SUBJECT: CT 81-5(A)/CT 81-6(A) - JEWETT - An amendment to two commercial tentative tract maps to modify street improvement conditions located on the northeast and southeast corners of Poinsettia Lane and Avenida - Encinas .
I. RECOMMENDATION
It is recommended that the Planning Commission
ADOPT Resolutions No. 2179 and 2180 APPROVING CT 81-5(A) and
CT 81-6(A), based on the findings contained therein,
11. DISCUSSION
This item is a request to modify two existing commercial tentative maps located as described above. would be the deletion of conditions relating to secondary access to the property (Condition No, 25 of Resolution 2033, and
Condition 33 of Resolution 2035). These conditions presently
require that the applicant provide a secondary access to his
properties at the time traffic counts reach 5000 ADT at the
intersection of Avenida Encinas and Poinsettia Lane (please see attached Exhibit "X").
The applicant believes that these conditions place an unnecessary
hardship on the development of his property. He contends that
the connection of Poinsettia Lane to Carlsbad Boulevard will
provide adequate access to his property and also will provide relief to any future congestion at the intersection of 1-5 and Poinsettia Lane. This connection is scheduled for completion in
June, 1984.
The City Engineer has reviewed this request in light of existing Engineering Department policies and in light of the applicant's unique situation. The City Engineer has determined that the
applicant's request is warranted and is recommending that the
Planning Commission delete the two subject conditions,
Since development is imminent on the properties south of Mr.
Jewett's southern parcel, however, the City Engineer believes
that Mr. Jewett should participate in any assessment district
that may be formed for t.he improvement of Avenida Encinas to Carlsbad Blvd. When thi,s street is constructed, Mr. Jewett's
property would derive some benefit. A condition of approval has
been added to CT 81-6(A) ensuring that Mr. Jewett will not
oppose an assessment district or other joint financing for the construction of Avenida Encinas, south of his property. This condition is spelled out. in the City Engineer's memo dated
September 1, 1983 and has been added to the attached resolution,

recommending approval of CT 81-5(A) and CT 81-6(A).

REPLACEMENT OF CONDITIONS OF APPROVAL ON PLANNING COMMISSION
RESOLUTION NOS: 2033 and 2035 - -
After discussions between the property owner and City staff concerning the application of Condition 25 in Resolution 2033, and Condition 33 in Resolution 2035, it was determined that the construction of
secondary access being dependent upon existing traffic counts of 5,000 ADT at Avenida Encinas and Poinsettia Lane was impractical.
In view of imminent development of properties south of the applicant's
property, it is more than appropriate that access along Avenida Encinas south and west across the Santa Fe tracks should be developed
jointly. Therefore, the conditions mentioned above should be replaced with the following:

"Prior to final map approval, the applicant shall enter into
an agreement satisfactory to the City Council by which
applicant covenants not to oppose an assessment district or
other joint financing for the construction of Avenida Encinas
from the southern subdivision boundary to Carlsbad Boulevard."

(Smith-Jewett Property)
Dear Ms. Rautenkranz :
Sammis Properties Company is the owner of Batiquitos Point proper
and Seabluff property located on the east side of Carlsbad Boulev
south of the present termination of Avenida Encinas and north of
the Batiquitos Lagoon.
The Smith-Jewett interest owns commercial property adjacent to
Poinsettia Lane, which property is the subject of this appeal. Smith-Jewett has been processing a subdivision map. Sammis Prope
Company has appealed one of the items of that subdivision map; na the consideration as to whether Smith-Jewett should be required t participate in certain road and bridge costs.
A public hearing before the City Council has been scheduled for November 15 to hear this appeal. Both Sammis Properties Company
and Smith-Jewett are interested in continuing this hearing for a
period of time that will allow us to accomplish the following:
BACKGROUND INFORMAT I ON
Sammis Properties and Smith-Jewett have drawn up an agreement,
which defines the way in which the parties will share in the cost of road and bridge improvements and the installation of a siltati
basin. The parties need approximately 30-60 days to finalize the
agreement.
REQUEST FOR CONTINUATION
Sammis Properties Company has agreed to bear all of the costs
of the proposed bridge improvements, if the portion of Avenida Encinas that crosses the Sammis development known as Seabluff and
Batiquitos Point can be established as a private road, or establi
in such a way that those two residential projects can have a priv
gated entrance.

POSITION OF THE CITY
We believe that the present position of the City of Carlsbad
concerning a private, gated community for Avenida Encinas is
as follows:
1. The City staff has indicated support for the private, gated
entrance concept.
2, The Circulation Committee has today indicated that Avenida Encinas should be a secondary arterial, which precludes the opportunity for a gated community.
3, Final considerations cannot be established until a computeriz traffic study analysis for the entire area, which is currently
being prepared by SANDAG, is completed.
INTER-RELATIONSHIP OF SMITH-JEWETT APPEAL AND PRIVATE, GATED ROAD
Smith-Jewett and Sammis Properties would like to see the private,
gated road established and approved because it more closely follo
the private agreement being established between those two parties We would, therefore, prefer to have the subdivision map appeal
continued until such time as the City of Carlsbad can reach a decision concerning the private road--if that can be done in a
timely manner.
ADVANTAGES OF TEE PRIVATE, GATED ROAD
The private gated community greatly enhances the future developme of some 950 residential units because:
1. It permits a human-scale approach to the relationship pattern
necessitating the use of pedestrian-oriented walkways and a bike community,
2. It is much safer in that the speed limit on a private road
is much better respected by the residents and methods can be
employed to slow traffic down.
3. It is greatly desired as well by the adjacent property reside
the Cardiff Shore Gardens Mobil Home Park,
4. Services such as police, fire and trash pickup are no problem
because of a bypass road to be created around the gates.
5, A gated community adds prestige to the project and is appreci
by the residents.

6. The incidence of burglary and vandalism is greatly reduced ani thus is an assistance to the Carlsbad Police Department.
TRAFFIC STUDY
The only reason that has been expressed not to make Avenida
Encinas a gated road is if the traffic coming off Poinsettia Lane (primarily from Interstate 5) that is going to go south on Carlsb
Boulevard or the traffic that is coming north on Carlsbad Bouleva that seeks to go to Interstate 5 or Poinsettia Lane, cannot be
handled by the intersection of Poinsettia Lane and Carlsbad Boule
But the answer to this question appears to rest with the completi
of the SANDAG traffic study.

REQUEST
In consideration of the foregoing, both Smith-Jewett and Sammis
Properties request that a continuance, or series of continuances
be granted to give enough time to properly evaluate the private r
concept for Avenida Encinas. We would appreciate it very much, i
you would make our request of the Mayor and the City Council. We would be glad to live with whatever continuance increments you suggest, On the other hand, if the Council desires for the heari to be held on November 15, we will be glad to appear at that time
