ITEM EXPLANATION The City Council at your meetings of November 15 and 22, 1983 conducted extensive public hearings on seven requests for amendments to the Land Use Element of the General Plan. Council directed our office to prepare a series of documents to accomplish the Council's intention in regard to the seven amendments and other related requests. Those documents have been prepared and are attached. If the City Council concurs you should take the series of actions recommended above. The results of those actions in regard to the seven requests is as follows: 1. EIR 83-5/GPA 70-( A)/ZC-276 - ALANDA; Denies without prejudice an amendment to the General Plan to change the land use designation from RM (4-10 du/acre) to RMH (10-20 du/acre) and a corresponding zone change on property on the northwest corner of El Camino Real and the future alignment of Elm Avenue. EIR 83-4/GPA/LU 70-(C)/ZC-291 - CAL COMMUNITIES; Approves part and denies part ofan amendmentto the General Plan to change land use designations and corresponding zone changes on 433 acres of property generally located between the easterly portion of Agua Hedionda Lagoon and El Camino Real. Directs staff to initiate an amendment to the Agua Hedionda Lagoon Local Coastal Plan. 3. EIR 83-7/GPA/LU 83-2/ZC-281 - ROBERTS GROUP; Denies an amendment to the General Plan to change the land use designation from RM (4- 10 du/acre) to RH (10-20 du/acre) on property located immediately south of Palomar Airport Business Park and 1500 feet west of El Camino Real. Approves a preannexation zone change to RDM (Q) and OS. 4. GPA/LU 83-3 - CALAVERA HILLS; Approves an amendment to the General Plan to change densities, park sites and open space areas within the Calavera Hills Master Plan Area. 5. GPA/LU 83-9/ZC-285 - TRUITT; Denies without prejudice an amendment to the General Plan to change the land use designation from RLM ( 0- 4 du/acre) to RH (20-30 du/acre) and a corresponding zone change from R-1 to R-3 on property on the south side of Tamarack Avenue immediately east of the AT&SF Railroad. 6. GPA/LU 83-11 - COUNTY OF SAN DIEGO; Approves an amendment to the General Plan to change the land use designation from OS Open Space to PI Planned Industrial, R-L Residential Low Density and Open Space on 205 acres of land east of El Camino Real and north of Palomar Airport Road. 7. GPA/LU 83-13/ZC-287/MP-2(A)/SP-23(D)/SDP 83-8 - KOBLENTZ; Denies an amendment to the General Plan to change the land use designation from RM (4-10 du/acre) to RMH (10-20 du/acre), a request to delete MP-2 and SP-23, a corresponding zone change from P-C to RDM(Q) and a site development plan for 150 apartment units on the west side of Paseo del Norte north of Alta Mira. GPA/LU 70(C) CAL COMMUNITIES AND GPA/LU 83-3 CALAVERA HILLS COMPANY. WHEREAS, the Planning Commission did on October 12 and October 26, 1983 hold duly noticed public hearings as prescribed by law to consider amendments to the Land Use Element of the General Plan GPA/LU 70(C) and GPA/LU 83-3; and WHEREAS, the Planning Commission has determined that GPA/LU 83-3 would not have significant impacts on the environment and a Negative Declaration was approved on October 12, 1983 and the City Council has certified EIR 83-4 for GPA/LU 70(C) all in satisfaction of the requirements of the City of Carlsbad Environmental Protection Ordinance of 1980 and the California Environmental Quality Act; and WHEREAS, the City Council did on November 15 and November 22, 1983 hold duly advertised public hearings to consider a series of amendments and at that time received the recommendations, objections, protests and comments of all interested persons desiring to be heard; and WHEREAS, the City Council, after considering all proposed changes to the Land Use Element of the General Plan, directed the City Attorney to return with appropriate documents to allow the City Council to vote on the change individually as a part of one single amendment to the Land Use Element of the General Plan. 3 in I 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: 1. That the above recitations are true and correct. 2. That this resolution and resolutions no. 7419 , 7420 , and 7421 , constitute a single amendment to the Land Use Element of the General Plan. 3. That the findings of the Planning Commission as set forth in Planning Commission Resolutions No. 2190 (GPA/LU 83-3) and 2208 (GPA/LU 70(C)) constitute the findings of the City Council. 4. That the Land Use Element of the General Plan is amended as follows: A. GPA/LU 83-3 CALAVERA HILLS COMPANY; To change the Land Use densities, park sites, and open space areas from the existing designations for property within the Calavera Hills Master Plan as shown on the maps marked Exhibit B - Existing General Plan and Exhibit A - Amended General Plan GPA/LU 83-3 attached hereto and made a part hereof. B. GPA/LU 70(C) CAL COMMUNITIES; To change the Land Use Element designations designating various parcels for residential development and revising the open space boundaries for 433 acres of the Agua Hedionda Lagoon - Kelly Ranch property as shown on Exhibit A - GPA/LU 70(C) attached hereto and made a part hereof. This general plan amendment is granted subject to the certification of a corresponding amendment to the Agua Hedionda Local Coastal Plan by the California Coastal Commission. WHEREAS, the City Council by their adoption of Resolution No. 7420 has denied GPA/LU 83-9 Truitt and GPA 70(A) Alanda without prejudice and denied GPA/LU 83-13 Koblentz said resolution is incorporated by reference; and WHEREAS, the applicants for those general plan amendments have also applied for related land use approvals ZC-276 Alanda, ZC-285 Truitt, and ZC-287 Koblentz and MP-2(A), SP-23(D) and SDP 83-8 Koblentz; and WHEREAS, because said requests are all inconsistent with the existing General Plan designations and since the City Council has denied the general plan amendments all these requests must be denied. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: 1. That the above recitations are true and correct. 2. That the City Council denies the appeal and upholds the Planning Commission's decision to deny the following: A. ZC-285 TRUITT; A proposed zone change from R-1- 7500 Single Family Residential to R-3 Multiple Family Residential on property generally located on the south side of Tamarack Avenue between Hibiscus Circle and the AT&SF Railroad as shown on the location map marked Exhibit A attached hereto and made a part hereof. This action is taken for the reasons contained in Planning Commission Resolution No. 2194. C. CASE NO.: ZC-291 The City Council of the City of Carlsbad, California does ordain as follows: SECTION 1: Title 21 of the Carlsbad Municipal Code is amended by the amendment of the zoning map to grant a zone change (ZC-291) from R-A-10 and County of San Diego E-1-A to City of Carlsbad P-C with an F-P overlay on property as shown on the map marked ZC-291 - Exhibit A, attached hereto and made a part hereof. SECTION 2: This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated August 29, 1979 and amended on April 2, 1982 on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee a copy of that agreement dated September 22, 1983 is on file with the City Clerk and incorporated herein by reference.
