CITY ATTYPk!& RECOMMENDED ACTION: Adopt Resolution No. 7372 approving plans and specifications, and authorizing the City Clerk to advertise for bids for the Hoernlein Storm Drain. Adopt Resolution No. 7379 authorizing the expenditure of funds for the City's share -of the project. ITEM EXPLANATION Per Council action, dated September 6, 1983, approving the settlement agreement in the case of Hoernlein v. City of Carlsbad, the Engineering Department has had plans and specifications prepared to construct the Strom Drain. The work will fulfill the agreement of the City to construct a storm drain and fill the "gully" on the Hoernlein property. FISCAL IMPACT The Engineer's Estimate for completion of this work was a sum not to exceed $18,000 with the design and other engineering work to be done "in house.'' The settlement agreement of $28,000 including costs and attorneys fees ($10,000) with no City contribution was based on that estimate. After completion of the design plans and specifications the Engineer now estimates the costs as follows: Engineering Consultant Soils Testing and Inspection Staff Engineering Construction (Attorney's Fees) TOTAL $ 3,700 1,000 400 28,000 33,100 10,000 $43,100 Under the settlement agreement the City's former insurance carriers will submit payment as follows: Global Surplus $ 7,000 Jefferson 7,000 Allianz (50% of cost of construction and attorney's fees) TOTAL 19,000 $33,550 The City's share under the new estimate will be $9,550. It is necessary for the Council to approve the expenditure of that amount from the liability self insurance reserve. The City Attorney advises that Allianz's willingness to waive their $10,000 deductible on this case and agree to pay 50% of the costs was based on the first Engineer's estimate. The increase in their share from $14,000 to $19,000 may cause problems which could increase the cost to the City for the project. Agenda Bill #7485-1 Page 2 10/18/83 EXHIBITS 1. Vicinity Map 2. CARLSBAD, CALIFORNIA, APPROVING PLANS AND SPECI- WHEREAS, the City Council of the City of Carlsbad, California, has determined it is necessary and in the public interest to construct the Hoernlein Storm Drain; and WHEREAS, plans and specifications for the furnishing of all labor, material, tools, equipment, transportation, and other expenses necessary or incidental for said Project No. 3157 have been prepared and are on file in the Engineering Department of the City of Carlsbad and are incorporated by reference herein. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. The above recitations are true and correct. 2. Plans and specifications as presented are hereby approved. 3. The City Clerk of the City of Carlsbad is hereby authorized and directed to proceed to publish, in accordance with law, notice to Contractors inviting bids for the construction of the Hoernlein Storm Drain in accordance with the plans and specifications hereinabove referred to. WHEREAS, the City Council of the City of Carlsbad has previously approved the settlement agreement in the case of Hoernleiin v. City of Carlsbad; and WHEREAS, the Engineer's current estimate for completion of this work exceeds that estimate which was previously approved; and WHEREAS, in order to comply with that agreement a fund transfer is necessary: and WHEREAS, there are sufficient funds available in the liability self insurance reserve NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. The City Manager is hereby authorized to spend $9,550 for said project. 2. That fund transfer No. 024 on file with the Finance Director, is hereby approved to finance this project.
