I will be presenting the following agreement to the City Council on December 7. Beckman will dedicate to the City an 84' right of way for FARADAY ROAD and a 30' landscape easement on each side of the road. In addition, Beckman will dedicate a 30' land- scape easement along EL CAMINO.REA.L and an additional 8' road right of way. City will prepare necessary documents to implement these dedications. CITY agrees to accompl.,.sh the following as full consideration for the road dedication. 1. City at its cost and expense will construct full street improvements on FARADAY ROAD across Beckman property in 1984. Said improvements will include utility relocation fire hydrants, street lights, curb, sidewalk, street pavement, landscaping,three driveways and two four -inch conduits across Faraday Road and adjacent landscaped areas in a location to be provided by Beckman. 2. Landscaping will be installed by City on the north side of FARADAY ROAD simultaneously with the road construction. Landscaping on the south side of FARADAY will be installed by City when a building is constructed on Beckman's south campus. 3. The City will pursue obtaining approval from San Diego County for access by Beckman to the road to be constructed along Beckman's east property line between FARADAY and EL CAMINO REAL. In respect to that matter, I have attached a letter from the County Director of Public Works dated November 18, 1983. FA DECEMBER 1, 1983� BECKMAN INSTRUMENTS, INC. Page 2 4. City at its cost and expense will install a traffic signal on FARADAY ROAD at its intersection with the City -County road along Beckman's east property line. Said signal to be installed when traffic warrants are met. 5. city at its cost and expense will install street improve- ments and landscaping on the east half of EL CAMINO REAL adjacent to Beckman property for a distance of approxi- mately 1,820 feet. The improvements will include median, curb, street pavement, street lights, landscaping and a driveway to serve Beckman's south campus. 5. The City will initiate the necessary public hearings and recommend the vacation of: a) A 30' strip along Beckman's north line (44,000 sq. ft.); and b) A 52' x 230' strip (12,000 sq. ft.) which was required as an extension of Impala Road. _7. The City will rescind the requirement that Beckman dedicate a 20' strip of land on the east end of the parcel owned by the Palmer estate which was required as a condition of the previous Beckman site plan approval. 8. The City will file new parcel maps for Beckman's north and south parcels which border on Faraday Road. 9. The conditions which shall apply to the site development plan for the thud and final building on Beckman's north campus are set `Orth in the attached resolution. Please advise me if you wish to modify any of the statements recited herein. Upon approval of the City Council and your concurrence, I will proceed to implement this agreement. City will prepare all plans and specifications for the road improvements and submit for your review and comment. City will prepare necessary docu- ments for dedication and vacation of easements and submit for your signature. ' I will call you on Thursday, December 8, to report on Council action. We expect to complete our internal review of the matter and have a final recommendation for the Board of Supervisors within the next two weeks. From our initial review, it is apparent that the issue of road maintenance will need to be addressed -as a part of the'easement. During the time that the road remains a private road, some arrangement will need to be made for sharing -of maintenance responsibilities between the County, City and Beckman Instruments. ultimately, if the County develops its property and the road is improved and turned over to the City as a part of its maintained road system, private maintenance responsibilities would terminate. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A SITE DEVELOPMENT PLAN NO. 80-1(A), TO ALLOW FOR THE CONSTRUCTION OF AN INDUSTRIAL BUILDING ON PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF EL CAMINO REAL TO THE NORTH AND SOUTH OF THE FUTURE EXTENSION OF FARADAY AVENUE. APPLICANT: K8o 1(A;TRUMENTS CASENO:SDPnO ®CT WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request las provided by Title 21 o� the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal code, the Planning Commission did, on the day of , 1983, consider said request on property described as: A portion of Lot "B" of Rancho Agua Hedionda according to Map thereof No. 823 filed November 16, 1896; WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be rd, said Commission considered all factors relating to Site lopment Plan No. 80-1(A). In addition, the Planning Commission has added a condition tl,"-t a note shall be placed on the final map that building permits may not be issued for the project unless the City Engineer determines that sewer service is available, and building cannot occur within the project unless sewer service remains available, and the Planning Commission is satisfied that the requirements of the public facilities element of the general plan have been met insofar as they apply to sewer service for this project. DRAFTa b) All necessary public improvements ve been provided or will be required as conditions of approval. c) The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. This note shall be placed on the final map. 3) This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated April 2, 1982, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee, a copy of that agreement, dated August 20, 1982, is on file with the City Clerk and incorporated herein by reference. If said fee is not paid as promised, this application will not be consistent with the General Plan and approval for this project shall be void. 4) Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable C_1':y ordinances in effect at time of building permit issuance. 5) Water shall be provided by the City of Carlsbad in accordance with the water service agreement with Costa Real Municipal Water District dated May 25,6WAFT Land Use Planning 6) The applicant shall prepare a reproducible mylar of the final site plan incorporating the conditions contained herein. Said site plan shall be submitted to and approved by the Land Use Planning Manager prior to the issuance of building permits. 7) The applicant shall prepare a detailed landscape and irriga- tion plan which shall be submitted to and approved by the Land Use Planning Manager prior to the issuance of building permits. 8) All parking lot trees shall be a minimum of 15 gallons in size. 9) All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. 10) All roof appurtenances, including air conditioners shall be architecturally integrated and shielded from view and the sound buffered by a screen equal in height to the appurtenance. 11) The project shall attempt to develop a ride to work and home program for its employees with the North County Transit District. The applicant shall P. landscape the setback area off of Palmer Drive in accordance 3 with the Carlsbad Landscape Guidelines manual to the satisfact_.on of the Director of Parks and Recreation. 4 13) Any signs proposed for this development shall be designed in conformance with the City's Sign Ordinance and shall require 5 review and approval of the Land Use Planning Manager prior to 6 installation of such signs. 7 14) A uniform sign program for this development shall be submitted to the Land Use Planning Manager for his review and approval 8 prior to occupancy of any building. 9 15) Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location 10 of said receptacles shall be approved by the Land Use Planning Manager. 11 16) All lighting shall be arranged to reflect away from adjacent 12 properties. 13 17) The maximum allowable exterior noise level generated by this project shall not exceed sixty-five Ldn as measured at the 14 property line. Noise caused by motor vehicles traveling to and from the site are exempt from this standard. 15 18) Parking shall be provided for this use as follows: 16 Office Uses: 1 space/300 sq. ft. of gross floor area. industrial Uses: 1 space/800 sq. ft. of gross floor area. 17 Engineering DRAFT 18 19) The developer shall obtain a grading permit prior to the 19 commencement of any clearing or grading of the site. 20 20) The developer shall install half street improvements on Palmer Way in conformance with City of Carlsbad Standards. 21 These improvements shall include streetlights, street trees and sidewalks and shall be constructed prior to the occupancy 22 of any new buildings on the site. 23 21) A drainage plan shall be shown on the site development subject to review by the City Engineer. 24 Fire 25 22) Prior to the issuance cf building permits, complete building 26 plans shall be submitted to and approved by the Fire Department. 27 23) Additional public and/or on site fire hydrants shall be re- 28 quired if deemed necessary by the Fire Marshall. PC RESO NO. -4- � r• 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 171 18 19 20 21 22 23 241 25 26 27 28 E r L_ 24) The applicant shall submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants and on site roads and drives subject to the approval of the Fire Marshall. 25) An all weather access road shall be maintained throughout construction. 26) All required fire hydrants, water mains and appurtenances shall be operational prior to combustible building materials being located on the project site. 27) All driveways shall be extended to within 150 feet of all portions of the exterior walls of the first story of any building. 28) All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be submitted to the Fire Department for approval prior to construction. 29) Building exceeding 10,000 sq.ft. aggregate floor area shall be sprinklered or have four-hour fire walls with no openings therein which shall split the building into 10,000 sq.ft. (or less) areas.
