Approve Resolution 7.53 designating the Director of Utilities & Maintenance
as the Water Master as per the San Diego Regional Water Quality Control Board
Order No. 84-10.
ITEM EXPLANATION:
The City made application to the San Diego Regional Water Quality Control Board
(SDRWQCB) on December 8, 1983 to purvey reclaimed water purchased from the San
Marcos County Water District and approved for discharge in the Carlsbad water
service area or in the City limits. This area is generally south of Palomar
Airport Road, East of Interstate 5, North of La Costa Avenue and West of the
Eastern City limit. The RWQCB approved this application at their meeting of
January 23, 1984 and included as a provision of approval, that Carlsbad designate
a Water Master.
The Water Master is responsible for "the installation, operation and maintenance
of the reclaimed water conveyance system in accordance with the appropriate
State Health Regulations and Guidelines, prevention of potential hazards, and
maintenance of the conveyance system plans in "as built" form, and for conveyance
of reclaimed water in accordance with this order". This responsibility is
consistent with the assigned duties of the Director of Utilities & Maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA DESIGNATING A RECLAIMED
WATER WATER MASTER
WHEREAS, the San Diego Regional Water Quality Control Board approved
Order No. 84-10 designating the City as the purveyor of reclaimed water
for specified areas of the City and,
WHEREAS, Provision 5 of Order 84-10 requires that the City designate a
Water Master to be responsible for the conveyance of reclaimed water.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad that the Director of Utilities and Maintenance is designated
the Water Master for the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council
held on the loth day of March , 1984, by the following vote, to wit:

WATER RECLAMATION REQUIREMENTS
FOR THE CITY OF CARLSBAD
FOR THE PURVEYANCE OF RECLAIMED WATER
SAN DIEGO COUNTY
_• The California Regional Water Quality Control Board, San Diego Region (herein-
after Regional Board), finds that:

' 1. By letter dated December 8, 1983, Mr. Roger W. Greer, Director, Utilities &
Maintenance, City of Carlsbad reported that the City of Carlsbad intends
to execute an agreement with the San Marcos County Water District wherein
the City of Carlsbad will purchase wholesale reclaimed water from the San
Marcos County Water District and sell the water to various users within
the city.
2. The reclaimed water would be delivered to Carlsbad from the San Marcos
.: County Water District's Meadowlark Water Reclamation Plant through an
existing reclaimed water reservoir and emergency effluent disposal pipe-
line which is owned and maintained by the District.
3. Order No. 79-23, "Waste Discharge Requirements for San Marcos County Water
District, Wastewater Reclamation Project near San Marcos Creek" was adopted
by this Regional Board on March 26, 1979. Order No. 79-23 and Addenda
thereto serve as waste discharge requirements for the Meadowlark Water
Reclamation Plant.
4. As a result of planned public use of the areas proposed for irrigation
with reclaimed water treated at the Meadowlark Water Reclamation Plant,
there is potential for substantial human contact with wastewater used
for irrigation and, therefore, a potential public health problem.
5. Pursuant to Section 13523 of the California Water Code the Regional
Board, after consulting with and receiving the recommendations of the
State Department of Health Services, in order to protect the public
health, safety or welfare, may prescribe water reclamation requirements
for water which is used or proposed to be used as reclaimed water. The
purpose of this Order is to prescribe water reclamation requirements for
wastewater purveyed by the City of Carlsbad (hereinafter purveyor).
6. The Regional Board has notified the purveyor and all known interested
parties of its intent to prescribe water reclamation requirements for
purveyance of reclaimed water.

7. The Regional Board, in a public meeting, heard and considered all com-
ments pertaining to the use of wastewater for landscape irrigation.
8. These reclamation requirements govern the purveyance of reclaimed water
treated at the Meadowlark Water Reclamation Plant to persons using such
water for landscape irrigation. Such activity constitutes only a minor
modification to land and such activity is thereby exempt from the provi-
sions of the California Environmental Quality Act (Public Resources
Code, Section 21000, et seq.) in accordance with Section 15304, Chapter 3,
Title 14, California Administrative Code.
IT IS HEREBY ORDERED, That the City of Carlsbad shall comply with the following
for the conveyance and purveyance of reclaimed water.
A. RECLAIMED WATER PURVEYANCE SPECIFICATIONS
1. Reclaimed water shall only be purveyed to areas for which valid
waste discharge requirements, as established in Order No. 79-23
and Addenda thereto, are in force. Prior to purveying reclaimed
water to any other area or to persons using such water for any
other purpose, the City of Carlsbad shall obtain proper authoriza-
tion from the San M?:-Cos County Water District and this Regional
Board. The City of Carlsbad shall not purvey reclaimed water to
any person until and unless such person obtains water reclamation
requirements from this Regional Board.
2. All conveyance of reclaimed water shall be in accord with the rules
and regulations contained in the "City of Carlsbad, Reclaimed
Water Standards."
3. Conveyance of reclaimed water from the San Marcos County Water Dis-
trict Meadowlark Water Reclamation Plant to reclaimed water users
within the City of Carlsbad shall be under the direct control of the
City of Carlsbad and/or the San Marcos County Water District.
4. Bypassing or direct discharge of reclaimed water to San Marcos
Creek or tributaries thereof, or to any inland watercourse, is
prohibited.
5. Conveyance of reclaimed water shall not cause a pollution, contamina-
tion, or nuisance, as defined by Section 13050 of the California
Water Code.
6. Reclaimed water shall not be purveyed to persons who use, transport,
or store such water in a manner which causes a pollution, contamina-
tion, or nuisance, as defined by Section 13050 of the California
Water Code.

7. Reclaimed water shall not be purveyed to users unless such water
is in compliance with the effluent limitations for the San Marcos
County Water District Meadowlark Water Reclamation Plant specified
in Order No. 79-23 and Addenda thereto, and unless such water
conforms with the provisions of Article 4, Title 22, Division 4
of the California Administrative Code in their present form or as
they may be amended.
B. PROVISIONS
I. The City of Carlsbad shall allow the Regional Board, or an
authorized representat4we upon the presentation of credentials
and other documents as may be required by law, to:
(a) Enter upon the reclaimed water purveyor's premises where a
regulated facility or activity is located or conducted, or
where records must be kept under the conditions of this
Order;
(b) Have access to and copy, at reasonable times, any records
that must be kept under the conditions of this Order;
(c) Inspect at reasonable times any facilities, equipment
(including monitoring and control equipment), practices,
or operations regulated or required under this Order; and
(d) Sample or monitor at reasonable times, for the purposes o'
assuring compliance with this Order or as otherwise authorized
by the California Water Code, any substances or parameters
at any location.
2. Prior to purveyance of reclaimed water the City of Carlsbad shall
submit copies of "City of Carlsbad, Reclaimed Water Standards" to
the State Department of Health Services; San Diego County, Depart-
ment of Health Services; and the Regional Board. The purveyance
of wastewater shall not be initiated until the City's regulations
for reclaimed water use have been received and accepted by the
Executive Officer.
3. The City of Carlsbad shall enforce the City's rules and regulations
for reclaimed water use.
4. Prior to delivery of reclaimed water, the purveyor shall submit a
letter from the user, certifying that the operation of the reclaimed
water service will be in accordance with the appropriate portions
of Title 22, Division 4 of the California Administrative Code and
the State Department of Health Services' publications titled
Order No. 84-10
"Regulations Relating to Cross Connections," "Guidelines for Use
of Reclaimed Water for Irrigation and Impoundments," and "Guide-
lines for Worker Protection at Water Reclamation Use Areas."
5. A water master responsible for operation of the reclaimed water
conveyance system shall be designated by the City of Carlsbad.
He shall be responsible for the installation, operation and main-
tenance of the conveyance system in accordance with the appropriate
State Health Regulations and Guidelines, prevention of potential
hazards, and maintenance of the conveyance system plans in "as -
built" form, and for the purveyance of the reclaimed water in accord
with this Order. The name of the water master shall be furnished to
the Regional Board within 30 days of the adoption of this Order.
6. The designated water master shall report any noncompliance with
this Order to the Executive Officer. Any information shall be
provided orally within 24 hours from the time the water master
becomes aware of the circumstances. A written submission shall
also be provided to the Executive Officer within five days of
the time the water master becomes aware of the circumstances. The
written submission shall contain (a) a description of the noncom-
pliance and its cause; (b) the period of noncompliance, including
exact dates and times, and if the noncompliance has not been corrected,
the anticipated time it is expected to continue; and (c) steps taken
or planned to reduce, eliminate, and prevent recurrence of the
noncompliance. The Executive Officer, or an authorized representative,
may waive the written report on a case -by -case basis if the oral
report has been received within 24 hours.
7. The name of the designated water master shall be furnished to the
Regional Board at the following address:

8. This Order is not transferable to any person except after notice to
the Executive Officer of this Regional Board. The Regional Board
may require modification or revocation and reissuance of this Order
to change the name of the discharger and incorporate such other
requirements as may be necessary under the California Water Code.
9. The purveyor must notify the Executive Officer, in writing, at
least 30 days in advance of any proposed transfer of this Order's
responsibility and coverage to a new purveyor. The notice must
include a written agreement between the existing and new purveyor
containing a specific date for the transfer of this Order's respon-
sibility and coverage between the current purveyor and the new
Order No. 84-10 _5_
purveyor. This agreement shall include an acknowledgment that
the existing purveyor is liable for violations up to the transfer
date and that the new purveyor is liable from transfer date on.
