E N G SUMMARY STREET VACATION OF PERENNE PLACE TITLE: -PR 6S4-D CITY MGR.~ ~~~~ RECOMMENDED ACTION: Adopt Resolution No. 75/7 to summarily vacate Perenne Place and a 10-foot tree easement. ITEM EXPLANATION: Shape11 Industries, the Subdivider of Monarch Village (CT 83-l), has requested the vacation of Perenne Place and a 10-foot tree planting easement. The Subdivider has also submitted a final map for a 120-unit condominium project. This street was designed and constructed by the Developer to serve the model homes for Monarch Homes. The model homes have been removed and the street has been real i gned. The utility companies were notifited of the proposed vacation. Staff recommends the summary vacation of Perenne Place. FISCAL IMPACT: Approximately 21,000 square feet of land will be returned to the tax roll if the the vacation is approved. EXHIBITS : 1. Location Map 2. Plat and Legal Description 3. WHEREAS, that easement previously dedicated contains no public facilities or appurtenances, and provides no usable access to the adjoining property; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That an easement for all utility purposes is excepted from this vacation. 2. That a 10-foot tree planting easement is no longer necessary due to realignment of Perenne Place. 3. That the above facts are true and correct. 4. That Perenne Place, located in the City of Carlsbad, County of San Diego, State of California, particularly described on Exhibit "A", attached hereto and by this reference incorporated herein has been realigned and is unnecessary for street purposes. 5. That the City Council, pursuant to Section 8330 of Chapter 1050 of the California Streets and Highways Code, does hereby make this order vacating said Perenne Place conditioned on the approval of the final map of Carlsbad Tract 83-1. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council held on the 6th day of March , 1984, by the following vote, to wit: AYES: Council Mrs Casler, -is, Kulchin, chick and Prescott NOES: No= ABSENT: mne ATTEST : ALETHA L. RAU (SEAL) -J LEGAL DESCRIPTION All of Perenne Place as dedicated by Carlsbad Tract No. 75-5, Map No. 8379, in the City of Carlsbad, in the County of San Diego, State of California, said Map filed in the Office of the County Recorder of San Diego County on September 14, 1976. Also vacating a 10-foot tree planting easement. Excluding from the above street vacation all existing easement for uti 1 i ty purposes.
