RECOMMENDED ACTION: UL Adopt Resolution No.rL/3rmaking the finding that the Public Contract Code does not need to be complied with and authorize the City Manager to enter into the necessary contract to complete the storm drain construction using monies previously allocated by Counci 1. ITEM EXPLANATION: On October 18, 1983, the City Council authorized advertising for the Hoernlein Storm Drain. The Bid Opening was scheduled for November 14. No bids were received. Inquiries were made with the Contractors who received the plans and they commented that they were too busy to do the work. Per the Public Contract Code 20166, "If no bids are received, the Legislative Body may have the project done without further complying with this Chapter." Therefore, it is necessary that the City Council make the finding that the Standard Bid Procedure was followed and now the Public Contract Code governing that bid procedure no longer needs to be compl i ed with . Staff has investigated alternative means of completing the construction as outlined in the attached memorandum to the Assistant City Manager for Developmental Services. Should Council so authorize us, we will proceed with the. Contract using normal City purchasing procedures. FISCAL IMPACT: The City Council has already authorized monies for this project. Our alternatives are as follows: We have therefore had to look into alternative 1. Re-bid the contract using public contract code at a more advantageous time. 2. 3. Have Council find that Public Contract Code does not apply and allow Staff to negotiate in any way possible under City Code, using private contractors to complete the work. The City Attorney has indicated that time is of the essence on this construction project so Alternative Number 1 would not be acceptable for reasons of timing. The Utilities Maintenance Director has indicated a willingness to install a temporary pipe but this would disrupt his maintenance scheduling and just push the issue down the line to a later date. Resource Developments (Full Project) $47,840.00 Our recommendation is to proceed with a contract with Draves Pipeline. We have inquired into the licensing board and found no outstanding complaints. Hadley Bacon, our Senior Construction Inspector, is familiar with their work and has indicated they do a good, professional job. We are currently checking into their project reference list. We anticipate doing this project using normal purchase order procedures. Since the City is contributing greater than $5,000 to its completion, we will need Council authorization to enter into a contract with Draves Pipeline, assuming all their references prove satisfactory. Contract Code does not need to be complied with. We also need Council to make the finding that Public 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 28 ,~ l1 RESOLUTION NO. 7438 A RESOLUTION OF THE CITY COUNCIL OF THE CITY THAT THE HOERNLEIN STORM DRAIN PROJECT DOES NOT HAVE TO COMPLY WITH THE PUBLIC CONTRACT OF CARLSBAD, CALIFORNIA, MAKING THE FI~~DING WHEREAS, the City Coinicl of the City of Carlsbad, California, has determined that it is necessary and in the public interest to construct the Hoernlein Storm Drain; and I WHEREAS, the City Clerk of said City had advertised said Storm Drain for bids per Municipal Code, Section 3.28.080; and WHEREAS, no bids were received for said Storm Drain; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. The above recitations are true and correct. 2. The Hoernlein Storm Drain Project is to be continued to its completion. 3. The Public Contract Code governing bids for Public Work no longer needs to be complied with for said Storm Drain. ~ 4.
