RECOMMENDED ACTION:
If the City Council wishes to approve the Tentative Tract Map
CT 77-8(B) and Condominium Permit CP-45(^then your recommended
action is to approve Resolution No. 73 7 7 .
ITEM EXPLANATION
The City Council at your meeting of October 11, 1983 directed the
City Attorney to prepare the necessary document approving an
amendment to a 60 unit Tentative Tract Map CT 77-8(B) and
Condominium Permit CP-45#V\ That resolution is attached.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING AN AMENDMENT TO
A TENTATIVE TRACT MAP (CT 77-8) AND CONDOMINIUM
PERMIT (CP-45fl TO ALLOW PHASING OF A 60 UNIT
CONDOMINIUM ON PROPERTY GENERALLY LOCATED ON THE
EAST SIDE OF EL CAMINO REAL IMMEDIATELY NORTH OF
DOVE LANE.

WHEREAS, on September 14, 1983, the Carlsbad Planning
Commission adopted Resolution No. 2171 recommending to the City
Council that an amendment to Tentative Tract Map (CT 77-8(B)) and
Condominium Permit (CP-45/^be approved; and
WHEREAS, the City Council of the City of Carlsbad, on
October 11, 1983, held a public hearing to consider the
recommendations and heard all persons interested in or opposed to
the amendment to Tentative Tract Map (CT 77-8(B)) and Condominium
Permit (CP-45&; and
WHEREAS, said Tentative Tract Map and Condominium
Permit have been declared exempt from environmental review per
Section 19.04.070 of the Carlsbad Environmental Ordinance;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California as follows:
A. That the above recitations are true and correct.
B. That the findings of the Planning Commission in
Resolution No. 2171 constitute the findings of the City Council
in this matter.

C. That said Tentative Tract Map, together with the
provisions for its design and improvement and subject to the
conditions of this resolution, is consistent with all applicable
general and specific plans of the City of Carlsbad.
D. That Tentative Tract Map CT 77-8(B) and Condominium
Permit CP-45Aare hereby approved subject to all applicable
requirements of the Carlsbad Municipal Code and to the
satisfaction of the conditions contained in Planning Commission
Resolution No. 2171, dated September 14, 1983 marked Exhibit A,
attached hereto and made a part hereof.
PASSED, APPROVED, AND ADOPTED at a regular meeting of
the City Council of the City of Carlsbad, California on the
18th day of October , 1983 by the following vote,
to wit:
AYES: Council Members Casler, Lewis, Kulchin, Chick and Prescott

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING AN
AMENDMENT TO A TENTATIVE TRACT MAP TO ALLOW
PHASING OF A 60-UNIT CONDOMINIUM ON
PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF
EL CAMINO REAL IMMEDIATELY NORTH OF DOVE LANE.

EXHIBIT A
Resolution "No. 7377
WHEREAS, a verified application for certain property, to
wit:
A Portion of the west half of the northeast quarter of
Section 26, Township 12 south, Range 4 west, San
Bernardino Meridian, in the County of San Diego, State of
California,
has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request
as provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 14 day of
September, 1983, hold a duly noticed public hearing as prescribed
by law, to consider said request; and
WHEREAS, at said public hearing, upon hearing and
considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors
relating to the Tentative Tract Map and Condominium Permit; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
(A) That the foregoing recitations are true and correct.
1 (B) That based on the evidence presented at the public hearing,
the Commission hereby APPROVES CT-77-8(B)/CP-45^ based on the
2 following findings and subject to the following conditions:
3 Findings;
.4 1) That the phasing of this project is consistent with the
General Plan since the entire project, as well as Phase I
5 is within the density range specified for the site.
6 2) That all required parking, recreation area, and other
development standards required for Phase I by the planned
7 development ordinance will be constructed in this phase.
8 3) That the Land Use Planning Manager has determined this
project to be categorically exempt from environmental"
9 review per Section 19.04.070 of . the Carlsbad
Environmental Ordinance.

Conditions:

1) Approval is granted for CT 77-8(B)/CP-45flas shown on
12 Exhibits "A" and "B" dated August 19, 1983, incorporated
by reference and on file in the Land Use Planning Office.
13 Phasing shall occur as shown on these exhibits.
14 2) All conditions of approval for CT 77-8(A)/CP-45^are
incorporated herein by reference and shall be complied
15| within their entirety unless otherwise noted herein.
16 PASSED, APPROVED AND ADOPTED at a regular meeting of the
Planning Commission of the City of Carlsbad, California, held on
the 14 day of September, 1983, by the following vote, to wit:
18 AYES: Chairman Schlehuber, Commissioners Rombotis,
Marcus, Lyttleton, Farrow, Friestedt and Rawlins,
19 NOES: None.
