HD,..Q.!:1'1---,,,- CITY ATTY....-~ CITY MGR~~~ RECOMMENDED ACTION: Adopt Resolution No. 1"-(t/::1,. , authorizing the destruction of certain files. ITEM EXPLANATION: This agenda bill is part of a continuing Record Management Program for City Departments. Adoption of the Resolution will complete the destruc- tion of obsolete and unnecessary files in the Police Department Records Division. Section 34090 of the Government Code provides authority for destruction of documents which are more than two years old and are no longer required. This Section also requires the consent of the City Attorney and the author- ization of the City Council prior to the destruction of any documents. Sec~tion 34090 does not authorize the destruction of the following: 1. Records which affect title to real property. 2. Minutes, Ordinances, or Resolutions of the City Council or of any Ci.ty Board or Commission. The documents listed as Exhibit "A" to Resolution No. 7'1'-/:J. , have been reviewed in accordance with the provisions of the Government Code, and meet those requirements and the City Attorney has consented to their de- struction. FISCAL IMPACT: The dollar savings is difficult to determine, but the space savings will ce immediately realized. EXHIBITS: Exhibit "A", list of records desi-red to be destroyed. WHEREAS, maintaining all obsol~te files, correspondence and papers is unecon J1111cal; and WijEREAS, Sectio(1 34090 of the Government Code provides authority for the destruction of certain records; and WHEREAS, the documents listed un Exhibit "A" attached hereto and made a part hereof, have beEn reviewed by the Chief of ~olice; and WHEREAS, the Cliief of Police recommends that all documents listed on Exhibit "A" are more than two years old, are no longer required, and meet the requirefficnts of Goverr.ment Code Section 34090 for destruction; and WHEREAS, the City Attorney has consented to the destruction of those documents listed on Exhibit "A"; NOW, THEREFORE, BE IT RE~OLVED by the City Council of the City of Carlsbad, as follows: 1. That the above recitations are true and correct. 2.
