2) for the Alga Road Improvements and Golf Cart Crossing in the amount of $835,625 to T. B. Penick & Sons Inc.
ITEM EXPLANATION:
On December 6, 1983, Council authorized the Advertisement for Bids for the Alga Road
Improvements. The bid schedule was in two parts, Schedule 1 for the street improvements to be financed from City funds, and Schedule 2 for a Golf Cart Crossing to be financed by La Costa Hotel & Spa. The award of the contract, as recommended,
is to the lowest qualified bidder for the Public Works portion of the contract. La
Costa Hotel & Spa has agreed to the award of Schedule 2 to this Contractor and has
provided the City with a irrevocable Letter of Credit to cover the award of Schedule
7 L.

T.B. Penick & Sons Inc., the low bidder, has previously worked for the City having
satisfactorily completed the City's Streetscape project.

Staff recommends the award
The installation of the traffic signal at Alicante and Alga Road is being handled
separately and will be completed so as to not interfer with the completion of this
contract.
FISCAL IMPACT
The Engineer's Estimate for the total contract was $1,000,000 ($850,000 for Schedule 1 and $150,000 for Schedule 2). Funds in the Alga Road Improvements Account No. 10- 18-40-3141, in the amount of $843,127, to cover the costs of Schedule
1, $692,097.50, according to the Finance Department.
La Costa Hotel & Spa has provided the City with an irrevocable Letter of Credit
issued by the City National Bank, in the amount of $143,527.50 to cover the
construction costs of Schedule 2. This account can be drawn upon by sight drafts
signed by the Assistant City manager in the amounts due and payable to the Contractor
on the project. Thus, a total of $986,654.50 is available to cover the total cost of
construction.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING BIDS AND AUTHORIZING THE EXECUTION
OF CONTRACT NO. 3141 FOR THE ALGA ROAD IMPROVEMENTS.
WHEREAS, bids have been received by the City of Carlsbad, California, for
he Alga Road Improvements, which consists of two parts: Schedule 1, Street
mprovements, to be funded by public funds, and Schedule 2, Golf Cart Crossing,
o be funded by La Costa Hotel & Spa, Contract No. 3141; and
WHEREAS, the low bid received for this project was submitted by T.B. Penick
! Sons Inc., in the amount of $835,625; and
WHEREAS, funds in the amount of $843,127 are available in Account No. 10-18-
0-3141 for the public works' portion of Alga Road Improvements; and
WHEREAS, the LaCosta Resort Hotel and Spa has provided the City with an
rrevocable Letter of Credit with City National Bank in the amount of
,143,527.50; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad

1. The above recitations are true and correct.
2. The bid of $835,625 received from T.B. Penick & Sons Inc. for the Alga

RE: ALGA ROAD GOLF CART CROSSING
Dear Mr. Kackley:
In response to your letter of January 12th, 1983, to our
engineer, Mr. Robert Ladwig, please be advised that La Costa
Hotel and Spa accepts the contract bid of $143,527.50 submitted
by T.B. Pennick and Son, for construction of the golf cart
underpass, as outlined in Schedule 2 of the Alga Road widening
project .
We are prepared to have City National Bank pay the City
for work done in connection with the project, as agreed between
the Assistant City Manager for Developmental Services and
myself, as soon as Mr. Eeckman provides us the Agreement he
described in his letter of December 2nd, 1983.
