TITLE: WORKERS' COMPENSATION CLAIM IN THE
CASE OF SENIOR POLICE OFFICER KATHLEEN LANG CITY MGR.~

ITEM EXPLANATION:
Senior Police Officer Kathleen J. Lang has incurred an injury
arising out of her employment and in the course of her employment
with the city.
Officer Lang's physician states her percentage of disability resulting from the injury is 17+%. The city sponsored examination
finds the disability to be 12%. As a result of meetings between
Officer Lang's attorney and an attorney representing the city a compromise was reached at a 14 3/4% disability rating which could be settled for a disability payment of $7,000.00. The amount
represents a value of $6,402.50 for the injury and $597.50 additional costs. '
Officer Lang has agreed to settle her claim for the amount of
$7,000.00. This settlement ends all payments arising out of the injury including lifetime medical care which would usually be
paid.
FISCAL IMPACT
Settlement cost of $7,000.00 would be the total fiscal impact.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING
A COMPROMISE AND RELEASE SETTLEEENT FOR A
WORKER'S COMPENSATION CLAIM IN THE CASE OF
KATHLEEN J. LANG.
WHEREAS, the City Council has established and clearly defined
its authority to settle workers' compensation claims in excess of
five thousand dollars ($5,000) ; and
WHEREAS, the claim of KATHLEEN J. LANG is approximately
$7,000; and
WHEREAS, the City Council authorizes a settlement in that
amount;
NOW THEREFORE, BE IT RESOLVED by the City Council for the
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the City Council authorizes and directs the City
Manager to obtain a Compromise and Release settlement in the
workers' compensation case of KATHLEEN J. LANG in the amount
stated.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 20th day of December , 1983,
by the following vote to wit:
AYES : Council F&mbers Casler, Lewis, Kulchin, Chick and Prescott
NOES: None
ABSENT: None
