HD.JS^JL CITY ATTY\lOlL ,CITY MGR,<2J?_[ l)V O -j u OO RECOMMENDED ACTION: The Planning Coimiission and the staff are recommending that the City Council direct the City Attorney's Office to prepare documents DENYING GPA/LU 83-13, ZC- 287, MP-2(A), SP-23(D) and SDP 83-8. ITEM EXPLANATION This item is an appeal of a Planning Commission decision denying a request to change the land use element of the general plan from Residential Medium Density (RM 4-10 du/ac) to Residential Medium High Density (RH 10-20 du/ac) on property located on the west side of Paseo del Norte just north of Camino Del Parque. The applicant has also requested a zone change from Planned Community (PC) to RDM-Q, deletion of existing master and specific plans and approval of a site development plan for 150 apartment units. The Planning Commission denied the requests based on the fact that the proposed density is incompatible with existing development. The project is proposed for 18.75 dwelling, the overall density of the existing Alta Mira development is 10 du/ac. The area of Alta Mira directly adjacent to the proposed project is at 6.5 du/ac. All other residential land use in the vicinity is shown as RM (4-10 du/ac). The Planning Commission and the staff felt that the subject property could be developed for residential use at a density compatible with Alta Mira or as a medical office or a very low intensity commercial center (beauty shop, dry cleaners, etc.). Staff has received 245 letters regarding this project. There were 243 in opposition and 2 in favor. For further information please see the attached staff report to the Planning Commission. ENVIRONMENTAL REVIEW The Land Use Planning Manager has determined that this project will not cause any significant environmental impacts, and therefore, has issued a Negative Declaration, dated October 5, 1983, which was approved by the Planning Commission on October 12, 1983. I. RECOMMENDATION It is recommended that the Planning Commission APPROVE THE Negative Declaration issued by the Land Use Planning Manager and ADOPT Resolution Nos. 2201, 2202, 2203, 2204 and 2205 DENYING GPA/LU 83-13/ZC-287/SP-23(D)/SDP 83-8, based on the findings contained therein. II.PROJECT DESCRIPTION AND BACKGROUND The applicant is requesting approval of five related actions on eight acres, located as described above. Included, are requests to amend the General Plan, to change the land use designation for the subject property from Neighborhood Commercial (N) to Residential Medium-High (RMH, 0-4 du/ac) and delete Master Plan, MP-2 and Specific Plan, SP-23. Also requested is a Zone Change to RD-M-Q, Residential Density Multiple with a Qualified Overlay, zone and approval of a Site Development Plan for 150 apartment units. The project site is graded into two pad areas, divided by a steep 15 foot slope. The northern pad area is bordered to the north by a drainage course and is elevated approximately five feet above Paseo Del Norte. The corner lot to the south is on grade with Camino Del Parque and neighboring duplexes. It is elevated approximately ten feet above Paseo Del Norte. The City Council, in December 1971, approved a Zone Change to P- C, Planned Community, and an accompanying Master Plan, MP-2, for 112 acres encompassing the proposed Alta Mira development. The Master Plan provided for residential development of not more than 1,120 units, for a resulting density not to exceed 10 du's/ac. The master plan also set aside the subject property for Neighborhood Commercial use. In March, 1972, the City Council adopted Specific Plan, SP-23, providing for development of the western 50 acres of the master plan area. The specific plan permits 326 residential units on the 50 acres, and designated the subject property for Neighborhood Commercial use. The 326 units, adjoining the subject property, were constructed as duplexes at a density of 6.5 du's/ac. In July of this year 288 condominium units were approved on the 35.4 acre Seagate property, across Paseo Del Norte to the east of the subject property. The resulting density is 8 du's/ac. The duplex portion of Alta Mira adjoins the subject property to the south at a density of 6.5 du's/ac. A major drainage course border's the site to the north and Interstate 5 borders the property to the west. The proposed Site Development Plan would provide for 150 apartment units on the two parcels. The northwest and lowest of the two lots would be devloped with 48 one-bedroom and 16 two- bedroom apartments, at a density of 19.4 du's/ac. Access would be drived from one driveway on Paseo Del Norte. The southeastern corner parcel is proposed for 8 one-bedroom and 78 two-bedroom apartments, for a density of 18.3 du's/ac. Access would be taken from both Paseo Del Norte and Camino Del Parque. The proposed project would result in an overall density of 18.75 du's/ac. III. ANALYSIS Planning Issues 1) Is the proposed land use appropriate for the site? 2) Is the proposed land use compatible with surrounding land uses? Discussion Staff does not believe that the proposed RMH land use designation is appropriate for the site. Of primary concern is the issue of land use compatibility. The requested RMH classification would establish a permitted density range of 10 to 20 du's/ac. The applicant is proposing apartment development at 18.75 du/ac. Staff does not believe that the RMH designation, with it's permitted land uses, would be compatible with existing and approved neighboring developments. Almost everything in the near vicinity is approved at 6 to 10 du/ac. The west portion of the site, fronting on Camino Del Parque, is on-grade with the existing Alta Mira duplex units. This area of the site, therefore, topographically identifies to the units across Camino Del Parque and adjoining to the south. Staff does not believe that multiple-family development as permitted by the -2- RMH land use designation, would be compatible with adjoining units. Due to the lack of topographical distinction between the site and the existing Alta Mira project, the ability to buffer is limited and impacts may be more appreciable. Staff, therefore, believes that development at the proposed density range could be disruptive to the neighborhood and adversely impact adjoininq properties. Staff feels that density should be in the same range as these adjoining properties. Staff does not believe that the proposed land use designation is compatible with approved developments in the area. All residential property along Paseo Del Norte, south of the drainage course, is designated Residential-Medium density, 4-10 du's/ac by the Land Use Element of the General Plan. Approved developments in the area include Seagate at 8 du's/ac; Standard Pacific, 7 du's/ac; Pacesetter, 9.4 du's/ac; Sea Cliff (Covington), 4.9 du's/ac and Alta Mira at an overall density of 10 du's/ac, (see attachment). Staff is not necessarily adverse to residential development on the subject property. Consideration, however, should be given to impacts on the site from the freeway and nearby sewer plant. Staff does believe, however, that any residential development should be at a density compatible with adjoining and surrounding approved developments. Staff also believes that land uses permitted by the existing Neighborhood Commercial designation could be an appropriate use of the site. It is staff's opinion that a small convenience center or low-intensity office use, such as a medical office, could be developed without adversely impacting surrounding property. Such uses would be unaffected by noise and odor impacts. Staff has indicated to the applicant that consideration could be given to a request for a Residential-Medium, (RM, 4-10 du's/ac), designation. The applicant has advised staff, however, that residential development at less than the requested density is not economically feasible. Since uses permitted by the existing Neighborhood Commercial designation could be developed with minimal impacts and residential development, at the density proposed, would not be compatible with surrounding land uses and development at a compatible density may not be feasible, staff is recommending that no amendment be made to the land use designation specified by the General Plan, Master Plan 2 and Specific Plan 23. Consequently, staff is recommending denial of the requested Zone Change to RD-M-Q as it would not be consistent with the General Plan and denial of the Site Development Plan as it is not in conformance with either the General Plan or zoning. The City has received a number of letters in opposition to the proposed project, and a couple in favor. -3- IV. ENVIRONMENTAL REVIEW The Land Use Planning Manager has determined that this project will not have a significant impact on the environment and has, therefore, issued a Negative Declaration on October 5, 1983.
