HD.,t�, MTG.-3 20 84 TAX AT STATE PARK CAMPSITES CITY ATTY DEPT. CA CITY MGR. RECOMMENDED ACTION: If the City Council wishes to adopt the transient occupancy tax at state park and private campsites your action is to introduce Ordinance No.1L43-_- ITEM EXPLANATION The City Council at your meeting of March 6, 1984 directed the City Attorney to prepare an ordinance imposing the City's transient occupancy tax at state park and private campsites in the City of Carlsbad. An ordinance in that regard is attached. Chapter 3.12 of the Carlsbad Municipal Code imposes the City's 6% transient occupancy tax on the "occupancy" of all "hotels" to be collected by the "operator". Section 3.12.020 defines to terthe occupancy, hotel and operator. Ord No. would definitions of that section as follows: 1. State parks and private campgrounds would be included in a definition of hotel. 2. The use of campsites in such campgrounds for recreational vehicles or tents would be included in the definition of occupancy. 3. A state would be included in the definition of operator. These changes in the definitions would make the tax imposed by in chapter 3.12 applicable to state park and private campgrounds the City of Carlsbad. It is my observation, based on over 30 years of camping, that the occupants of ; these site are average taxpapers who cannot afford hotels and motel.
