RECOMMENDED ACTION:
Both the Land Use Planning staff and Planning Cmission reccimnend that this
application be APPROVED and that the City Council introduce Ordinance
No. 9700
ITEM EXPLANATION
This is an amendment to the Zoning Ordinance regulating price signing for
automobile service stations. identification signs allowed by the sign ordinance. to meet the following criteria:
These signs would be in addition to the normal Any price signs would have

each street would be permitted, however, a station located adjacent to a freeway on .or off ramp would be permitted only one sign on the street frontage.
The Planning Commission believes this ordinance will encourage mre attractive
signing for service stations.
All station Owners have been contacted and sent copies of the proposed
ordinance. Also, all service stations in the City are in mpliance with the ordinance at the
present time.
No Owners have indicated any opposition to the ordinance.
The Land Use Planning Manaqer has determined that this project will not cause
any significant environmental impacts d, therefore, has issued a Negative
Declaration, dated July 18, 1983, which was approved by the Planning
Commission on August 10, 1983.
FISCAL IMPACT
No fiscal impacts are anticipated by the approval of this project.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AMENDING TITLE 21, CHAPTER 21.41 OF THE
CARLSBAD MUNICIPAL CODE BY THE ADDITION OF SECTION
21.41.074 TO REGULATE PRICE SIGNS FOR AUTOMOBILE SERVICE
STATIONS.
The City Council of the City of Carlsbad, California does
brdain as follows:
SECTION 1: That Title 21, Chapter 21.41 of the Carlsbad
iunicipal Code is amended by the addition of Section 21.41.074 to
-cad as follows:
21.41.074 Service Station Price Signs.
(a) In addition to signs permitted by this chapter, service
itations shall have one sign advertising the price of gasoline or
bther motor fuel sold on the premises which meets the following tequirements:
(1) The sign shall display only the minimum information
.equired by Chapter 8.49 of this code and by Article 12 of Chapter
4 of Division 5 of the State Business and Professions Code iommencing with Section 13530.
(2) The price sign shall either be a monument type sign ox be attached to an existing pole sign located on the property. The iign may be double faced and the maximum area for each sign shall lot exceed 12 square feet if attached to an existing pole sign or 1t iquare feet for a monument sign measured at the outermost boundary

(b) If a service station is located at the intersection of twc itreets, excluding freeway on or off ramps, such a station may have ,ne price sign, not to exceed the maximum size, stated above, on

EFFECTIVE DATE: This ordinance shall be effective thirty
lays after its adoption, and the City Clerk shall certify to the

CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A ZONE CODE
AMENDMENT, AMENDING TITLE 21, CHAPTER 21.41, OF THE
CARLSBAD NUNICIPAL CODE, BY THE ADDITION OF SUBSECTION
2 1 .4 1 -07 4 TO ADD REQUIXEMENTS REGARDING SERVICE STATION
PRICE SIGNS.

WHEREAS, the Planning Commisson did, on the 10th day of .>
ugust, 1983 and on the 28th day of September, 1983, hold a duly
oticed public hearing as prescribed by law to consider said
equest; and
WHEREAS, at said public hearing, upon hearing and
onsidering all testimony and arguments, if any, of all persons
esiring to be heard, said Commission considered all factors
elating to the Zone Code Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
omission as follows:

I . RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Negative Declaration and ADOPT Resolution No. 2160 recommending APPROVAL Of ZCA-167.
11. DISCUSSION
This item was continued from the Planning Commission meeting of August 10, 1983 to allow additional time to receive input from affected service station owners. Since that time, Staff has sent letters to each service station owner in the city with a copy of the proposed ordinance requesting input on the proposed
regulations. Staff has received no responses from any of the
owners and Staff bel.ie.ves tlit?re.are no major objectians to the ordinance as prcposed. Staff is, thereforc, recommending approval of ZCA-167.

RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Negative Declaration issued by the Land Use Planning Manager and
ADOPT Resolution No. 2160 recommending APPROVAL of ZCA-167 based one findings contained therein.
11. PROJECT DESCRIPTION
Several months ago staff began to implement a City-wide sign
abatement program. It was decided to first enforce non- conforming signs at service stations due to a large number of complaints regarding price signs at these locations. Service
stations are required by the State to display the prices of the gas they sell; however, the Zoning Ordinance has no provision for the type of frEestanding sign normally used. Consequently,
there are no guidelines for station owners to follow when displaying their prices.
To resolve this issue, staff has proposed the regulations
stated below. All. station owners were contacted earlier and the
majority of stations comply with "these proposals.. There are a few temporary, free-standing signs that will eventually have to
be brought into coriformance.
111. ANALY S I S -
Staff proposes the following additions to the Sign Ordinance to
regulate price signs for service stations:

SERVICE STATION PRICE SIGNS
In addition to signs permitted for service stations as stated in this Ordinance, service. stations may also have a "price" sign provided it meets the followi.ng requirements:

The maximum area for each sign shall not. exceed 12 square feet if attached to an existing pole sign or 16 square feet for a

(3) Each service station may have one "price" sign
unless the station is located at the intersection of two streets
(excluding freeway right-of-ways). Such a station may have one price sign, not to exceed the maximum size, stated above, on each street frontage. Stations located adjacent to a freeway on/off
ramp shall be permitted only one sign on the street frontage.
With these changes, staff believes station owners will have
definite guidelines to follow and will be treated equitably by the City. The area allowed for price signs will be over and above the square footage permitted other commercial
establishments. Staff hopes this will encourage attractive
monument price signs rather than the temporary ones commonly
seen.
IV. ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project
will not have a significant impact on the environment and,
therefore, has issued a Negative Declaration on 3uly 18, 1983
which was approved by the Plaririing Commission on August lC, 1983.
