RECOMMENDED ACTION:
The Planning Commission and staff are recommending that the City Council direct
the Attorney's Office to prepare documents APPROVING GPA/LU 83-7/ZC-279.
ITEM EXPLANATION
This item is a request for:
1 ) A General Plan Amendment from NRR to P-I ; and
2) A Zone Change from L-C to
on property located approximately 60 feet north of the future intersection of
College Boulevard and Statler Street. The property is one-half acre in size and
is sandwiched between the Signal Landmark industrial property and Macario
Canyon.
As a point of background, the property was included by LAFCO in the annexation
of the Huntington property located further to the east. LAFCO wanted to delete
this site as a county island. The property was given a zoning designation of
L-C which is a holding zone for properties which are annexed but have not
undergone a prior zone change.
The Planning Commission found that the property relates topographically to the
Signal Landmark industrial property. The Commission believes that the Planned
Industrial general plan designation and zone are the most appropriate for this
site.
Through staff review and Planning Commission hearing, all issues on this matter
have been satisfactorily resolved.
ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project will not cause
any significant environmental impacts and, therefore, has issued a negative
declaration, dated July 22, 1983, which was approved by the Planning Commission
on August 24, 1983. A copy of the environmental documents is on file in the
Land Use Planning Office.
FISCAL IMPACT
The applicant will provide all required public improvements to the property at
the time of development. Also, the applicant has agreed to pay a public
facilities fee to offset the costs of providing all other public services at the
time of development.

CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF AN AMENDMENT TO THE LAND USE ELEMENT
OF THE GENERAL PLAN FROM NRR (NON-RESIDENTIAL
RESERVE) TO P-I '(PLANNED INDUSTRIAL) ON A .53
ACRE PROPERTY GENERALLY LOCATED 60 FEET
NORTH OF THE FUTURE INTERSECTION OF STATLER
STREET AND COLLEGE BLVD..

WHEREAS, a verified application for an amendment to the
General Plan designation for certain property located, as shown on
Exhibit "B", dated June 22, 1983, attached and incorporated herein,
have been filed with the Planning Commission; and
WHEREAS, said verified applications constitute a request
for amendment as provided in Title 21 of the Carlsbad Municipal
Code; and
WHEREAS, the Planning Commission did, on the 24th day of
August, 1983, hold a duly noticed public hearing as prescribed by
law to consider said request;
WHEREAS, at said public hearing, upon hearing and
considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors
relating to the General Plan Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad, as follows:

A) That the above recitations are true and correct.
B) That in view of the findings made and considering the
applicable law, the decision of the Planning Commission is to
recommend APPROVAL of GPA/LU 83-7, as shown on Exhibit "B",
dated June 22, 1983.

Findings;
1. The property is physically suitable for industrial development
because the site is on the same elevation and is bounded on
two sides by property designated for industrial development.
2. The uses allowed in the proposed planned industrial use
designation will be compatible with the surrounding future land
uses.
3. This project will not cause any significant environmental
impacts and a Negative Declaration has been issued by the Land
Use Planning Manager, dated July 22, 1983 and approved by the
Planning Commission, August 24, 1983.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Planning Commission of the City of Carlsbad, California, held on
the 24th day of August, 1983, by the following vote, to wit:
AYES: Chairman Schlehuber, Commissioners Rombotis,
Farrow, Lyttleton, Friestedt and Rawlins.
NOES: None.
ABSENT: Commissioner Marcus.

WHEREAS, a verified application for certain property, to
wit:
The southeasterly 152.00 feet of the southwesterly
152.00 feet of Rancho Agua Hedionda according to Map 823
filed November 16, 1896,
has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said application constitutes a request as
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 24th day of
August, 1983, hold a duly noticed public hearing as prescribed by
law to consider said request; and
WHEREAS, at said public hearing, upon hearing and
considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors

Commission as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the
Commission recommends APPROVAL of ZC-279, based on the
following findings and subject to the following conditions:

1) The proposed zone change to P-M is consistent with the
General -Plan designation of P-I since this designation is
applied to areas that are suitable for industrial develop-
ment. ,
2) The P-M zone is compatible with surrounding properties
because the properties which surround the subject property
have been designated for industrial development.
3) The applicant has agreed and is required by the inclusion of
an appropriate condition to pay a public facilities fee.
Performance of that contract and payment of the fee will
impacts and a Negative Declaration has been issued by the
Land Use Planning Manager on July 22, 1983, and approved by
the Planning Commission on August 24, 1983.
Conditions
""1) Approval is granted for ZC-279, as shown on Exhibit "A
dated June 22, 1983, incorporated by reference and on
file in the Land Use Planning office.
2) This project is approved upon the express condition that the
applicant shall pay a public facilities fee as required by
City Council Policy No. 17, dated April 2, 1982, on file with
the City Clerk and incorporated herein by reference, and
, according to the agreement executed by the applicant for
payment of said fee, a copy of that agreement, dated, April
29, 1983 is on file with the City Clerk.and incorporated
herein by reference. If said fee is not paid as promised,
this application will not be consistent with the General Plan
and approval for this project shall be void.

SUBJECT: GPA/LU 83-7/ZC-279 - KELLY - A Request to amend the
General Plan Land Use designation from NRR (Non-
Residential Reserve) to P-I (Planned Industrial), and a
zone change from L-C (Limited Control) to P-M (Planned
Industrial) on property located approximately 60 feet
north of the future intersection of College Boulevard
and Statler Street.
I. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Negative Declaration issued by the Land Use Planning Manager and
ADOPT Resolution No's 2161 and 2138; recommending approval to
the City Council of GPA/LU 83-7 and ZC-279.
II. PROJECT DESCRIPTION AND BACKGROUND
The applicant is requesting that the Land Use Element of the
General Plan be changed from NRR (None-Residential Reserve) to
P-I (Planned Industrial) and that the zoning be changed from L-C
(Limited Control) to P-M (Planned Industrial) on property
located as described above. The property is .53 acres in size
and is bounded on the southern and western sides by the Signal
Landmark property. Topographically, the site slopes downward in
a northwesterly direction towards Macario Canyon.
When the applicant for the Huntington Properties applied for
annexation into the City of Carlsbad, LAFCO included this parcel
as part of the annexation and gave it a General Plan and zoning
designation of NRR and L-C. The applicant is proposing the
General Plan Amendment and Zone Change to Planned Industrial so
as to keep it consistent with the adjacent industrially
designated parcels of the Signal Landmark property.
III. ANALYSIS
Planning Issues - GPA/LU 83-7
1. Is the proposed General Plan designation of Planned
Industrial appropriate for this site?
2. Is the proposed designation compatible with existing and
future land uses in the area?
Discussion
The applicant has requested the P-M designation for the property
since it is on the Sctme elevation as the adjoining Signal i~!
Landmark property arid is best suited for industrial uses.
Staff concurs with this proposal since this area is bounded on
two sides by industrial uses, and the proposed P-I designation
would be consistent with existing and future uses in the area.
Overall, Staff feels it can make the required findings for a
General Plan Amendment and, therefore, recommends approval of
GPA/LU 83-7.
Planning Issues - ZC-279
1. Is the proposed P-M zone consistent with the General Plan
designation of P-I.
2. Are the allowed uses in the P-M zone consistent with the
surrounding zoning and land uses.
Discussion
The requested zone change would be consistent with the General
Plan designation of P-I for the subject property. Also, Staff
feels the proposed zone change and uses allowed within the zone
will be consistent with the surrounding zoning and land uses.
The properties which bound the subject property have been
designated for industrial development. Overall, Staff believes
the required findings can be made and, therefore, recommends
approval of ZC-279.
IV. ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project
will not have a significant impact on the environment and,
therefore, issued a Negative Declaration on July 22, 1983.
