ITEM EXPLANATION:
The Costa Real Municipal Water District raised the per unit charge for water by
120 at their meeting of December 7, 1983. This increase was necessitated by an
increase of $53 per acre foot imposed by the Metropolitan Water District and
passed through by the San Diego County Water Authority. The effective date of
this increase is for water delivered on January 1, 1984 and thereafter. A
comparison chart for local agencies is attached.
FISCAL IMPACT•
There is no direct impact on city funds as it is a direct pass through. It will
impact the average homeowner who uses 2.0 units per month by about $2.40 per month
or $28 to $30 per year. The average homeowner's bill as described above will
increase from $200 per year to $229 per year.

RESOLUTION NO. 443
A RESOLUTION OF THE BOARD OF DIRECTORS OF
COSTA REAL MUNICIPAL WATER DISTRICT
AMENDING RESOLUTION NO. 401, RESOLUTION NO. 427
AND RESOLUTION NO. 440
AND FIXING RATES AND CHARGES OF WATER SUPPLIED BY
COSTA REAL MUNICIPAL WATER DISTRICT
EFFECTIVE JANUARY 1, 1984
WHEREAS, the Board of Directors of COSTA REAL MUNICIPAL WATER
WATER DISTRICT adopted Resolution No. 401 on September 3, 1980, which
in part established the water rate for wholesale water delivered by
the District; and
WHEREAS, the Board of Directors of COSTA REAL MUNICIPAL WATER
DISTRICT adopted Resolution No. 427 on July 7, 1982, which in part es-
tablished the water rate for retail water delivered by the District

f after July 1, 1982; and
WHEREAS, the Board of Directors of COSTA REAL MUNICIPAL WATER
DISTRICT adopted Resolution No. 440 on August 3 198 g 3, which in part
established the water rate for retail water delivered by the District
after August 1, 1983; and
WHEREAS, the Board of Directors of COSTA REAL MUNICIPAL WATER
DISTRICT has carefully investigated the rising costs of water and
charges connected with the delivery of water to and by COSTA REAL MU-
NICIPAL WATER DISTRICT; and
WHEREAS, the Board of Directors has determined that a revi-
sion of the charges for water delivered is necessary.
NOW, THEREFORE, THE BOARD OF DIRECTORS OF COSTA REAL MUNI-
CIPAL WATER DISTRICT DOES HEREBY RESOLVE AS FOLLOWS:

1. That portion of Paragraph 1 of Resolution No. 401 and Re-
solution No. 440 relating to rates for wholesale water delivered by
COSTA REAL MUNICIPAL WATER DISTRICT is amended to read as follows:
The rates on monthly basis charged for all
wholesale water delivered by COSTA REAL
MUNICIPAL WATER DISTRICT shall be at the
rate of $320.89 per acre foot.
2. That portion of Paragraph 1 of Resolution No. 427 ands
Paragraph 2 of Resolution No. 440 relating to rates for retail water
delivered by COSTA REAL MUNICIPAL WATER DISTRICT is amended to read as
follows:
The rates on monthly basis charges for all
retail water delivered by COSTA REAL MUNI-
CIPAL WATER DISTRICT shall be as follows:

RESOLUTION NO. 7454
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY CF CARLSBAD REVISING WATER RATES
AND CHARGES
WHEREAS, Section 14.04.030 of the Carlsbad Municipal Code empowers the
City Council to, from time to time, by resolution, adopt rules and regulations
for the operation and maintenance of the Water Department of the City, and for
furnishing water to users, and empowers the Council to, by resolution, modify
rates, charges and penalties respecting water service.
NOW, THEREFORE, BE IT RESOLVED that the hereinafter stated regulations
respecting water rates, charges, billing and related regulations shall become
effective for all water billed after January 1, 1984.
I. Generally. The schedules of rates, compensations, charges and
minimum charges as set out in this resolution are fixed and established as the
rates, .compensations, charges and minimum charges to be charged and collected
by the City for domestic water and water service, except as otherwise
specifically provided.
II. Water Charges.
(a) There shall be a separate monthly water standby charge for
each consumer; provided that there shall be only one monthly
standby charge for each equivalent dwelling unit, each
agricultural and industrial consumer, and each institutional
consumer as follows:
For a 5/8" meter $ 4.40
For a 3/4" meter $ 4.40
For a 1 " meter $ 5.45
For a 11 " meter $ 5.90
For a 2 " meter $ 6.40
For a 3 " meter $12.30
For a 4 " meter $15.40
For a 6 " meter $15.40
For an 8 " meter $23.70

(1) When one meter serves multiple dwelling units or
multiple equivalent dwelling units, the first
unit shall pay the unit rate based on the above
schedule and all other units shall pay $2.53
for each additional multiple residential unit,
(2) In the event no water is used through the meter
or the property becomes vacant, the monthly
stand-by charge will be charged to and paid by the
owner thereof.
(b) The rates to be charged for water supplied in any one month
through meters are as follows:
All consumers 73.50/100 cu. ft.
(c) All agricultural consumers who meet the Metropolitan Water
District Southern California requirements for agricultural
consumers receive a pro-rata share of the agricultural
rebate the City receives monthly from the Costa Real
Municipal Water District.
(d) There shall be a monthly charge of five dollars per month
for all water connections supplying non -metered water for
fire sprinkler purposes. All maintenance or repairs to
fire service systems from the water main to the shut off
valve shall be paid for by the consumer and shall be charged
on the regular water billing. All fire service systems
shall be equipped with a meter by-pass which shall be paid
for and installed at the consumer's expense. In the event
water is served through the fire service system, the City
Water Department and the Fire Department shall estimate the
amount of water used and the regular charge therefore shall
be put on customer's bill and shall be paid by consumer.
(e) A monthly fee of one dollar shall be paid for each five
rooms in any hotel, rooming house or motel, in which no
cooking is allowed.
(f) A monthly fee shall be charged for each individual living
unit contained in any motor court, motel, hotel, or rooming
house or other transient type habitat which allows cooking
in rooms in the amount of 700 in addition to other charges
established.
III. Payment of Bills. All water bills are due and payable at the City
Hall of the City of Carlsbad upon presentation and are delinquent if not paid
by the 15th of the month following the monthly billing.
IV. Meter Reading - Water District. For convenience in the reading of
meters and preparation of water bills, the department is expressly authorized

1 to divide the City into districts. These districts may, from time to time, be
2 revised or changed as necessary or desirable, in order to equalize the work
3 of reading meters and billing. The meters in each district so established
4 shall be read and water bills based on such meter readings, shall be prepared
5 and mailed to the consumers in eacn district on approximately the same day of
6 each and every month, except when Saturdays, Sundays and legal holidays
7 intervene.
8 V. Bills - Mailing. Unless the applicant for water service directs
9 otherwise, all bills will be mailed to the premises where water service is
10 furnished.
11 VI. Change of Ownership or Occupancy - Notification. It shall be the
12 duty of every person signing an application for water delivery and of every
13 owner of property to which water is delivered to notify the Water Department of
14 any change in the ownership or occupancy of the premises to which the water
15 is to be furnished at least two days prior to such change. Every applicant
16 shall be liable for the water furnished and metered in accordance with the
17 application until the Water Department receives written notice to cancel
18 same and shut off the water, when the applicant's liability shall cease except
19 I as to water previous to such notice. Every owner of property is liable for
20 water furnished to any premises he has rented in the event the tenant does not
21 pay the water bill. Water service shall not be given any consumer upon change
22 of address until all delinquent charges owed by the consumer at a former place
23 of residence or business shall be paid.
24 VII. New Accounts - Tbrning on Water Charge. Regulation of water service;
25 turning on and off of water supply. A three dollar and thirty cents charge
26 will be made by the department for turning on the water supply when requested
27' by the consumer incident to the opening of a new account.
28 VIII. Nonpayment - Service Discontinuance. In the event that any consumer

shall be delinquent in the payment of his water bill, and such delinquency
shall continue for a period of ten days after the final date for payment of
such bill, the department shall have the right forthwith and without notice
to discontinue water service to the premises of such delinquent consumer, and
water shall not again be supplied to him or to the premises until all delinquent
water bills, plus the penalties thereon, and reconnection charges, have been
paid.
IX. Restoring Service After Discontinuance Procedures for restoring
service after delinquency period. If water service is cut off or discontinued
for failure to pay delinquent bill:, such service may again be established only
in the event the consumer or tf�e applicant for service at such place pays all
delinquent bills, charges and penalties, and makes sL n cash deposit as may be
required by the Water Department.
When an owner or consumer has been delinquent in his water bills in
successicn or three times in any one calendar year, he shall be required to
deposit a sum equal to an average two months' water bill upon such premises
and pays, in addition thereto, the sum of eight dollars and twenty-five cents
for turning on the water supply. Thereupon and not otherwise will water service
again be made or established to the premises where the water bill has been
delinquent.
X. The Rates and Charges established by this resolution shall on their
effective day supersede the rates established by Resolution No. ?32S
