ASSEMBLY BILL 2239
Most types of private clubs in California are required not to
discriminate as a condition of licensure by the Department of
Alcoholi~'Beverage Control. Generally these are types of
organizations for which licensure has been authorized since 1976.
Clubs licensed prior to this date are not required to meet this
standard and it is these clubs on which AB 2239 is focussed. The
reason for this is that many of these clubs are used for business
purposes for which tax deductions are taken. Where these
organizations discriminate, the state, through its licensing and
taxing practices, subsidizes this behavior to t1'1e economic
disadvantage of persons who are excluded.
