ITEM EXPLANATION
The City requires secondhand dealers to report purchases and sales of
secondhand goods to the police chief and to hold secondhand goods
for a specified period of time before resale. State law now
prohibits cities from imposing holding and reporting requirements on
the sale of coins and certain precious metals. [1984 Statutes,
Ch.840] This ordinance will amend the City regulations of
secondhand dealers to be consistent with state law.
Dealers of coins and precious metals are still subject to state
regulation and other parts of the secondhand dealers' ordinance.

ORDINANCE NO. 6074
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA AMENDING TITLE 5, CHAPTER
5.40 OF THE CARLSBAD MUNICIPAL CODE BY THE
ADDITION OF SECTION 5.40.160(£) TO REVISE THE
RESTRICTIONS ON SECONDHAND DEALERS.
The City Council of the City of Carlsbad, California does
ordain as follows:
SECTION 1: That Title 5, Chapter 5.40 of the Carlsbad
Municipal Code is amended by the addition of Section 5.40.160(f)
read as follows:
"(f) The retention holding and reporting requirements of
this chapter shall not apply to transactions involving coins,
monetized bullion or commercial grade ingots of gold, silver or
other precious metals. "Commercial grade ingots" means .99 fine
ingots of gold, silver or platinum, or .925 fine sterling silver
art bars and medallions, provided that the ingots, art bars and
medallions are marked by the refiner or fabricator as to their
assay fineness."
EFFECTIVE DATE: This ordinance shall be effective
thirty days after its adoption, and the City Clerk shall certify
to the adoption of this ordinance and cause it to be published at
least once in the Carlsbad Journal within fifteen days after its
adoption.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 7th day of February ,
1984, and thereafter
