ZCA-168 - CITY OF CARLSBAD DEPT. HD.~ CITY AM CITY MGR,QJ& RECOMMENDED ACTION: The Planning Comnission and staff are recomnending that the City introduce Ordinance No. 76 creating the 0 zone. ITEM EXPLANATION The proposed amendment to the zoning ordinance would create a new zone which would be an exclusively office type me. The new office mne, or 0 mne, is intended to implement the Professional and Related Comwrcial (0) category of the general plan. Currently, this designation is implemented by the Residential Professional (R-P) zone. Problems with using the existing R-P zone are that it also allows residential use and it prohibits limited, incidental mmercial uses normally located in an office area. The new mne will solve both of these problems. The 0 zone will probably be used for new developnent primarily in the central and southern areas of the city. Unless requested by property owners, it will not be utilized to replace existing R-P zoning. The proposed zone was reviewed by members of the business connnunity and several changes were made in response to their input. see the attached staff report to the Planning Conunission. For additional information please The Land Use Planning Manager has determined that this project Will not cause any significant enviromntal impacts, and therefore, has issued a Negative Declaration, dated July 27, 1983, which was approved by the Planning Connnission 3n Septdr 14, 1983. The City Council of the City of Carlsbad, California, loes ordain as follows: SECTION I: That Title 21 of the Carlsbad Municipal Code .s amended by the addition of Chapter 21.27 to read as follows: Chapter 21.27 0 - OFFICE ZONE lections: 21.27.010 Intent and purpose 21.27.020 Permitted uses 21.27.030 Uses and structures permitted by conditional use permit 21.27.040 Site development plan required 21.27.050 Development standards 21.27.010 Intent and purpose. The office zone establishes ,egulations for the development of professional offices and Ilosely related commercial uses. This zone is intended for Nxclusive office use but limited commercial may be permitted in Iertain circumstances. This zone may be utilized as a buffer letween higher intensity commercial uses and residential evelopment. 21.27.020 Permitted uses. Subject to the provisions of Chapter 21.50 the 'ollowing uses may be permitted by conditional use permit: (1) Athletic clubs (2) Day care facilities for children (3) Hospitals (4) Restaurants (5) On-premise sale of liquor within a bonafide eating (6) Drive-through facilities (7) Schools including dance, drama and music establishment 21.27.040 Site development plan required. Approval of a ite development plan, processed according to the provisions of lhapter 21.06 shall be required for any development in the 1 zone. 21.27.050 Development standards. The following development tandards shall apply to all new construction, development or ubdivision in the 0 zone: (1) Lot Area. The minimum area of any newly created lot hall be 10,000 square feet except that this requirement shall .ot be construed to prohibit condominium or planned unit evelopments approved pursuant to Chapter 21.47 of the Carlsbad lunicipal Code. This zone may be applied to existing lots of 2. b 1 (2) Lot Width. Every newly created lot shall have a width of not less than 75' at the rear line of the required front yard. within the 0 zone shall not exceed 35 feet. Additional building height may be approved in the Site Development Plan, provided, however, that the City Council shall be the final approving body of the Site Development Plan. (3) Building Height. A detailed sign program shall be submitted to .he Land Use Planning Manager for approval prior to occupancy of Iny new building or installation of any new signs. All signs )reposed in the 0 zone shall comply with the following Segulations: (A) Total maximum allowable area of all signs, ,ncluding monument signs, shall not exceed one square foot per ineal foot of building frontage. (B) One freestanding monument sign may be permitted 'or each lot. Said monument sign shall be no greater than six 'eet in height or six feet in length, (including the base), with I maximum of two sign faces. Comprehensively planned levelopments may be permitted additional monument signs, above .he allowable area, through the Site Development Plan process. ( 10) Walls and Fences. A solid masonry wall, six feet in 'eight, shall be constructed along the common lot line with any .esidentially zoned property, except in the front yard where the fall shall be reduced to 42" in height. Walls and fences up to I height of six feet are permitted except that no wall or fence lhall be erected in any front yard setback in excess of 42" and .hat all walls and fences shall observe a minimum setback of 10' rom the property line for side yard on a street. Chain link, barbed wire razor ribbon or other similar fences are specifically lot permitted. (11) Lighting. Exterior lighting is required for all lmployee and visitor parking areas, walkways, and building Intrances and exits. Light sources shall be designed to avoid lirect or indirect glare to any offsite properties or public *ights of way. (12) Roof appurtenances. All roof appurtenances, including lir conditioners, shall be architecturally integrated and ,hielded from view and the sound buffered from adjacent broperties and streets, to the satisfaction of the Land Use llanning Manager. (13) Trash enclosures. Trash receptacle areas shall be Inclosed by a six-foot high masonry wall with gates pursuant to 'ity Standards. September 14, 1983 Planning Commission Land Use Planning Office ZCA-168 - CITY OF CARLSBAD - An Amendment to the Zoning Ordinance creating the 0 (Office) Zone. RECOMMENDATION .It is recommended that the Planning Commission approve the Negative Declaration issued by the Land Use Planning Manager and ADOPT Resolution No. 217?, APPROVING ZCA-168, based on the findings contained therein. 11. PROJECT DESCRIPTION The project is an amendment to the Zoning Ordinance creating the 0 (Office) Zone. The proposed new zone would create guidelines for the development of professional off ices arid closeiy related commercial uses. The new zone would establish permitted uses and set development standards including lot sizes, setbacks, landscaping and signing. -c The proposed zone is intended to be used in conjunction with new development primarily in the central and southern areas of the City. It is anticipated that the new zone would be applied to areas of hiaher intensity, concentrated office uses. The office zone will serve to implement the "O", Professional and Related Commercial, Land Use designation of the General Plan. Currently, this land use designation is implemented by the R-P, Residential-Professional zone. The R-P zone does not properly implement the 0 designation because it permits residential uses along with office uses. As a result, it is usually necessary to exclude residential uses by Specific Plan in major office . projects, The new zone should eliminate the need for developers to process a specific plan for a total office development. The Office zone is intended to bridge the gap between the Residential-Professional zone and Commercial and Planned Industrial zones. As stated, the City provides for office development primarily in the R-P, Residential-Professional zone. As the name implies, this zone accommodates both residential and office uses and is commonly used in relatively low-intensity office situations and as a buffer between residential and commercial uses. Office uses are also accommodated in commercial areas and, to some extent, in the Planned Industrial zone. - - 4 By contrast, the new Office zone is exclusively office and amount of incidental commercial service facilities such as blueprint, duplicating and photocopy shops, Restaurants and day care facilities may be allowed by conditional use permit.
