ITEM EXPLANATION: TITLE: DESIGNATION OF EMERGENCY SERVICE WORKERS The City of Carlsbad employs a number of volunteers who work without compensation as Reserve Police Officers. Under the provisions of Chapter 10, Division 4, Part 1 of the Labor Code, these Reserve Police Officers are considered to be Disaster Service Workers. Having been declared and regis- tered as Disaster Service Workers, any injuries which result from their employment as Reserve Police Officers can be compensated for workers’ compensation purposes by the State Compensation Insurance Fund as opposed to the city absorbing the cost as a self-insured entity. FISCAL IMPACT: The fiscal impact of implementing this is unpredictable at this time and is dependent upon the number of work related injuries incurred by Reserve Police Officers. EXHIBITS : Resolution No. 7yordesignating Reserve Police Officers as Disaster Service Workers for purposes of workers’ compensa- tion insurance. 1 2 3 4 5 6 7 0 9 10 11 12 13 14 15 16 17 18 19 -2 0 21 22 23 24 25 26 27 20 RESOLUTION NO. 7408 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DESIGNATING RESERVE POLICE OFFICERS AS DISASTER SERVICE WORKERS FOR PURPOSES OF WORKERS' COMPENSATION INSURANCE. WHEREAS, Section 8580 of the Government Code provides "The Emergency Council shall establish by rules and regulations various classes of Disaster Service Workers and.the scope of the duties of each class. regulations prescribing the manner in which Disaster Service The Emergency Council shall also adopt rules and Workers of each class are to be registered. All such rules.and regulations shall be designed to facilitate the paying of workers' compensation." And, WHEREAS, the California Emergency Council has adopted rules and regulations establishing classes of Disaster Service Workers, scope of duties of each class, and the manner of registration of such volunteers as Disaster Service Workers; and WHEREAS, Section 8612 of the Government Code provides "Any disaster council which both agrees to follow the rules and regula- tions established by the California Emergency Council pursuant to the provisions of Section 8580 and substantially complies with such rules and regulations shall be certified by the Emergency Council. Upon such certification and not before, the disaster council becomes an accredited disaster council." And, 'WHEREAS, the City of Carlsbad is the signatory to the Second Amended Emergency Services Agreement of San Diego County, dated December 7, 1979, and thereby is an accredited disaster council which enables injured Disaster Service Workers registered by the city to benefit from the provisions of Chapter 10, Division, 4, J 1 2 3 4 5 6 7 a 9 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Part 1 of the Labor Code; and WHEREAS, under these authorities the City Council does hereby designate Reserve Police Officers as Disaster Service workers for purposes providing for workers' compensation insurance. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. The Reserve Police Officers of the City of Carlsbad are hereby designated as Disaster Service Workers who will be registered with the city and benefit from the provisions of Chapter 10, Division 4, Part 1 of the Labor Code.
