RECOMMENDED ACTION: If the City Council concurs your action is to adopt Resolution No* 737.3 ITEM EXPLANATION The City Council at your meeting of October 11, 1983 directed 1 City Attorney to prepare documents approving the above referenc development. In taking that action, the City Council indicate( was your intention to modify the project as recommended by the Planning Commission in two respects. First, the City Council approved a reduction in the front yard setback to 15 feet for number of the lots. Second, the Council approved the City Engineer's recommended interim improvements to the streets in area. The necessary findings and conditions to implement thes actions have been included in the City Council resolution, Th Council should satisfy itself that we have correctly incorpora your intentions in the matter. The Assistant City Manager/Developmental Services has recommen changes to a number of the previously recommended conditions a addition of some new conditions. In order to implement the in improvements, he has also recommended that the City immediate1 undertake the following actions: 1. That the extension of Olivenhain Road directly to the s of Olivenhain Water District shall be designated as a c way road. 2. The curved section of Rancho Santa Fe Road on the north corner of the Olivenhain Water District shall be barric and closed to traffic and the existing T-intersection K shall be used, City Council approval of this development will also include direction to staff to implement these two recommendations. FISCAL IMPACT Some minor cost for traffic signing to. be borne by the City. 680 is installed the costs of closing A Street and resignaliz will be recouped by the City by selling the lot to be gained the closed portion of A Street. APPLICANT: DAON CORPORATION CASE NO: CT 83-16/LCDP 83-1 - (LCDP 83-1) FOR A 171 LOT SUBDIVISION ON WHEREAS, on August 24, 1983 the Carlsbad Planning Commission adopted Resolution No. 2169 recommending to the Council that Tentative Tract Map (CT 83-16) and La Costa Development Permit (LCDP 83-1) be approved; and WHEREAS, the City Council of the City of Carlsbad, September 20, 1983 and October 11, 1983, held public hearin consider the recommendations and heard all persons interest or opposed to Tentative Tract Map (CT 83-16) and La Costa Development Permit (LCDP 83-1 ) ; and WHEREAS, said Tentative Tract Map and Condominium Permit have been declared to have a nonsignificant impact ( environment and a Negative Declaration was prepared and fi: August 15, 1983 in compliance with the requirements of the of Carlsbad Environmental Protection Ordinance of 1980 and California Environmental Quality Act: NOW, THEREFORE, BE IT RESOLVED by the City Counci: the City of Carlsbad, California as follows: A. That said Tentative Tract Map, together with th provisions for its design and improvement and subject to the conditions of this resolution, is consistent with all applic general and specific plans of the City of Carlsbad. D, That Tentative Tract Hap CT 83-16 and La Costa Development Permit LCDP 83-1 are hereby approved subject to applicable requirements of the Carlsbad Municipal Code and t satisfaction of the conditions contained in Planning Commisr Resolution No. 2169, dated August 24, 1983 marked Exhibit A, attached hereto and made a part hereof except the following conditions: 1. Condition 89 of Planning Commission Resolution 2169 is amended by the addition of the following: "Slopes owned in fee by the City adjacent to "A" Si from "F" Street to Rancho Santa Fe Road shall be satisfaction of the Land Use Planning Manager and Parks and Recreation Director.
