The City Council affirm the action announced by Personnel Board
Resolution No. 8, dated October 20, 1983.
ITEM EXPLANATION:
City of Carlsbad Personnel Board convened on Thursday, October 20, 1983, to hear an appeal on Christopher L. Henderson, formerly
Construction Inspector in the Engineering Department.
Mr. Henderson had been discharged effective August 18, 1983, for
being absent without authority from work. After appropriate
efforts on the part of the city to communicate with Mr. Henderson, he still failed to report for work and was, subsequently, dismissed.
Mr. Henderson appealed the dismissal. The appeal hearing was
scheduled. Mr. Henderson requested a delay and a delay was
granted. Two separate attempts at informing Mr. Henderson regarding the hearing by registered mail return receipt requested
were unanswered, however Mr. Henderson was orally advised of the hearing time and date. Evidence that Mr. Henderson was fully aware of the time and date of the hearing was presented to the board and the board found first notice of the hearing
was, in fact, given to Mr. Henderson.
The Personnel Board convened as scheduled. Mr. Henderson did not attend the hearing. The board received the city's exhibits
in evidence and adopted a Personnel Board Resolution No. 8.
FISCAL IMPACT:
There is no fiscal impact resulting directly from this action.

RESOLUTION NO. 8
A RESOLUTION OF THE PERSONNEL BOARD
OF THE CITY OF CARLSBAD, CALIFORNIA,
ANNOUNCING ACTION ON THE APPEAL OF
CHRISTOPHER HENDERSON.
WHEREAS, CHRISTOPHER HENDERSON has appealed his dismissal to
the Personnel Board; and
WHEREAS, the city has notified CHRISTOPHER HENDERSON orally
of the hearing date, and has given-mailed notice to inform
Mr. HENDERSON of the time, place, and date of such hearing: and
WHEREAS, Mr. HENDERSON has failed to appear; and
WHEREAS, the documents presented by the city have been
presented and accepted into evidence;
NOW, THEREFORE, BE IT RESOLVED by the Personnel Board of the
City of Carlsbad, California, as follows:
1. The above recitations are true and correct.
2. That based on the evidence presented by the city, the
Personnel Board finds that the termination of CHRISTOPHER HENDERSON
was justified and sustains the dismissal action of the city.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the
Personnel Board of the City of Carlsbad, California, on the 20th
day of October, 1983, by the following vote, to wit:
