Fjnance RECOMMENDED ACTION: Approve the refund of the following fees: Ponderosa Homes $32,148.00 ITEM EXPLANATION: The following fees have been collected by the city and should be refunded to the appropriate parties: NAME Ponderosa Homes 11300 Sorrento Valley Rd. Sui·te 100 San Diego, Ca. 92121 FISCAL IMPACT: AMOUNT REASON $32,148.00 Ponderosa Homes is building a subdivision which is in two school districts, both Carlsbad and San Marcos. The developer tried to make arrangements with the districts to allow all child- ren from the subdivision to attend: one school. As part of their effort, the developer paid San Marcos school fees on the entire development. Since then, the school districts have been unable to reach agreem~pt on the single school issue. The developer has now paid Carlsbad school fees and is requesting a refund of a por- tion of the fees paid to San Martos school district. San Marcos has refunded $32,148.00 to the city which the city should now refund to the developers. (Refund received 4/16/84) Any refund of fees reduce the amount of revenue available to the city; however, the city may not retain fees collected with the intention of using said fees for a deposit to guarantee the completion of a task once the task is completed.
