RECOMMENDED ACTION: If Council concurs, introduce Ordinance No. ID D/73 amending Title 5, Section 5.04, Section 5.04.020 to allow business licenses to be effective for one year from date of issue. ITEM EXPLANATION The amendment of the Business License Code is the first of many aimed at up-dating our license practices. The City presently issues business licenses on a calendar year basis. All licenses come due on January 1st each year and must be renewed by February 9 each year to avoid penalties. This causes a substantial work load for the license clerk from November when renewal notices go out, to March when license activity begins to wind down. Allowing year- round licensing will allow us to begin to spread this workload out throughout the year. Another important factor of year round licensing is that it addresses one of the most frequent complaints from businesses. This complaint is that businesses licensed near the end of the calendar year must obtain a license for the current calendar year and then, in three months or less, obtain a license for the new calendar year, thereby paying the basic license fee twice within a very short period of time. This is particularly hard on contractors who start a small job near the end of one calendar year. FISCAL IMPACT The change from calendar year to year round licensing will have little impact on total license revenue. The City will experience some lost revenue due to the elimination of the short period licenses (i.e. those issued late in the calendar year, when a new license is required again as of January 1.) However, this loss will not be substantial and should be offset to some extent by the larger license fees collected for full year licenses from these companies licensed on gross receipts. The major benefit will be in the eventual reduction of the year end license effort which removes staff from other issues such as the collection of parking c itations. The City Council of the City of Carlsbad, California does hereby ordain as follows: SECTION 1: That Title 5, Chapter 5.04 of the Carlsbad Municipal Code is amended by the amendment of Section 5.04.020 to replace the second sentence which reads: "The license tax shall be due and payable before the commencement of any new business and deliquent on and after the thirty-first day after commencement of a new business; and in advance, annually, on Janury 1st and delinquent on and after the tenth day of February of each year for all previously established businesses." with the following sentences: "The license tax shall be due and payable before the commencement of any new business and deliquent on and after the thirty-first day after commencement of a new business. For all previously licensed businesses the license tax shall be due and payable annually in advance on the first day of the month in which the business was originally established and deliquent on the tenth day of the following month." SECTION 2: This ordinance being an ordinance relating to taxes for usual and current expenses of the City, pursuant to Section 36937(d) of the Government Code, shall take effect immediately upon its passage. Before the expiration of fifteen days after its passage, this ordinance shall be published once in the Carlsbad Journal, a newspaper of general circulation printed and published in the City of Carlsbad.
