CITY ATTY CITY MGR _ V2 Q UJ RECOMMENDED ACTION: Adopt Resolution No. r7<£~&($ _ , revising school fees in the San Dieguito School District. EXPLANATION: The San Dieguito School District has submitted a letter requesting revision of school fees. The District is recommending reducing the fee for multi- family attached homes due to a lower pupil generation factor in multi-family units. The fee revision is summarized as follows: Present Fee Single or mul t i - f ami ly 3 or more bedrooms $1995 Single or multi-family 2 bedrooms $ 863 Multi- family 1 bedroom $ 324 Revised Fee Single Family - Detached Housing $1995 3 bedrooms 2 bedrooms $ 863 1 bedroom $ 324 Multi-family - Attached Housing 3 bedrooms $1396 2 bedrooms $ 604 1 bedroom $ 226 The present fees become effective November 1, 1983. The Municipal Code allows the Council to adjust fees from time to time by Resolution. The revised fees will become effective March 1, 1984.a.Q. Fiscal Impact OO No direct fiscal impact on the City. Deouty City :ierk Enc. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO.7506 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING RESOLUTION NO. 5998 REVISING THE AMOUNT OF FEES TO BE REQUIRED AS A CONDITION OF APPROVAL FOR RESIDENTIAL DEVELOPMENT WITHIN CERTAIN AREAS OF THE SAN DIEGUITO UNION HIGH SCHOOL DISTRICT. WHEREAS, pursuant to Chapter 4.7, Division 1, Title 7 of the California Government Code, the City Council of the City of Carlsbad, California has adopted a School Facilities Dedication and Fee Ordinance (Carlsbad Municipal Code Chapter 21.55); and WHEREAS, Section 21.55.150 of the Carlsbad Municipal Code provides that the standards for the amount of fees to be required pursuant to such ordinance shall be determined by the City Council and set by resolution. The City Council's determination is to be made after consideration of recommendations from the governing board of the affected school district; and WHEREAS, the City Council established standards for the amount of fees to be required pursuant to Chapter 21.55 in Resolution No. 6010; and WHEREAS, the City Council is in receipt of recommendations in regard to revised amount of fees from the San Diequito Union High School District. Their recommendation is attached hereto as Exhibit A, and is made a part hereof; and WHEREAS, the City Council fully considered the matter at the regular meeting of February 21, 1984 at which time the City Council determined to concur in the revised standards as recommended by the Board of the San Dieguito Union High School District; NOW, THEREFORE, BE IT RESOLVED by the City Council of 1 Carlsbad: 2 A. That the above recitations are true and correct. 3 B. That the standard for the amount of fees to be required 4 as a condition of approval for residential developments within 5 that portion of the City of Carlsbad, which is also within the 6 boundaries of the San Diequito Union High School District, shall 7 be as contained in Exhibit A. 8 C. This determination is based upon the City Council's 9 concurrence in the recommendations made by the Governing Board 10 of the San Dieguito Union High School District, including the 11 facts supporting such recommendations as contained in Exhibit A. 12 D. Unless the decision making body especially determines 13 to the contrary, the City Council hereby determines that the 14 development of fifty units or less: 15 1. All such developments shall be required to pay fees in accordancd with the schedule in Exhibit A. 16 2. The City Council has reviewed that portion of the 17 General Plan which applies to the San Diequito Union High School District and finds that it 18 provides for the location of public schools. 19 3. That the fees to be paid shall be used for the purpose of providing interim school facilities. 20 4. That the fees to be paid for each unit bear a 21 reasonable relationship to the burdens placed on the School District by such unit and that the 22 fees will be used to mitigate that burden. 23 5. That the school facilities to be funded by the fees are consistent with the City's General Plan. 24 E. The standards adopted by this resolution do not at this 25 time require the dedication of land. The San Dieguito Union 26 High School District is developing standards regarding such 27 dedications. When the District is prepared to make their 28 recommendations in that regard, the City Council intends to amend this resolution to include provisions for requiring the dedication of land as they determine to be in the public interests. F. The action provides for a lesser fee structure for multi-family attached homes. The schedule is attached for your information and use.
