RECOMMENDED ACTION:
If the City Council concurs and wishes to approve the following
amendments to the Land Use Element of the City of Carlsbad General
Plan (GPA/LU 83-1 Palomar and Co.; GPA/LU 83-7 Kelly; GPA/LU 83-8
City; GPA/LU 83-15 Hunt Properties; and GPA/LU 83-5 Garapich/Nogle
and Partners) then your action is to adopt Resolution No.
If the City Council wishes to approve ZC 279 (Kelly) your action is
to introduce Ordinance No. 9^99
ITEM EXPLANATION
The City Council at your meeting of September 27, 1983 directed the
City Attorney to prepare documents approving the five above
referenced amendments to the Land Use Element of the General Plan.
The required resolution has been prepared and is attached.
If the City Council is satisfied that the resolution properly
incorporates your findings and decision in the matter your action
is to adopt Resolution No. 73(* "~f
A part of your consideration of GPA LU 83-7 (Kelly) the City
Council also directed preparation of a corresponding zone change
from Limited Control (L-C) to Planned Industrial (P-M) for the
property. Ordinance No. #6 9 9 is also attached.

RESOLUTION NO. 7367
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING THE LAND USE ELEMENT
OF THE GENERAL PLAN TO CHANGE THE LAND USE DESIGNA-
TIONS FOR FOUR AREAS OF THE CITY'S GENERAL PLAN
GPA/LU 83-1 (PALOMAR & CO.)? GPA/LU 83-7 (KELLY);
GPA/LU 83-8 (CITY); AND GPA/LU 83-15 (HUNT PROPERTIES)
AND TO GRANT AN APPEAL OF THE PLANNING COMMISSION'S
DENIAL THEREBY APPROVING SUCH A CHANGE GPA/LU 83-5
(GARAPICH/NOGLE & PARTNERS).
WHEREAS, the Planning Commission did on August 24
and September 14, 1983 hold duly noticed public hearings as
prescribed by law to consider amendments to the Land Use Element
of the General Plan GPA/LU 83-1, GPA/LU 83-7, GPA/LU 83-8, GPA/LU
83-15 and GPA/LU 83-5; and
WHEREAS, the Land Use Planning Manager and the Planning
Commission have determined that amendments GPA/LU 83-1, GPA/LU
83-7, GPA/LU 83-8 and GPA/LU 83-5 will not have significant
impacts on the environment and Negative Declarations have been
prepared and filed, and EIR 83-2 was certified for GPA/LU 83-15
all in satisfaction of the requirements of the City of Carlsbad
Environmental Protection Ordinance of 1980 and the California
Environmental Quality Act; and
WHEREAS, the City Council did on September 20 and
September 27, 1983 hold duly advertised public hearings to
consider said amendments and at said time received the
recommendations, objections, protests and comments of all
interested persons desiring to be heard; and
WHEREAS, the City Council, after considering these and
other proposed changes to the Land Use Element of the General
Plan, directed the City Attorney to return with appropriate

documents to allow the City Council to vote on the changes
individually as a part of one single amendment to the Land Use
Element of the General Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California as follows:
A. That the above recitations are true and correct.
B. That this resolution constitutes a single amendment
to the Land Use Element of the General Plan.
C. That the findings of the Planning Commission as set
forth in Planning Commission Resolutions Nos. 2168 (GPA/LU 83-1);
2161 (GPA/LU 83-7); 2167 (GPA/LU 83-8) and 2182 (GPA/LU 83-15)
constitute the findings of the City Council and that No. 2162
(GPA/LU 83-5) does not constitute the findings of the City
Council.
D. That the Land Use Element of the General Plan is
amended as follows:
1. GPA/LU 83-1; Change the land use designation
from Extensive Regional Retail (RRE) to Travel Service (TS) on
3.8 acres of property generally located between Interstate 5 and
Avenida Encinas approximately 700 feet north of Palomar Airport
Road, as shown on the map marked Exhibit A, dated July 26, 1983,
attached hereto and made a part hereof.
2. GPA/LU 83-5; Change the land use designation
from Residential Medium Density (RMH) to Residential Very High
Density (RVH) on .67 acres of property generally located at 3334
Harding Street, as shown on the map marked Exhibit B, dated
September 20, 1983, attached hereto and made a part hereof. In

making this change the City Council finds that the property in
question is a part of the downtown area and meets the
requirements for the higher density and therefore the Council
grants the applicant's appeal of the Planning Commission's
denial of such change.
3. GPA/LU 83-7; Change the land use designation from
Non-Residential Reserve (NRR) to Planned Industrial (P-I) on .53
acres of property generally located 60 feet north of the future
intersection of Statler Street and College Boulevard as shown on
the map marked Exhibit C dated June 22, 1983, attached hereto
and made a part hereof.
4. GPA/LU 83-8; Change the land use text and map to
revise the designation of school sites and service areas as shown
on the text marked Attachment "A", dated September 8, 1983, and
the maps marked Attachments "B", "C" and "D" dated August 5,
1983, attached hereto and made a part hereof. The land use
element map will show actual boundaries for the following
existing school sites: high schools #1 and #2, junior high
school #1, and elementary schools #'s 1, 2, 3, 4, 5, 7, 16 and
17.
5. GPA/LU 83-15; Establish the land use designation as
a combination district (0, C, RMH) for approximately 280 acres
of property generally located on the west side of El Camino Real
south of La Costa Avenue, as shown on the map marked Exhibit D
dated September 27, 1983, attached hereto and made a part
hereof. The City's sphere of influence shall be amended to
include said property.

7. Schools
This land use classification represents both existing
proposed school sites necessary to serve the ultimate planning
area. The sites are designated as elementary, junior high or
high school facilities. Sites delineated on the Land Use Map
with precise boundaries represent existing sites and sites shown
with a circular symbol represent proposed sites to be confirmed
by the respective school districts at time of development.
The school locations have been determined by a special study
which re-evaluated the. original (1974) locations shown on the
Land Use Map. The School Location Plan was adopted by the
Carlsbad School District in April, 1983.
The School Location Plan also designates "service areas" for
each of the school locations city-wide. These service areas
were identified based on student generation factors, ideal
school sizes and maximum travel distance. The "service areas"
show the general areas which would provide students for each
school location.

All school locations and service areas are inter-related. It
should be noted that a substantial change in individual school
location, or school addition/deletion, would necessitate
revision of locations city-wide. .
NOTE; For those school districts only partially within the ADDED
city's sphere of influence where service areas may overlap school AFTER
district boundaries (i.e., San Marcos Unified, San Dieguito
Unified High, Sncinitas Unified) an additional procedure is
necessary to confirm specific school locations and service areas
as shown on the land use plan map.
At the time of development review (subdivision) for an area in
which a school site is shown, the affected school district must
confirm the location in writing to the city. The confirmation
must include the followingT ~~~

Indication of the general similarity of the city school
service area to the districts anticipated service area for
the planned school.
2. Details of the arrangements that have been made by the
overlapping school districts which would result in sufficient
students to justify the specific location, using criteria
established by the City's school location plan.
If confirmation cannot be accomplished, the school site
designation shall revert to the adjacent land use designation and
alternative service areas and school locations shall be
consTcTered by the City -M. a subsequent amendment to the general

OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21 OF
THE CARLSBAD MUNICIPAL CODE BY AMENDING THE
ZONING MAP TO GRANT A CHANGE OF ZONE (ZC-279)
FROM L-C TO P-M ON AN APPROXIMATELY .53 ACRE
PROPERTY LOCATED 60 FEET NORTH OF THE FUTURE
INTERSECTION OF COLLEGE BOULEVARD AND STATLER
STREET.

The City Council of the City of Carlsbad, California does
ordain as follows:
SECTION 1: Title 21 of the Carlsbad Municipal Code is
amended by the amendment of the zoning map to grant a zone change
(ZC-279) from L-C (Limited Control) to P-M (Planned Industrial) on
property as shown on the map marked ZC-279 - Exhibit A, attached
hereto and made a part hereof.
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its
adoption.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the llth day of October ,
