ITEM EXPLANATION approving the Engineer's Report, and The improvements for the Monroe Street Assessment District, Contract No. 0519-1, have been completed and are acceptable to the Maintenance Department. Pursuant to the provisions of Chapter 21 of the "Improvement Act of 1911", these procedures need to be initiated by the City. The approval of the Engineer's Report and authorizing a public hearing are necessary steps toward assessing the property owner for the costs of the improvements and assessment proceedings. The public hearing will be held December 6 FISCAL IMPACT The costs associated with this Assessment District are as follows: Construction Assessment Legal Staff Time TOTAL Fees $9,720 $ 500 $2,938 $13,158 Reimbursement of these costs incurred by the City will come from the property owner, per Resolution No. 7183, adopted April 19, 1983, ordering the installation of the improvements. EXHIBIT / AGENCY: CITY OF CARLSBAD PROJECT: ASSESSMENT DISTRICT NO. 83-1 (MONROE STREET) TO: CITY COUNCIL CITY OF CARLSBAD ENGINEER'S "REPORT" PURSUANT TO THE PROVISIONS OF CHAPTER 27 OF THE "IMPROVEMENT ACT OF 1911", AND SPECIFICALLY SECTION 5882 THEREOF The CITY COUNCIL of the CITY OF CARLSBAD, STATE OF CALIFORNIA, has initiated proceedings pursuant to the provisions of Chapter 27 of the "Improvement Act of 1911", commencing with Section 5870 of the Streets and Highways Code of the State of California, for the installation and construction of certain works of improvement, together with appurtenances, in a special assessment district, said assessmentdistrict known and designated as ASSESSMENT DISTRICT NO. 83-1(MONROE STREET) (hereinafter referred to as the "Assessment District"). WHEREAS, the property owners were noticed in the manner and form as authorized by law, and a public hearing was held and the property owners did not commence the construction within the sixty (60) days period, as authorized and required by law; and, WHEREAS, the City did then authorize the construction and installation of the works of improvement, and upon completion of the construction, the designated Superinten- dent of Streets has prepared the necessary "Report" setting forth the final costs of construction and installation, including incidental expenses, and a description of all property benefited from the works of improvement and to be assessed therefor. I, the appointed SUPERINTENDENT OF STREETS, submit herewith the following "Report" for approval and final confirmation, and do hereby set forth the total costs and expenses of the improvements and assess said costs against the parcels within the boundaries of the Assessment District in direct proportion to the bene fits received. The costs to be assessed are set forth as follows: I. CONSTRUCTION $ 9,720.00 QUANTITIES: 400 Lineal Feet of Curb & Gutter $ 3,400.00 2000 Square Feet of Sidewalk $ 5,000.00 600 Square Feet of Paving and Base $ 1,200.00 5 Lineal Feet of Curb & Gutter Replacement $ 45.00 25 Square Feet of Sidewalk Replacement $ 75.00 II. INCIDENTAL EXPENSES $ 3,438.00 III. TOTAL CONSTRUCTION AND INCIDENTAL EXPENSES $ 13,158.00 IV. CONTRIBUTION $ -0- V. SUPERTNTENDENTIF STREETS ' / CITY OF CARLSBAD I/ STATE OF CALIFORNIA MONROE STREET ASSESSMENT DISTRICT Legal Description Those portions of Tracts 254 and 255, in the City of Carlsbad, County of San Diego, State of California, according to Map No. 1681, filed in the Office of the County Recorder of San Diego County, on December 9, 1915. Said property being more particularly described: Commencing at the most northerly corner of Map No. 4165, filed in the Office of the County Recorder of San Diego County on May 5, 1959, File No. 90086, said corner also being the TRUE POINT OF BEGINNING. Thence N 23C33'00" W a distance of 400.66 feet. Thence S 61'19'32" W a distance of 751.86 feet to the easterly right-of-way line of Monroe Street. Thence S 28°36'53" E along said easterly right-of-way line to the northerly boundary of said Map No. 4165. Thence along said northerly boundary N 61°22'14" E a distance of 717.55 feet to the TRUE POINT OF BEGINNING. 1 RESOLUTION NO. 7405 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING REPORT AND 3 AUTHORIZING A PUBLIC HEARING FOR MONROE STREET ASSESSMENT DISTRICT. 4 5 6 8 WHEREAS, the City Council of the City of Carlsbad, California, has instituted proceedings pursuant to the provisions of Chapter 27 of the "Improvement Act of 1911", being Division 7 of the Streets and Highways Code of the State of California, for the construction of certain authorized improvements in a special assessment district known and designated as ASSESSMENT DISTRICT NO. 83-1 12 (MONROE STREET) 13 (hereinafter referred to as the "Assessment District"); and WHEREAS, construction of the improvements has been completed by the City and at this time the City Council desires to authorize the Notice of Filing Assessment and Time of Public Hearing to be given to each property owner within the above-referenced 18 Assessment District. 19 NOW, THEREFORE, BE IT RESOLVED by the City Council of the 20 City of Carlsbad as follows: 21 SECTION 1. That the above recitals are true and correct. 22 SECTION 2, That the Public Hearing will be held on 23 December 6, 1983, at 6 :00 P.M. in the Council Chambers, 1200 Elm Avenue, Carlsbad. SECTION 3. That the construction of the authorized 2<> improvements has been completed and the "Report" of the Superintendent of Streets of the cost of the construction has been 28 /// 1 submitted and is herein approved. The Superintendent of Streets 2 is further authorized to notify the property owners within the 3 Assessment District of the filing of the assessment and time of 4 public hearing, said assessment to show the amount to be paid to 5 the Contractor for the work and improvements contract for and 6 performed, together with all incidental expenses, and showing the 7 amount of each assessment against each lot or parcel of land 8 asssessed to pay the same. 9 SECTION 4.
