RECOMMENDED ACTION:
Adopt Resolution No.approving agreement with
Richard S. Whitmore for labor negotiation and consulting services,
ITEM EXPLANATION:
City staff recommends that Richard S. Whitmore be hired to repre-
sent the City in negotiations with the Carlsbad Police Officers'
Association. Mr. Whitmore has extensive experience in public
sector labor negotiations in California.
FISCAL IMPACT;
The cost of Mr. Whitmore's services is estimated to be between
$8,000 and $10,000. Funds are available in the Personnel
Department budget to pay for the service.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
AN AGREEMENT WITH RICHARD S. WHITMORE
FOR LABOR NEGOTIATIONS AND CONSULTATION
SERVICES.
WHEREAS, the City Council has determined the need to have
the services of a labor relations negotiator and consultant.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above facts are true and correct.
2. That the City Manager is hereby authorized and
directed to sign the agreement for labor negotiations and
consultant services which is attached hereto and made a part
hereof, as Exhibit A.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 17th day of January , 1984,
by the following vote, to wit:
AYES: Council Members-Casler, Lewis, Kulchin, Chick and Prescott
NOES: None

Dear Dick:
This letter will serve as an agreement between you and the
City of Carlsbad for labor negotiation and consultation
services.
You agree to represent the City of Carlsbad in negotiations
with the Carlsbad Police Officers' Association and consult
with the City Council and staff as determined necessary by
the City Manager.
The city agrees to compensate you at the rates stated in
your November 10, 1983 letter, plus reasonable travel expenses
The estimated cost of your services is approximately $8,000
to $10,000.

Vince Jimno asked me to put in letter form the attorneys
fee arrangement we discussed some time ago. We will represent
the City of Carlsbad in labor relations matters on the following
hourly fees:
Partner: $95.00/hour
Associate: $70-85/hour
Law Clerk: $40.00/hour
Paralegal: $40.00/hour
Graduate Legal Assistant:$45.00/hour
It is anticipated that these rates will increase $10 per hour
after January 1, 1984. The rates apply to all time spent actually
performing work for the City. We also ask for reimbursement of
actual travel expenses. We submit itemized monthly statements and
ask for payment within thirty (30) days.
It is my understanding that this letter sets forth the
arrangement we discussed. If you have any question or disagreement,
please let us know.
