work road for
dragline.
It is absolutely essential to begin construction of the work road for extra
Island within the next 10 days if we are to complete work before the wildlife
migration begins this season.
